The Regular Meeting of the Butte County Planning Commission was
held on Wednesday, September 23, 1959-

II MINUTES:
The Meeting was called to order by Chairman Albert J. Walsh.
The Minutes of the Regular Meeting of September 10, 1959 were
read and approved.
Chairman Walsh brotght up the matter of a reported subdivision
violation by Wm. F. Storz of paradise which was introduced at the last
meeting of the Commission, and Fee Chan explained the details as follows:
Mr. Storz has sold four parcels from his property on Edgewood Lane --
(1) to Elealeh Kern 0 Poole recorded June 7, 19510v (2) to ,Alfred D.
Lammers, recorded July 240 1952; (3) to E.G. Ide, recorded May 60 19529
and (4) to Wilhemina Storz (his sister), recorded July 29, 19576 and
owns a remaining parcel,, which activity Chan stated is in virl.ation of
the State Map Act and. the County Subdivision Ordinance
Mrd Storz appeared before the Commission and admitted the .facts
of sales as stated., but advised that the fourth sale was a gift to his
sisters Commissioner Meiss interjected the statement that it still
constituted a transfer of title4 Mrb Starz stated that the remaining
parcel which he owns is one Acre.
Chan stated that the procedure by the State is that the subdivider
file a map with the Planning Commission for review and consideration
Commissioner Moiss recommetnded that a map be ppoparod and submitted to
the Planning Commission for review and approval.
Motion was made by Commissioner Meiss � seconded by Commissioner
Bash, unanimously carried (Cop�missioners Hash, Cooper, Meise, Stott,
Watson and ;0hairman Walsh) that a tentativo map of the Wma P. Storz
Subdivision be submitted to the Planning C`ommVision within 30 days.
ITS CONSIDERATION OF SUBDIVISIONS:
A. Rexdale Heights Subd z is ,un, ':Merrill. Road, Parad i

A. Standards for Trailer Couros Crable
A report presentod by Mr a arable commenting on regulations
for Trailer 'Courts set forth in this proposed report of the Land
Use Committee, was read to tyre 01ommission. Contention of the
report is that, to regulate tha minimum site of a general, use is
not within the general zoning pwvera of the County. Also, regard-,
ing a further requirement set forth in the proposed re-oxlt of the
Committee providing that Use Pe.-3iits for Trailer Court vou:l4d not
be transferrable, Mr. Crablevr i,-ePort contends that, "this proposal,
which M3 no discernible bearing on the regulation and control of
land uses, might well be construed to be beyond the zoning posters
of the County"
Commissioner Meiss read a � ,;rt:fi.on of the San Bernardino
County Trailer Park O.rdinant a W�. Y t, -h s cipul.ates an area of at
least three (3) acres for a eras ,l er P,xk establishment; and Orango,
San Diego and Riverside County t,l. &,nauces are similar.
Considerable discussion ensued and the matter was tabled . for,,'
action at a later date after f'c'r(:hex5 study and consideration is
taken by the Committee.

and the Stave Division of Housi 2 Por approval.

Motion was made by Commissioner Bash, seconded by
Commissioner Cooper, unanimously carried (Commissioners Bash,
�ooper, Nieiss, Stotts Watson and Chairman Walsh) that the
Use Permit request of'Walter So Brownie be recommended for
approval as stated
2. Clayton NoSmithVariance from County Setback

Chan reported there were no protests presented at the
. ublic Hearing. It was explained that Niro Smiths requests
topreserve the greatest number of trees and that the 5 -foot
Variance requested would per,~:ib the proposed home to extend
further out than the other rouses on the street. Chan did not
feel that the request constituted a hardship case, although the
Public Works Department has no objection to the 5 -foot Variance.

request of Clayton N. Smith be recommended for uznial•

Inflammables and. Variance, Skyway, Magalia
Chan reported that the Use is _set for a Public Hearing
tomorrow (September 24th) The request concerns the enlargement
of underground storage capacity for inflammables at the Maga.? xa
postoff ce and a Variance of 5 feet for addition to the posto-Mce
b,ldingq and Chan recommended approval subject to the results of
the Public Rearing ano further subject to plans and specifications
boing submitted to the State Division of Forestry for approval.
Mr. Glander stated his department recommends a,ppr6VA1 of the

approval and then present them back to the Planning �;ommission
for action, which was the concensus of the Committee.
Mr, 0, H. Miller appeared before the Commission and '
stated that he will comply with all necessary requirements and
will appreciate more time to check with CAC.
Chairman Walsh recommended that the matter be deferred
and taker up at a later date when Mr. Miller has a definite
answer from GAC.

t1WHEREAS, MR. FRED H. NOTTELMANN has been a member of
this Commission since January 1957, h8.ving been appointed
thereto as a representative of Chico; and.
«WHEREAS, MR. NOTTELMANN during this period of time also
served as a member of the Planning Commission of the City of
Chico, and accordingly carried a double burden in the field
of planning throughout his term of service on this Commission;
and

For the CITY OF OROVILLE, California
We propose to prepare for the City of Oroville a suggested
Master Plan of Streets and Highways and related work as outlined
below.
The work will be completed in a good and skillful manner
Within ten (10) months from date of acceptance of the proposal for
a total fee of $4,200'. 00.
Work will be undertaken in close coordination with public
officials and agencies concerned with street,
parking problems, and with the Council and Planning Commission,
Periodic progress reports will be made to the Council and/or'
Commission in discussion and work session meetings, and plan
procedures and progress will, be discussed with the public, service
clubs) etc . as ,
may be desired during the working period
We will assist in the presentation of the proposed Master Plat:
in two public hearings to be held by the Planning Commission and
one public hearing to be held by the City Council. We will prepare
all necessary forms of re8'Olutions, notices of hearings, reports
and certificates.
We will deliver to the City two sats Of full scale study and
Plan maps, and one hundred copies of the Master Plan Report in
bound book form.

Gentlemen;
The 1969 Legislature passed Assembly Bill No: 1865 deal-
ing with two sections of the Streets and Highways Code. For
your information,, I have attached a copy of this bill as approved
by Governor Reagan j ly 14, 1969.. These provisions became
effective on November 10, 1969'„
The bill amends Section M5 to clarify previous un-
certainty regarding the meaning of this section. As now amended
a public hearing is required by the Board of Supervisors and
Planning Commission prior to making a recommendation regarding
either adoption of a State highway route by the Legislature or
the selection of a State highway location by the California High
way Commission.
The bill. also added Liction100.22to the code which
requires the Board of Supervisors toapublic hearing before
entering into a Freeway agreement with the Division of H ghWay's4
in ordev, to obtain more community involvement in these
highway developments it appears preferable to have these hearings
separate from the Division o:Highways or Highway Cornni:ssion
hearings held On these matters.

The Public Works Department requests that you give consideration and study to amending
the Streets & Highways portion of the Master Plan as follows:
(1) Stilson; Canyon Road--extend northeasterly up Little Chico Creek Canyon and tie
into the Preeway (highway 32) as shown in pink on the attached map. It will be neces-
sary for. the Board to request a change in the freeway agreement, adding a public road
connection to Highway 32 at the point indicated. It is my understanding that some
development is proposed in the irrmediate future s route and that
rear Highway 32 on this
