Dear: Lawrence Kirby:
This is a formal warning notice. Pursuant to Butte County Code (BCC) Section 41-2, we sent you a courtesy
notice dated July 21, 2003, notifying you that you are in violation of the BCC, and 1998 California Building Code
(CBC), at the above -referenced location. As of this date, the following violations still exist:
Failure to obtain the required permits, inspections and approvals from this office for the construction of a
new shop and the addition to a residence.

The above violations(s) shall be corrected or abated by you by submitting three (3) complete sets of plans,
applying for the required permits, and paying the appropriate fees, including penalties. After permit issuance and
field authorization to proceed, the work must be completed and approved by this office within the permit
specified time.
This is your final warning. Unless you contact this office and make the proper arrangements to correct or
abate the violation(s) voluntarily, within ten (10) days from the date of this letter, enforcement shall be
pursued through the issuance of a citation (ordering you to appear in court) for said violation(s) and for
failing to comply with this warning letter.
Upon conviction of said violation(s) or of failing to comply with this letter, the court shall impose penalties (fines)
and a Notice of Violation shall be recorded in accordance with Butte County Code Section 41-7. The Notice of
Violation shall include a description of the premises the violation concerns, a description of the violation, the date
of your conviction and the action necessary to correct or abate the violation(s).

Dear Lawrence Kirby:
This is a courtesy notice to notify you that you are in violation of the Butte County Code, at the above -referenced
location, as follows:
Failure to obtain the required permits, inspections and approvals from this office for the construction of a
new shop and the addition to a residence.
Since permits and inspections are required for the above work, please submit three (3) complete sets of plans,
apply for the required permits, and pay the appropriate fees. All work must stop until these permits are issued and
you are authorized by our field inspector to proceed. The field authorization cannot be made until the existing
work is inspected and approved.
It is the County's goal to obtain voluntary compliance with the Butte County Code. However, you should be
advised that Butte County has an active Code Enforcement Program which provides an effective means of
enforcement if voluntary compliance is not obtained. Enforcement may be pursued through the issuance of
citations, fines and the recording of a Notice of Violation including a description of the action necessary to abate
the violation.
You have thirty (30) days to voluntarily comply with the above directions or to present an acceptable plan for
abatement or corrective actions to be taken by you. Should you have any questions concerning this matter, please
contact Scott Rutherford or Michael Vieira in this office at the address or telephone number listed above.

Regarding my road right-of-way, I have a 20 foot deeded easement/right-of-way that runs between the
homes of Mr & Mrs.. Ed Kirby and Mr. & Mrs Titus Johnson.. Approximately 10 feet of that right-of-way
was being used prior to Mr. Ed Kirby, who has a commercial business on his residential property started
enlarging on his home and building out -buildings, expanding his house almost tripling the dwelling with
several new rooms and garage. He also tore down an old garage and replaced it with a much larger
building/garage, the extent of his project being a new dining room, plus a quite large room
upstairs/possibly more than one room and a garage drive-through below part of the expansion..
All of the expansion crowded his driveway on the other side of his house. Mr. Kirby made a new
driveway on the north side which circled the back of his home for customers and as a delivery entrance
for all work related traffic which happens to infringe on my road easement. Several times I have
encountered waiting delivery and customer traffic, partially blocking my entrance/exit. When I am
coming home from anywhere and the driveway Is blocked it puts me In an extremely precarious position
on Foothill Blvd. as only about 30 feet south of my driveway there Is a sharp curve which does not allow
for any reaction if somebody happens along on Foothill from the south. Coming from the North you
come down a hill from the Wyandotte cemetery and can see nothing until reaching the bottom except Mr.
Johnson's and my driveway, but no preview of the oncoming traffic around the curve, and several times
recently both my wife and I have been stuck waiting on the road for a vehicle to finish entering or exiting
while out on Foothill Blvd. which Is only two lanes with cars coming down the hill, and/or around the
blind curve very fast, attempting to avoid hitting me and blowing their horns at me for being on the road.
I talked to Ed and told him he needed to widen the driveway for better access. That made him mad. I
reminded him I had a 20 foot right-of-way. He then put In a post that extended all the way out to
Foothill Blvd that blocked me from making a right turn safely out of my driveway, as well as cutting my
driveway down to about eight feet. I then took his post down; I actually have no Idea what his problem
was all about, I thought Ed and I were friends. I soon found out in part; he has expanded his business
and has some kind of business going in the new garage. Now instead of the one employee which worked
for "Northern Golf Carts", he now has three employees, two of which do something full time In his new
garage with a big extension of the building attached. He also has moved in a couple of large trailers,
possibly for storage, and has quite a few old cars stored on the lot as well. Apparently this is the reason
he feels he needs my driveway, because he doesn't want all the dust and traffic so close to his living
quarters, instead he feels that he has a right to take part of my driveway and redirect his traffic and dust
into Mr. & Mrs. Johnson's home and yard instead.
Recently Mr. Titus Johnston, the people who own and live in the house at 4680 Foothill Blvd, In front and
myself went to the Planning Commissioner to check to see if Mr. Kirby even had permits for any or all of
the work he had done.. At that time we were told that there had been no permits Issued on that
property since 1977. To my knowledge all of this area is zoned for residential and agriculture, not
commercial, and I would appreciate it very much if there Is something that can be done to remedy these
problems.

To Whom It May Concern:
In the year 1973 at approximately the last part of May or the first part of June we purchased five acres of
land with a home from Mr. and Mrs. Eugene Oats. The transaction was carried out through a local real
estate agency, the agents being Mr. and Mrs. Holland. The home is located at 4680 Foothill Blvd., Oroville,
CA The previously mentioned transaction took, place in late May or early June of 1973.
At the time of the purchase Mr. Oats gave me a tour of the property as well where the adjoining property
lines were located. He took me to the comer at the back of the house toa big wooden post next to what he
stated was an easement road, which was on his property which, went back to some property behind our
property. At that time nobody lived there. He showed me the gates he had on the end of the easement and
said the easement road was on his property. A Mr. and Mrs. Charles Kinnard lived on the other side of the
easement in the back of his house.
W. Kinnard told me after we moved down here in August of 1973 that I had to keep watch on who was
coming and going on the easement. He was right, people would try to go in there hunting or even cut wood
and at times they would get in before we knew they were there, and at times would leave the gate open and
our animals would get out. It was a problem for us. During this time we were robbed twice, the first time
they took four guns and some other things. The last robbery took place while we were away, they took two
saddles and gear, aswell as a chain saw. Subsequently in 1981, after the robberies had taken place, we put
a five foot chain link fence around our house and got a couple of good guard dogs and have not been
robbed since that time.
The fence in the back of our property was put on the line that Mr. Oats told me was the property line. There
was never any dispute or problem with the Kinnards regarding property lines. Eventually Mr. Cook and
family built a home on the back parcel and moved there. I then took the gate down and built a fence up the
easement where they could go without opening gates as I knew he would keep people out who didn't
belong there as he would be able to monitor any problems in the back of the property from his home at 4686
Foothill. In the meantime Mr. Kinnard died and Mrs. Kinnard sold her property at 4688 Foothill Blvd,
Oroville, CA to Mr. Ed Kirby and family. He looked at the property so he did know what he had bought on
their word, just as I did when Mr. Oats told me what I had bought.
Mr. Kirby seemed like a good family man, he told me he works on golf carts which was no problem for me,
but soon he started to increase his business and his buildings in a very large volume. There were cement
trucks and dump trucks coming and going plus building supplies, etc. The dust was covering our house
and patio which rendered the patio useless as a patio, and really exacerbated my wife's asthma to the point
of severe illness. Shortly after that he had all of the extra dirt from the new road they were putting in hauled
" over the -easement right behind my home without watering the road, nor did he ask thepeople who own the
easement if he could even use it. This all took place in the summer when it was extremely dry and dusty.
Our house was covered with dust inside and out. Our house sits west of the easement and most of the wind
is from the east putting very little of the dust in his home. Our kitchen, bedroom and family room are all on
the East Side, which really made life extremely difficult for us.
Soon after the road was built he said he was going to put in fence to the new road down where no-one could
drive up to the front of his house and would funnel all of the traffic on the easement behind my house.
Needless to say, this upset not only me, but also my neighbor Jack, the man who owns and maintains the
easement. I put some posts and wire down the east side of the easement, then he said okay, you stay on
your property and I will stay on mine. He built a road on the other side and for the last couple years has
graveled it. For the last one -and -one-half to two years he has had two full time and one part-time workers in
his big new building. Apparently he ran out of room so now he's after more. He has a half to possibly one
dozen old cars, a couple of large trucks, a storage trailer and some other junk strewn over the property. He
has been building for about two years now and does not show any intentions of stopping. Jack Sisk (the
man who has the easement road) and I would like to know if he can do all of this in an agriculture district..
Recently Mr. Jack Sisk of 4686 Foothill Blvd. and myself went to the county to check on permits.
According to Butte County there have been no permits at all issued on that property since 1977 and we
would like this stopped. Mr. Kirby has always had a driveway on the other side of his house but rather than
get their kitchen and dining room filthy, and put up with the noise of all the trucks, traffic and dust, he feels
he has a right to detour his problems to the neighbors on the back side of his house and business. Also, if
you will examine the house closely there are no windows on the additions to the home on the side of their
house that faces us.
