Parcel 52-1&1-13, located on Honey Run Road in Pared se,
The zoning at the time the use permit was granted was
4A-2 Limited Subsequently, on December 23, the area
was zoned "R-1% which restricts the use of the area to
single family dwelling units.:
Ordinance :gid. 1044 states that "a use permit not used within
one year of the date of granting chaff l automatically become
nu71 and void` It Mould therefore he several months Before
this use permit Mould expire, had the zoning remained `A-2
Limited".
The Building Department has questioned whether t4ey s6.ould
issue a building permit to Mr Burnside for the Duplex in
lieu of the "R-1" zoning on the property.
Question -- Does the use permit take precedence over the
"R-1" zoning, or bas the subsequent SYR^1" zoning nullified
the use perinit
