(only applies if variance approved) , 11 ANALYSIS This project is a request for a Variance to the front yard setback to allow a building 47.6 ft, from the centerline of Greenview Circler in the Butte Creek Estates drea south of Chico, This application has resulted . from the foundation for a new home being placed too close to the centerline off,Greenview Circle, The need for aVariance was discovered by the Building bo,'tartment at the foundation instiection approximately 3 months ago, At that ti�t�e the applicant was informed of the procedures for filing for a variance and informed of the findings required by the Governiflent Code and Eutte ) '�IIE NO. AP 40-37-2 BUTTE COUNTY PLANNING C014MISSION 8'1`AFF FINDINGS - December 15, 198,.3 County ordinances "regarding hardship. Between that time and the date of application (November 29, 1983) construction has continued on the home to the point that the building is mostly completed. No other variances have been granted in the area and all other buildings in the area appear to be outside the setback area. The Building Department .has received the attached letter stating that if the Variance is not granted the building will be moved out of the setback area. If the Variance is granted it should be noted that; the subdivision map 1 creating the subject lot shows a 20 fte from edge of right-of-way building � setback area and the notes on the cover sheet indicate that this is also a light and air easement. Therefore, it will be necessary for the appli cant to abandon the light and air easement and modify the subdivision map inaccord.ance with the California State Map Act and Butte County Subdivision ordinance. This project is Categorically txempt from environmental review. f RECOMMt-NDATIONS, 1 A.
