Re: Reclamation efforts by Ralph Witcher for CA. Mine ID#: 91-04-0017
Dear Ms. Ceccarelli:
On Monday, December 18, 1995, Mike Crump, Butte County Public Works Director, and myself,
drove out to Hamilton Nord Cana Highway to inspect the reclamation efforts of Mr. Witcher. It
was evident by the appearance of grading efforts, heavy equipment tracks, and the general
configuration of the boundaries of the mined site, that reclamation efforts had been employed. The
result is a pond that will be used by Mr. Witcher for cattle, when there is sufficient precipitation.
Natural grasses local for this area were already evident in propagating themselves in portions of
the reclaimed area. In discussing the nature, extent and effectiveness of these efforts, both the
Mike and I were in agreement that we believe the efforts shown by Mr. Witcher are sufficient.
I appreciate the fact that you are measuring Mr. Witcher's reclamation efforts by a reclamation
plan submitted by him to your office: It is not a plan that was submitted to the County, nor
approved by the County. Even so, the Butte County Public Works Department and the Planning
Division are satisfied with the reclamation efforts performed by Mr. Witcher.

Dear Mr. Whitcher:
The Department of Conservation's Office of Mine Reclamation
(OMR) sent you•a certified letter, dated June 2, 1995 (copy
enclosed) requesting the 1994 Mining Operation Annual Report for
your mining operation in Butte County.
Our.letter also notified you that failure to submit the
required annual report within 30.days of receipt of.the letter
could result in daily administrative penalties being assessed.
As of August 18, 1995; our office has not received the
required 1994 Mining Operation Annual Report and reporting fee.
Public Resources Code Section 2207(d)(6) requires that in
case of late payment of the reporting fee, a penalty of not less
than $100 or 10 percent of the amount due, whichever is greater,
plus interest at the rate of 1 1/2 percent per month, computed
from the delinquent date of the assessment until.and including
the date of,payment, shall be assessed.
The completed 1994 Mining Operation Annual Report, plus the
reporting fee, late fee, and interest must be sent to our office
within fifteen (15) days of your receipt of this letter, or a
daily administrative penalty will be assessed. PRC Section
2774.1(c) states that failure to file the required annual reports
shall result in an administrative penalty of up to $5,000 per*
day. Please send the required report and fees to:

Dear Mr. Whitcher:
A call from a concerned citizen prompted staff from the
Department of Conservation's Office of Mine Reclamation to
inspect the.above-referenced surface mining operation in the SE/4
of Section 14, T.23N, R.1W in Butte County. Staff determined
that this site was subject to the Surface Mining and Reclamation
Act (SMARA, Public Resources Code Section 2710 et. seq., copy
enclosed).
Additionally, Section 2207(a) of the Public Resources Code
(PRC) requires that the operator of any mining operation of
whatever kind•or character within the State shall file an annual
report by July 1 with the State. This includes federally managed
lands such as BIM and U.S. Forest Service lands.
Enclosed is the 1994 Mining Operation Annual Report form.
Please complete the form and return it with the associated
reporting fee by_ July 1, 1995.
Public Resources Code Section 2207(d)(5) requires that in
case of late payment of the reporting fee, a penalty of not less
than $100 or 10 percent of the amount due, whichever is greater,
