On December 12, 2002, the Department of Public Works made the finding that the Certificate of Merger
on the above referenced property is exempt from environmental review, and approved the project subject
to the following conditions
PUBLIC WORKS CONDITION:
1. Provide approved access to new parcel B.
BUILDING DIVISION CONDITION:
2. Verify each remaining parcel is served with utilities maintained on their respective parcels (well,
septic, electric, etc.).
We will record the certificate after verification from each department that the conditions have been
satisfied.
Should you appeal the decision of the Department of Public Works, please submit your appeal, in writing,
with the appeal fee of $50.00, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville,
California, prior to 4:00 p.m., December 23, 2002.
If there are no appeals, we will submit the Certificate of Merger to the Butte County Recorder's office for
recording and processing, and we will return your certificate to you.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Paul and Carol Condon are hereby granted an Administrative
Permit in accordance with application filed: November 3, 1994 to allow a detached Senior
Citizen dwelling unit on property zoned AR -1 (Agricultural Residential) located on the
northwest side of Grey Fox Lane, approximately 200' north of Mt. Ida Road in the Oroville
Area.
I. Failure to comply with the conditions specified herein as the basis for
approval of application and issuance of Permit, constitutes cause for the
revocation of said permit in accordance with the procedures set forth in the
Butte County Zoning Ordinance, including Butte County Code Section 24-
62.
2. Unless otherwise provided for in a condition to an Administrative Permit, all
conditions must be completed by the permittee within 12 months of the
delivery of the countersigned permit to the permittee.
3-- If any use for which an Administrative Permit has been granted is not
established within one year of the date of receipt of the countersigned
permit by the permittee, the permit shall become null and void and
reapplication shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and
assigns of the Permittee.
SPECIAL CONDITIONS:
1. The "living area" meaning the interior habitable floor space area of a dwelling unit
including basements and attics, but not including a garage or any accessory
structure, shall not exceed 1,200 square feet.
2. The senior citizen dwelling unit is intended for the sole occupancy of one (1) adult
62 years of age or over or two (2) adult persons, one of whom is 62 years of age
or over. An affidavit of compliance with the age requirements of this section shall
be recorded in the office of the Recorder prior to issuance of building permits.
Said affidavit shall include the legal description of the lot or parcel and shall
constitute a covenant running with the land, binding upon the original owners and
their heirs, successors and assigns, limiting the occupancy of the senior citizen
dwelling unit to the conditions described in this section.
3. The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel
containing the unit is created in compliance with the existing zoning and
subdivision ordinances and the resulting density is in conformance with the
General Plan.
4. Two off-street parking spaces shall be provided for the senior citizen dwelling unit
in addition to the parking spaces required for the primary dwelling unit.
5. Adequate sewer and water facilities shall be provided subject to the approval of the
Environmental Health Division.
6. All site development standards as required by the zoning district in which the unit
is located shall be met.
7. Meet the requirements of PRC 4290 except for the requirement for on site water
storage. Placement of the new structure must be at least 30 feet from the closest
property line.
8. The approval of this permit constitutes approval only to the extent that the project
complies with the Butte County Code and all other applicable regulations.
9. The requirements of all concerned governmental agencies having jurisdiction by
law, including but not limited to the issuance of appropriate permits, shall be met.
NOTE: Minor changes may be approved administratively by the Director of Development
Services or designee upon receipt of a substantiated written request by the applicant.
Prior to such approval, verification shall be made by each Department or Division that the
modification is consistent with the application, fees paid and environmental determination
as conditionally approved. Changes deemed to be major or significant in nature shall
require a formal application for amendment.

NOTE: Issuance of this Administrative Permit does not waive requirement of obtaining
Building and Environmental Health Division permits before starting construction and their
approvals prior to use or occupancy, nor does it waive any other requirements.
