I did reveiw your site plan again and since the existing house already lays within the setbacks on the northeastern side of the property, it would be an expansion of a non -conforming use. Therefore any addition that you make to this nonconforming use would require a use permit. I hope that this helps to explain it better. Below is the code where this determination comes from: 24-35.20 Change or expansion of nonconforming use. Except as hereinafter otherwise provided, no nonconforming use shall be expanded, enlarged, extended, reconstructed, substituted, or structurally altered unless made to conform to the use standards and regulations for the zone within which it is located. Provided, however, that any nonconforming use may be changed to another nonconforming use, expanded, enlarged, extended, reconstructed, or structurally altered upon obtaining a use permit from the planning commission.
