that a Use Permit would'b.e required before any explosives are
utilized for exploratory seismology.tests.,

TM -5 (Timber Mountain Zone) (b)(6) requires that a Use Permit

Dear Mike:
On November 13, 1984, the Board of Supervisors on
a 3 to 2 vote interpreted the above Butte County Ordinance
as requiring the landowners by and with Eno Mining Corporation
and the Placer :Management Group to obtain a use permit in
order to proceed with exploration testing through seismic
activity. Our office represents the Eno Mining Corporation,
Placer Panagement Group, and the landowners who desire to
pursue this exploratory activity by seismic testing without
obtaining a use permit and believe that the Ordinance does
not require a use permit given the nature of the work in
this particular case. We;request that the Board listen to
evidence explaining the nature of the seismic activity work
to be performed and that this work should not be construed
as objectionable.

This office represents the Del Oro Water Company,
an investor owned public utility, supplying domestic water
service to consumers in the Magalia area of Butte County.
The company's domestic water is drawn from ground water
sources underlying the immediate geographical area and which
appear at this time to be interconnected with ground waters
in the Steiffer Mine.
Some years ago, the company was involved in litigation
with the then apparent owners of the Steiffer Mine respecting
the impact of proposed mining operations on the ground water
source and ori the company's domestic water supply for the
community. The operators left their mine at that time for
various reasons. We are now informed of a renewed interest
in the operations of the Steiffer mine. We are not aware of
exactly who has this interest or their ultimate goals.
However,apparently one of the potential operators is Placer
Management Group of Reno, Nevada, represented in part by
Cooksley Geophysicist, Inc.,.of Redding, California.
This letter constitutes the formal request of the
Del. Oro Water Company for notice of any current or future
filings for permitsand/or approvals from your agency for a
mine, mine operations or the dewatering or other activity of
the Steiffer Mine, in Magalia,-Butte County, California.
Thank you in advance for your prompt consideration
of this matter.

STEIEFER MINE, MAGALIA
Ivlr:. David Donnelly, representing the Morningstar Development Company,
made o statement about the operations of. the Nbrningstar Development Company at the
Ste 1ffer Mine in Magalia. Background of the matter set out. The Company was aware
of the availabHi.ty.of water and the possibility of. tapping it. They. were going to
.contact the California Water Hoard and the Paradise Irrigation District. He stated that
circumstances -have developed that have caused them to postpone the .reining operation at this
time.
They have acquired the use of 10 acres of land north of themine; they will
conduct the operation away from the Steiffer shaft,
At present, alI activities for mining. has been terminated, Wnen.and if the -tome ever cot
comes that mining becomes feasible. they will acquire the necessary permits'. They did put up
a building Without a use permit;.it is going to be used for storage..
N1r. Donnelly stated he had talked with County Counsel and they are in. the.
process of getting together the appropriate papers..
Dan Blackstock, County Counsel, stated Mr. Donnelly has photos of the.
shaft in question.. This company would have to comply with. the law in the event this mine
were to go forward Mr. Blackstock stated that now would be a good time togo into the
question of water.
Apparently there is one water bearing strata which Del Oro Water Company
supplies to people in.the areo. The. issue of competitive water rights has been an issue.
It does not prohibit him from pumpi ng water out of the mine, At the present time, there
is on injunction against. this. company.. It prohibits any type contamination of the water
bearing strata. Mr... Donnelly.: read a letter from the Regional Water Quality Control
Board.
Other appearances regarding the. water problem:
I.. Mri Carter Nelson. He asked what the water.would be used for that the
company would pump out.. He felt that if the compcny tapped .the line, the water users
would get it through their lines. County Counsel explained the matter of water rights.
2. Bob Murphy, attorney at law, representing the Del Oro Water Company. .
He stated that the company is concerned over what is.beeing done up there now. He feels
that if the Water Quality board came up now, they would express a different view than set
out in their letter. This is going to be a water rights feud:. Their concern at this time is the
total lack of information. Mr. Murphy stated he had. gone overthe site and there was a lot
of activity up there. The County should be concerned as to what is going to happen.up there.
The injunction only. goes to the control of the quality of'the water. He stated that there will
be two representatives from the Water. Quality Control Board up here tomorrow, .

He spoke co.nceming the mirie .and the matter of the water. The water from the 09.110
Minewill. not be taken°by this operation.
5.. Rita %blfalk, Magatia, asked if the Vamingstar Mining Company was.
involved i'n mining of gold -or in collecting water.- She asked if the company was involved.
with .the. Paradise Irrigation Districts
Mr,Bl:ockstock said that. for the record, one of the reasons in discussing this

Route, Steiffer Road, Magalia is the company. working the proJect.
Pat Robuck i,s the "Man in charge. They have five. or six men.
clearing the dirt away at the bottom of the Steiffer Shaft.
They are about 350 ft. down. Water is right below them.. Wh.err
the dirt is cleared away they will p.ut ir, pumps and pump water
up to Pat Robuck's mobile home which is abouta mi..le north of
the Steiffer Shaft. They. also. intend to sell wat;.er° to PID by
pumping it. into the storm drain on Imperial Drive an.d letting
it drain . down into the lower Magal is Reservoir. They. have -a
large crane -at the Steiffer shaft which is shown In the pictuires..
North of the Stei ffe.r Shaft about ' a mile and .above . the Steiffer
Roadb Mr. Robuc-k has his mobile home and has. built a large metal
building.which.is his workshop. I understand that he did not.

As attorney for the Del .Oro Water Company, I am
writing this letter to request immediate action by your
office with respect to a threatened contamination. of domes-
tic water supply.
The Del Oro Water Company is a public utility
certificated to provide _ domestic and municipal water
service to the area of Paradise Pines in Butte County near
the community of rfagalia.. Its water source is ground water.
extracted from an alluvial basin through old . mine. shaf is
which have been. improved into domestic wells. The shafts
which f urnish the major amounts of ' water are the Corey Shaft
and the Magalia Shaft. The water supply is of high quality,
and the health authorities allow it to be used without treat-
ment of any kind.
The threat of contamination of this supply arises
from the fact that the owners. of another old mine shaft, the'
Steiffer Shaft which is located near the two shafts which
are used by the water company, have recently commenced op-
erations to .clean out the accumulated earth and other debris.
-in the Steiffer Shaft and open it up completely preparatory
to resu)ing mining_ The result will 'be to expose the. common
.ground waters upply which that shaft and the Corey and I_aga.
lia Shafts intercept to surface contamination and contamination'
from th'e proppsed minim operation.. Tunnels from these shafts
riay be in. close proximity to eachother so that contamination
in the Steiffer Shaft might readily travel to the water pumped
by the water company from the'other two shafts. If this were
to occur, the. eater company. could be unable to meet its obli-
gations to provide .a safe , potable water supply. to its customers.

On Deceiabar 2, 1371,, 1 received' a call from Mr.. Bob Fortino, Director of
Operations, requesting our Department's assistance In abating a potential
contamination threat to their water supply. Bob explained that work has
been started on, an abandoned mins.shart (Stalffer ,aline) supposedly for. the
purpose of nlning gold. The Del Oro Water Caa'pany is greatly concerned'
because t46 geographical location, the geological conditions and kna4rt
construction of the urine pose a potential danger to their cwn groundwater
supply located nearby and downstream From the mining operation.
Del .Oro Water Company serves -the Paradise nines, Fir Haven and' Del Oro
Estates subdivisions located about five miies north of Paradise, Butte
County. The. service, area encompasses almost' seven square tni-les. Thare
are presently approximately 1300 activs service connections, serving an
estimated population of 4,000. It is anticipated that the total-develop�me-nt
.6f the -area will include 6,.500 additional lots which can be served by the.
treater company.
Two of tha "wells" are old abandoned rains shafts which extend to ovar 500
feet below ground level. Lateral horizontal shafts at the base of the
vertical. ;;hafts reportediy extend in all directions l0t"..01.e3i-derab;e distances.
The third source, Well #5, Is'a conventionally constructed, deep waterweli-

a cciibinsd total capacity of 1,240,000 gal -ions. The water is bacteriologically,

Following my phone conversation with.u.el. Oro Water Company officials, I con-
tacted Noward Toussaint and. Charles Byrd of the County health Department, and
Anthonj t.ai►dis, ereginaer, California neq;onal Water :quality Control Hoard,.
Central liaNey ;legion, to discuss the problem and to set up a neet.ing to inves-
tigate the situation in the field. I a.1so talked to.Phil Kelly:, Manager,
Paradisa lrr!5ation District. On Decer+ber 3, 1976, Charles Ryrd, Anthony' Landis

The Stelffar M=ne, : !ch has been inactive for nany years, was originally aban-
doned because of the :,r«gat difficulty experienced inkeeping the :-nine pumped out.
Tile nirea is Located approximately 700 feet westerly of the Cory Mine (ell ;ri)
ana approximately one-half mile north of Naga? is Mine (`.Jell 421. th?. Stel Fer
Hine is reportedly over 300 feet daep and has a shaft that extends in a southerly

direction. The length of the shaft was not determined. Magaiia :Aire shaft is
reportedly 525 feet deep. South of Magal is Ntne, Dei Oro Water. Company has .four
more domestic water wells, of which only Vell No. 5 is presently In operation.
Well #5 is approximately -one mile south of M c:alle Mine and about 11 oiler south
of Steiffer M10 -a. All water sources tap the saner groundwater aqui for, .with a hyd-
raulic gradient In the southerly direction. A geahydrostatic profile, throug:�"a
cross-section line that.cuts through Cory fine, Magalis Mine an4 Well i5 shows the
bedrock formmtion at the bass of. Cary Bine to drop rapidly in the Airection of. Well
#5 (150 + feet in 11 ►titles). Hes Paulsen insists there is. a direct Tntere.6nnection
between Steiffer Mine and the underground water basin, affecting Mar

Company", hurray -McCormick cnvironuwental Group, 1x72, states that pumpin+l tests have

connected.
Maturally, Gel Oro Water Company is cunco�rnei on two grounds: (a) Wates` depletion
and (b) %~later pollution.

gine with a heavy crane and clamshell working on rwwvincg dirt and debris from the
open shaft.
According to Mr. Robuck, he plans to develop the mine for the purposes of. mining Vold.
He proposes to open thet wine, construct a steal ujine shaft 51-;eet x IC -foe t," from the
surface to bedrock, and urine below bedrock. Tall Ings are to be hauled away by 'truck to
be washed and processed at another site. He does not bxpect to have any significant
disc=harges and expects to maintain ail wastes on.eighty acres surrounding the nine.
Mr. Robuck states his sole purpose is to mina gold and that he has no interest what-
soever In the water supply and would take every precaution to protect the groundwater.
