Commissioner Everbard's main concern was fire protection. Mr. Daniels said that there Was a Volunteer Fire Department in Forest Ranch that was attempting to raise money to build, a fire hall after which the County would provide a pumper. He also commented that the State Forestry Station was 4 miles north of Forest Ranch and Provided.protection for this area during the high danger fire season. Commissioner Bennett said that there had been many horror stories over the years regarding lack of water in the Forest Ranch and Cohas8ot areas, and said there should be some assurance that the water supply Would be adequate for all Who pov,chased properties in tRa area, In response to a question from commissioner Everhard regarding snow removal, Mr. Daniels said they had considered housing a snow vehicle on the project for use during the few times when such equipment would be needed. M1- i 1 BUTTE COUNTY PLANNING COMMISSION MINUTES - August 8, 1977 Mr, Lawson, in response to a question from one of the Commissioners assured them that their consideration regarding the availability of water was proper and related to the health, safety and general welfare of the public. Mr. Daniels said the first order of business would be to develop the necessary water supply and reminded the Commission that the project could not proceed without water. Robert Kutz,, 1000 The Esplanade, a Chico attorney speaking as an adjoining 240 -acme property owner, said that he feels this is an excellent development and a keystone in the further development of the area. He further stated that he has no financial interest in the project and had never met the applicant In response to a question from Commissioner Stutz, M Lutz stated that there should be a water development plan for the entire area, but efforts by a committee some two years ago had accomplished little in that direction. Opposed: No one, The hearing was closed and motion made by Commissioner Everhard, seconded by Commissioner Stutto to recommend approval of this rezoning subject to the 20 conditions as recommended by staff, and finding the proposal to be in conformity with the Butte'County General Plan. PAC rezone request at Last Tuesday's Board Meeting, T did some, ad-Utional research relating to the water supply question. According to the staff specialist who wrote the report, the original environmental; evaluation statements relating to water were based on information ftarnished by the project developer, and did not reflect engineered test data. We have accordingly revised the checklist and discussion relating to items 3(f), 3(g)., 14(a) and 17(b) According to experts that I contacted, there is a poasibility of welds for this project influencing wells on adjoining parcels , There is also a possibility of no effect. Monitoring of neighboring wells -rithin 1,000 feet of the project, wells while the project wells are being pumped would be necessary to resolve the question with certainty. The long term effect of additional wells in the area on the overall area water table cannot be predicted with certainty. A. comphrehens ve shady of groundwater hydrology in the area would be very expensive ($4,000 to $100,000, according to Howard Toussaint) and would still only be a "bast guessk'Iof e perts. Whether or not this project is approved, additional wells will likely be dug in the area to service additional parcels which may in the future be crePted by parcel, map. State law currently allows property owne•s to tap the groundwater rem sources on their property, and if this lowers the water table so an adjoining well goes dry, the owner of the responsible pump is (under some circumstances) not legally accountable. The owner of the dry well may only have the option of digging a deeper well. As for a decision, on this project $ the options available to the Board are the following. - 1. oll:owing,1 Delay a decision on adoption of the recommended conditional negative declaration until the project wells can be test pumped with wells within 1,000 feet monitored for drawdown during the test. 2. Adopt the conditional negative as presently revised. This would require a finding by the board that the possibility of influencing neighboring wells does ;not constitute a signi- ficant effect on the environment. 3i Adopt the conditional negative with ;an additional contin- gency requiring the applicant to perform :the pump test at a later date. A negative declaration is recoomended. The question continued from last week has to do with the water supply. Discussion oa a conditional negative declaration had at this time° A conditional negative declaration has to be a condition of the project. Discussion of the subdivision that is within a feta hundred yards; of the property proposed to be rezoned .had at this time. Howard Toussaint Sanitarian, stated that; there is a need for additional storage for water. They are concerned about the water, shortage. Clay Castleberry, Public Works Director; stated that in '1973` the problem of water for this area was addressed. There are two solutions, a deep well of from 600 to 1500 feet or a pipe from the Jonesville Dain which is a long way froin being done. Hearing open to the public. Appearing: Rack Daniels, Mr. Daniels stated that there had been a long discussion on the water situation. The water will be from underground sources rather than surface water. There are two wells on the property that produce 15 gallons per minute and 25 gallons per minute. T1 fere are also three other toles that have been drilled on the property. Mr Daniels stated that in order to meet the water standards the wells will be drilled deEper of there would be another well .drilled on the property. Financially the project could not proceed without water. The Vogpeerit could not be sold or built on without water.. BOARp OF SUPERVISORS MINUTES — September 6, 1977 Mr. Toussaint stated that 'there has never been that much of a goo -logical study made in the Mammoth and Paradise Pines area,. Mro Toussaint stated that he knows nothing about the wells on the proporty in question. Rearing closed to the public and confined to the BoarO. Jim Lawson, Planning Director, stated that the Board would be approving the plan when the rezone was approved. The question involved is whether this is a proper use for, the land. On motion of supervisor Winston, seconded by Superv4sor Lemke and unanimously carried, that although the proposed project could have a significant effect: on the environment, based on the testimony, there, will not be a significant effect in this case because the following mitigation' measures have been added to the project and a negative declarationis recommended: 1. River Rock or other erosion preventing material shall be placed in drainage ditches as needed, , 2. Natural vegetation should be retained wherd'possible. 3. Building design standards and placement should reflect the geologic constraints of the area. 4. If a!IY cultural resources are discovered during construction that: may j have been buried or obscured from view previously, an archaeologist should be contacted immediately, 5.
