County ordinances "regarding hardship. Between that time and the date of
application (November 29, 1983) construction has continued on the home
to the point that the building is mostly completed.
No other variances have been granted in the area and all other buildings
in the area appear to be outside the setback area. The Building Department
.has received the attached letter stating that if the Variance is not
granted the building will be moved out of the setback area.
If the Variance is granted it should be noted that; the subdivision map 1
creating the subject lot shows a 20 fte from edge of right-of-way building �
setback area and the notes on the cover sheet indicate that this is also
a light and air easement. Therefore, it will be necessary for the appli
cant to abandon the light and air easement and modify the subdivision map
inaccord.ance with the California State Map Act and Butte County Subdivision
ordinance.

24-49 of the Butte County Code in respect to finding of hardship
and deprivation of privileges; and

front yard setback area as shown on the site plan for AP 40-37-21

if the Commission can make the fundings required by Section 24.40 of the
Butte County 'Code and Section 65006 of theCaliforniaGovernment Code
with regard to hardship and deprivation of privileges, then it would be

Staff read the analysis from the staff findings
The hearing was opened to the public,
James Miller, Durham, stated that there was an error in the plot ,plan
that he was working from. He aj;so stated that this was an odd shaped
lot
The hearing was closed and comments confined t.o the Commission and staff.
Commissioner Behunin stated that the he went out and looked at the
