Consequently, I have reviewed the Parcels deleted by the Commission on December 12, '1077, and have prepared comments and recommendations as follows. All parcels deleted are designated as Timber -Mountainous Terrain on the Land Use Plan map. 58-03-02 Bolles, Katherine G., etal 160 acres 58-11-04 & 05 Johnson Walter, etal 80 acres These parcels north of Concovi Reservoir were included on List B Because diamond International Corporation owns timber t-inhts. Noting this fact in a memo, Dick Barnes of the Assessor's Office has questioned the deletion of 'these parcels What has been overlooked is that all three parcels were rezoned to TM -40 in September 1075 at the request of Diamond International Corporation. I believe that the existinq TM -40 zoning is a good alternate to TP -160 for these parcels and that no further action by the Commission is necessary. 71-23-07 Anderson, Ellis R. 80 acres This parcel south of Feather Falls was previo.usl.y rezoned to TM -160, a suitable alternate zone, and thus needs no further attention by the Commission. 56-23-08 & 09 Col eman , Mabel , etal (Richard Brown) 104 acres These two parcels are about two Miles north of De Sabla and presently zoned A-2. Elevationis about 3,000 feet and slopes are level near Humbug Road to more than 3!J% 'roward butte Creek. All surrounding narcols are owned by Diamond and zoned TP -•160,_ I recommend rezoning this parcel to TM 40 Q 61-02-02 Moss, Gertrude & Hollis This quarter section is located one mile north of Brush Creek near French Creek Road. Average elevation is about: 1,400 feet and slope varies from 1095 to 40%. All surrounding parcels are owned by the U.S.A. and are hart of the Pl umas National Forest, I recommend rezoning this parcel to TM -20. Rigby concerning six parcels with respect to which Diamond International owns permanent timber rights but there is other fee ownership of the underlying land. Per your setter, the parcels are timberland, have been assessed as timberland, and timber and timberland taxes have been paid on them, but the parcels were omitted from the Butte County Assessor's list "A". Although you believe and have requested that the parcels should now be included on the Assessors list t1B , the ,assessor has not included the parcels on list 1111" because in his opinion the highest and best use of the parcels is recreational homesites. You thus ask our opinion, as to how the parcels should be zoned. From the information provided, we believe that the parcels should, for the most part, be zoned as timberland preserve. As you are aware, however, it is the "Board" or "Council", as defined in Revenue and Taxation Code Section 51100# which is empowered to zona properties as timberland preserve. While it appears; that the parcels should have been included in list 11,x" (Rev. & Tax. Code 5 51110), they were not, and the statutes do not provide for the inclusion of omitted parcels in list "A". Barrett December 27, 1977 As hereinafter explained, the nature of Diamond international's rights appear to bre such that we would regard it as an owner of timberland subject to zoning and one who could, prior to January 1, 1518, petition directly to the board to have its parcels included 3n list "B As we have previously indicated in our November 9, 19770 Letter to Assessor Anderson, we do not believe that a subdivision should be considered for zoning as timberland preserve. on -t,he other hand, an occasional dwelling on timber- land should not prevent a parcel from being considered for timberland preserve. Thus, parcels l., 2 3 (40 acres), 5 (except for subdivided portion), and G should be considered for zoning as timberland preserve, while parcels 3 (6.411 acres-- nonforest), 4 and 5 (subdivided portion) should not be. Of import with respect to parcels 4 and 5 is that subdivisions exists and hence, that the land therein is not devoted to growing and harvesting timber. As also indicated in our November 9, letter, it 'is the board which is empowered to zone properties as timberland preserve. Section 51112 provides for public hearing by the board, and states that the board by ordinance shall zone as timberland preserve all parcels appearing on list "B", except those parcels which it finds by a majority vote of the full body to be in the public interest to exclude from such a zone. You also ask how parcels 1, 2, 3 (40 acres) 5 (excejlsth for subdivided portion), and G, assuming they are added to lisil "S", and -the othersixteenparcels on Assessor's list "B" shoulN be taxed. In this regard, you state that the landowners are be;ting taxed, Diancond International's timber rights are being .taxed, pn',d' Diamond international will be subject to the yield tax when timber is harvested. We Assume that Diamond international, similarly owns the timber rights pertaining to these sixteen parcels but that there is other fee o�, nership of the underlying land. Thus, in each instance, Diamond International's rights arcs as set forth in grant deeds or other documents of conveyance, and may, vary from case to case. Assuming also then that Diamond i'nternational's rights in the sixteen parcels are'such that it has title` to the timber and; the right to use the timberland, We would regard Diamond International's rights in.parcel.s 10 20 3 (40 acres), 5 (except for subdivided portion), and 6 and in the said sixteen parcels as interests in realty which should be Valued according to the schedule set forth in Section 434.5. Should this (subdivision) be considered for "TPZ" zoning? We do not believe that a subdivision should be consid- ered for "TPZ" zoning. As you know, pursuant to Government Code Sections 5111.0 and 51110.1,°an assessor is to have assembled a list of all parcels which, as of the lien date in 1976, were assessed for growing and harvesting timber as the highest and best use of the land (List A) and a separate list of all parcels which, as of said lien date, appeared in his judgment to constitute timberland, but which were not assessed for growing and harvest- ing timber as the highest and best use (List B;). As indicated in the enclosed copy of the November 9, 1977, letter to Mr. L. D. Babe Taylor, Sis%iyou County Assessor, the value schedules set forth in Revenue and Taxation Code Section 434.5.are applicable and should be used for timber rights as well as for fee ownerships. It is the board or council., which is empowered tozone properties as TPZ, and the board or council may do so without the consent of all parties involved. Section 51.1.1.2, which provides for public hearing by the board or councilf states that the board or council by ordinance shall zone as timberland preserve all parcels appearing on list A which are designated as "contested" and all parcels appearing on list D, except those parcels which it finds by a majority vote of the full body to be in the public interest to exclude from such e zone. County of Teliama, 258 Cal„ App. 2d 668, the assessor assessed the mineral value of lots in which plaintiff had retained the mineral rights at $60 per lot. At the local equalization hearing,, plaintiff had contended that the mineral rights had no 'value, and the assessor indicated that lie was unaware of any market value for the minerals and that the $3.35 tax actually represented his book work costs, In reversing the trial court's judgment for defendant county, the court held that the mineral rights were properly subjected to assess- ment but that the method of assessment used by the assessor was improper; the assessor is compelled to assess all property Pursuant to the constitutional mandate that all property be taxed in proportion to its value and his method was not related to the full cash value of plaintiff -Is mineral rights. We believe that the timber rights should be valued, according to the schedule set forth in Rev, & Tax. Code section •,434.5. As indicated therein, the Legislature has found and declared that the values in the schedules are consistent: with the taxation of timberland used primarily for growing timber. And it is Beckett ranches, which is, in fact, growing timber, which has all the right As to the use of the timberland for such purposes, and which owns the interest which the schedules are intended to value. Since timberland which is properly classified and zoned is considered to havethegrowing of timber as its highest and best use,, it would seem improper p pex tro regard the nebulous interest retained ,by the grantor of the timber rights as having any value. Where, however, such a grantor is actually making a compatible use or uses of the property, the value of that use or uses should be assessed to him. On the other hand, where a grantor has retained the right to make,,a compatible use or uses of the property but has not exercised such night; that right should not be separately valued. Rev. & Tax. Code section 435 specifically provides that only "...existitiq, compatible, nonexclusive uses;..."
