As you know, a default judgement was obtained against Mr. and Ms. Sturgeon. That judgement is set to be executed upon or enforced by the Butte County Sheriff's Department on Wednesday, September 26, 2001 on or after 6:01 a.m. The right to the use, possession and control of the property does not revert to you until the judgement for possession is enforced by the Sheriff's Office pursuant to the Notice to Vacate previously posted at the premises. However, I have been informed that you have already improperly and illegally retaken possession i to the property, thereby interfering with Mr. and Ms. Sturgeon's right to the use of and access to the property. Specifically, you changed the locks and/or locked gates on or about September 17, 2001. This has prevented Mr. and Ms. Sturgeon from completing their move out from the premises, and prevented them from doing the routine clean up which they otherwise would have done prior to formally and completely vacating. There are several consequences to the aforementioned improper activity. One, pursuant to Civil Code Section 789.3, there is a potential fine of up to $100.00 per day for each day you have improperly interfered with or prevented Mr. and Ms. Sturgeon's access to the property. Since your interference has been on going, and you will not have the legal right to the property until September 26, 2001, this statutory fine or penalty will have accrued for at least nine (9) days, or a total statutory penalty of up to $900.00. In addition to the aforementioned penalty, Civil Code Section 789.3 also provides for actual damages, including attorney'' fees and court costs. Actual damages in this case remain to be determined. Likewise, attorney's fees and court costs incurred as a result of your improper activity have yet to be determined. For the moment, there are only $125.00 in attorney's fees. Actual damages would be at least the value of personal property that Mr. and Ms. Sturgeon have not been able to move due to your improper conduct. Specifically, the items in question which they have been prevented from reclaiming are an ice chest ($20.00), lawn mower and gas can ($200.00), Kirby vacuum cleaner ($1,500.00), and three (3) to four (4) boxes of miscellaneous household cleaning items and personal effects ($200.00). Once the right to possession is legally and properly awarded to you as ofWednesday, September 26, 2001, you are under an obligation to properly store the aforementioned items, and under a specific statutory obligation to give Mr. and Ms. Sturgeon or their agents reasonable access to the property to remove their personal possessions. (Civil Code Section 1965; 1980 et seq.). Mr. and Ms. Sturgeon have fifteen (15) days from the date the Notice to Vacate was enforced by the Sheriff's Department within which to reclaim their property. Reasonable access to do so must be given to them by you. You are entitled to charge only for the reasonable storage value for the number of days their personal property remains at the premises after September 26, 2001. "Reasonable storage value" under these circumstances means the per day rental value of the house. However, since you prevented Mr. and Ms. Sturgeon from moving their property in a timely manner in the first place, there is a valid argument to make that you may not now charge for storage. You should contact Mr. and Ms. Sturgeon immediately to confirm a time for them to be given reasonable access to the property so that they may remove their remaining possessions. Millard Sturgeon will be able to promptly contact either Barbara or Christopher Sturgeon to confirm the time for them to reclaim their personal property. In order to reduce your potential liability, you should confirm arrangements by phone for the pick up and removal of their property immediately. A second issue which needs relatively prompt attention is that of the utility bill. As you know, there is a shared meter at the premises. The imposition of this shared meter upon Mr. and Ms. Sturgeon as part of their rental agreement was not done in compliance with Civil Code Section 1940.9. Accordingly, you as well as the beneficial'user of the utilities (tenant in garage. unit) are responsible to reimburse Mr. and Ms. Sturgeon for their increased or additional utility costs. Based upon the average usage attributable only to them, the excess or reimbursable utility bills appear to be at least $1,000.00. Mr. and Ms. Sturgeon are informed and believed that there is only one utility meter because the rental in the back was built without the necessary permits. If so, that could be a further violation of your landlord/tenant responsibilities. The entire rental contract may have been an "illegal" one, meaning not in compliance with California law, or applicable zoning and code requirements. If their rental contract was an illegal one as defined above, Mr. and Ms. Sturgeon may also have a claim for reimbursement for some, if not all, of the rent they previously paid to you pursuant to that contract. Separate and apart from the foregoing, it is Mr. and Ms. Sturgeon's position that they were constructively evicted. Although a default judgement was entered against them, that judgement is capable of being set aside. Depending upon whether this dispute settles or not, a motion to set aside and vacate that default will be made. The Sturgeon's damages case would proceed thereafter as may be needed. Mr. and Ms. Sturgeon were "constructively evicted" because they were forced to move due to your ongoing harassment or interference with their peace and quiet. The level of harassment rose to a breach of the covenant of quiet enjoyment, thereby constructively evicting Mr. and Ms. Sturgeon. They were compelled to move due to your ongoing harassment and interference with their rights. Accordingly, they are entitled to reimbursement for their moving expenses, even if the underlying contract was proper, legal and enforceable. The record in this case indicates that you knew, or should have known, that the unit in the back was improper. That is, you knew or should have known that it didn't have the requisite permits. You appeared to have taken steps to affirmatively "hide" that situation by having a common meter, instead of a separate meter that would normally be required. It is actionable conduct in California not to disclose a known defect in rental premises. You, as well as your agent, are also under a duty to disclose any such known or apparent defects (code and zoning violations etc.) to prospective purchasers. As you know, Mr. and Ms. Sturgeon had a right of first refusal to purchase the property. Your failure, and the failure of your agent, to disclose known defects is a further violation of California law. Finally, at least for the moment, there is Mr. and Ms. Sturgeon's security deposit of $550..00. Pursuant to California law; that deposit must be returned to them, or properly accounted for within twenty-one (2 1) days of when they vacate. Since they were improperly a evicted by you due to your self help eviction as of September 17, 2001, the twenty-one (2 1) days should start from that date. In that regard, if Mr. and Ms. Sturgeon are obligated to pay any rent for the month of September, it would only be up to September 17, the date you improperly changed the locks. It is their position that they do not owe any rent for September, due to your breach of the covenant of quiet enjoyment, due to the utility credits they are owed, and due to the statutory penalties and damages referred to in this letter. If you fail to return the deposit or properly account for it, you can be held liable for an additional statutory penalty of up to $600.00. (Civil Code Section 1950.5). In summation, although Mr. and Ms. Sturgeon's tenancy is soon to be formally terminated, this dispute appears to be far from over. To minimize your liability, you should immediately contact Mr. and Ms. Sturgeon at 510-0055 so that arrangements can be made for them to reclaim their personal property.
