Listed below are all the acceptance tests for lighting systems. The designer is required to check the boxes by all acceptance tests that apply and list all equipment that require an acceptance test. If all equipment of a certain type requires a test, list the equipment description and the number of systems to be tested in parentheses. The NJ number designates the Section in the Appendix of the Nonresidential ACM Manual that describes the test. Also indicate the person responsible for performing the tests (i.e. the installing contractor, design professional or an agent selected by the owner). Since this form will be part of the plans, completion of this section will allow the responsible party to budget for the scope of work appropriately. The latest Use Permit we have in our files is UP 02-16, a 24 month permit which has not been established; thereby, declaring it null and void. Has the UP been updated? Use Permit 02-16 is for a 3,495 sq. ft. church. The plans state the building is 3,561 sq. ft. The minor upgrade in square footage is not a problem with the Fire Department— does it affect the Use Permit? 2. UP 02-16 requires: "Water for fire protection is required. The preferable system is a hydrant system capable of meeting the fire flow requirements. If this is not feasible, a system involving independent pumps, static water storage and dry standpipes may be substituted. Such a system is subject to the approval of the fire department. The available water flow from such a system must meet the general flow requirement. The minimum volume of water in storage must equal the fire flow for the type of project times 20 minutes. Provisions must be made to ensure the system is maintained to its design capacity. The above requirement per UP -02-16 was to be shown on all building plans. It is not shown on any plans. The fire flow for this project is: 1,500 gallons per minute (GPM) = 30,000 gallons of water storage (tank or well.) A reduction in required flow of up to 75 percent is allowed when the building is provided with an approved automatic sprinkler system. 3. Fire Department Access: California Code of Regulations Title 19, Public Safety, Div. 1 State Fire Marshal, Chapter. 1 General Fire and Panic Safety Standards, Subchapter 1 Administration, Article 3 General Provisions, Section 3.05. Fire Department Access and Egress. (a) Roads. Required access roads from every building to a public street shall be all- weather hard -surfaced (suitable for use by fire apparatus) right-of-way not less than 20 feet in width. Posting shall be by means of a durable sign having a contrasting color from the background to which it is attached. Signs shall be of an approved type and shall be maintained in a legible manner by the owner or his authorized agent and shall indicate the number of occupants permitted for each room use. The Tentative Parcel Map shows the church structure to be in the southwest portion of the property, adjacent to the Wyandotte Cemetery. However, the site plan for the Use Permit shows the church to be located in the middle of the property. It was pointed out that the size of the church structure as shown on the Tentative Parcel Map is much larger than that approved by the Planning Commission under the Use Permit. The change in the location and the size of the church/school structure must be approved by the Planning Commission at a public hearing. Butte County Code Sections 24-45.45 and 24-45.50 state that modifications to a Use Permit must be approved by the Planning Commission. A new Use Permit application, along with the applicable processing fees, must be submitted. Due to the new location of the church there may be additional conditions of project approval. Please note that the Butte County Building Division cannot issue a building permit for the church structure in the location as shown on the Tentative Parcel Map. At the Inter -Departmental Review Committee meeting it was also pointed out that vegetation clearing is occurring on the property. Condition # 4 of the Use Permit requires that a tree plan be submitted to and approved by the Planning Division prior to any vegetation removal, grading, road construction, or other earthwork. The vegetation removal and other site preparation activities are in violation of the Use Permit. As I am sure you are aware, the Use Permit has not been issued to you because several conditions of project approval, such as Condition # 4, must be complied with before the Use Permit can be issued. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a -use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Prior to use of the site for the proposed use the applicant shall contact the Planning Division for a field inspection to verify that all conditions and ordinance requirements have been met. Conditions of Approval: Planning Division 1. All new outdoor lights shall be fully shielded. Lights shall be directed downward and contained on-site. Timing: Requirements of the condition shall be adhered to while installing outdoor lighting and during all use of outdoor lighting. Monitoring: The Planning Division and the Public Works Department shall ensure that the conditions are placed on the Use Permit. Building inspectors shall spot check and shall ensure compliance on-site. Butte County Air Pollution Control District inspectors shall respond to nuisance complaints. (Mitigation Measure # 3) 4. Prior to Use Permit issuance, a tree plan prepared by a certified arborist, botanist, or landscape architect shall be provided to the Planning Division. The Plan shall be prepared in accordance with the following 2 V • Site improvements shall be made in coordination with the tree plan to ensure that development occurs in areas that would provide a minimum amount of disturbance with native oak trees and result in fewer trees being removed. • The applicant shall minimize the removal of trees deemed suitable for retention. The plan shall show the location of trees deemed suitable for retention, and trees to be removed. • Factors used to assess suitability of trees shall include health, location, and size of the tree. The plan shall encourage the retention of larger, healthier trees over smaller or diseased trees. • Each tree to be preserved in the vicinity of construction activities shall be surrounded by a tree zone identified by the drip line of the tree. An orange plastic fence or other suitable type of fence shall be used to identify the tree zone during construction activities to ensure that construction equipment does not compact the soil surrounding the tree. • No vegetation removal, soil disturbance, or other development activities shall occur within the tree zone in order to protect root systems and minimize compaction of the soil. Plan Requirements: No vegetation removal, grading, road construction, or other earthwork shall be permitted until the tree plan is submitted and approved. Timing: The tree plan shall be submitted to the Planning Division prior to site development and Use Permit issuance. Monitoring: The Planning Division shall ensure compliance through routine inspection and review. (Mitigation Measure #4) 5.. Perform the following requirements to minimize soil erosion: (a) All graded slopes, over 5 feet in height shall be seeded, planted, mulched/hydroseeded, or otherwise protected to prevent soil erosion. (b) Structures, dumping, fill material, vegetation removal, and/or excavation shall not be allowed in areas having a slope of 30% or greater unless an Erosion Control Plan prepared by a registered civil engineer or other qualified professional is submitted to and approved by the Department of Public Works. Plan Requirements: The erosion protection measures shall be implemented during all times of construction where graded slopes are created over 5 feet in height or where development is proposed in areas of 30% slope or greater. Timing: This measure shall be implemented during site preparation and construction. Monitoring: The Planning Division shall coordinate with the developer and perform routine inspections to ensure compliance. (Mitigation Measure #5) 6. All development activity shall be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday, and 10 a.m. to 6 p.m., Saturday, Sunday, and holidays. Plan Requirements: The mitigation shall be placed on the Use Permit as a condition and shown on all building plans. Timing: The mitigation shall be applicable during all construction activity. The applicant or developer shall be required to submit a development impact fee for Sheriff s facilities to be paid pursuant to the provisions of Chapter 3, Article II of the Butte County Code, prior to issuance of building permits. Thirty -Two (32) parking stalls shall be provided, two of which shall b disabled parkin stalls. In accordance with Butte County Code Section 24-240.10 (e), an additio of the gross lot area (approximately 850 square feet) shall be devoted to landscaping. Each planter area shall be surrounded by a six-inch raised concrete curbing or equivalent. An irrigation system shall be installed in each separate planter area. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The mitigation shall be required prior to the issuance of building permits. Monitoring: The Butte County Planning Division and Building Division shall ensure compliance. (Mitigation Measure #10) Public Works 9. Prior to site development and building permit issuance, a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how stormwater drainage shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no net increase in the peak flow runoff to said channel or facility. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. N Timing: The drainage plan shall be required prior to the issuance of building permits. Monitoring: The Department of Public Works shall be responsible for ensuring compliance with this mitigation. (Mitigation Measure #7) 10. Perform the following to the satisfaction of the Butte County Fire/California Department of Forestry: (a) Construction, installation or development of structures or facilities within this development shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulation in effect at the time of application for improvement permits. (b) Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. (c) Water for fire protection is required. The preferable system is a hydrant system capable of meeting the fire flow requirements. If this is not feasible, a system involving independent pumps, static water storage and dry standpipes may be substituted. Such a system is subject to the approval of the fire department. The available water flow from such a system must meet the general flow requirement. The minimum volume of water in storage must equal the fire flow for the type of project times 20 minutes. Provisions must be made to ensure the system provided is maintained to its design capacity. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: This Mitigation shall be implemented at the time of site construction and prior to issuance of final building permits.
