"Compatible user' is defined in section 51100 (h) as any use which does not significantly detract from the use of the property for, or inhibit, growing and harvesting timber. This list consisted of parcels of land which were prosently being assessed, for ,growing and harvesting of timber as the highest and best use of the land" The parcels on List A �gere considered by your Board and 'after deleting certain parcels were adopted by your Board for inclusion in tho. Board of Suparviao;rs February 21, 197 i'ago Two The assessor then, as required by §511.10,.1 of the Govern- ment Code, prepared a list of parcels which were in the judgment 'r of the assessor to constitute timberland but which we}_%� not assessed for growing and harvesting timber as the highest and best use of the Land, This list of parcels was known as List B Neither List A tion List B included the parcels which Diamond International is requesting to be included in the Timber Preserve zone, On December 28, 1.977, Diamond International submitted a letter to your Board requesting the inclusion of certain parcels on List B. Their letter indicated the request was made in reference to the legislative findings and declarations o± 51 and §2 of Statutes, 1976,; Chapter 1.76 and prusuant to 951110.3 of Chapter 853, which chapter was added 'by urgency legislatioA in 1.977Section 51110.3 provides that if a landowner did not receive notice from the assessor that tha landowner's, property was played on List B for inclusion in the Timber Preserve zone, such landowner could, prior to January 1, 1978, petition directly to the Board to have the parcel or parcels owned by much person included on List B,' Your Board, on January 10, 1978, approved the request by Diamond International to include the parcels on List B for consideration to be placed in the Timber Preserve zone Subsequently to that, it was determined that the parcels submitted by Diamond International caex.e those upon which it has the timber rights According to the list prepared by the ass'essor's office, there appears to be at least fifty owners of the land upon which Diamond international has the timber rights, These owners did not petition your Board to - have their parcels placed on List B for consideration of inclusio,a in the Timber Preservc zone. The initial question in front of your Board is whether or not the parcels of land in question, upon which Diamond international has the timber rights, can even be considered by your Board for inclusion on List B. The reason for this is because of §51110.3 which specifies that a landowner is the person who is to petition the Board for inclusion of parcels upon List B. The sections in the Government Code dealing with the Timber Preserve zone do not define what is -.Peant by land-cri6mer. Sectloft 659 of the Civil. Code defines land to be the material of the earth, whatever may be the ingredients of which it is composed, whether soil, rock or other substance, Two elements of real property, as defined by §658 of the Civil Code, are land and that �,rhlich is affixed, to land, Obviously, standing and growing timber would be affixed to land, and hence, timber rights would be an interest in real property. Although sometimes, real property and land are considered to be synonymous, the Court in Krouser vs. San Bernardino County. 29 Cal. 2d 766, indicated that in construing a particular statute-, the word land should be interpreted -in accordance with its, strict legislative intent, unles it is clear that the Legislature intended the broader, all inclusive mean'Lng. Thus, the question to, be resolved is, whether the word landowner in §511.10.3' includes those who hold an interest in, real property, such as Diamond lnbexnat:ional's Board of Supervisors February 21, 1.978 Pa6e Four, timber rights, or whether the word landowner refers to those who own the land, which in this case 'would be the people who have title to the land upon which Diamond International holds timber rights. In revi-ewing H51100, et of the Government Code dealing with Timber Perserve zone, the conclusion :gas reached that the Legislature aid not intend to consider the word real property to be synonymous with land such as to bring into play all the various elements of real property. In, §51100, under subdivision (f), timberland is defined to mean privately owned land or land acquired for State Forest Purposes which is devoted to growing and harvesting timber and compatible -uses. Subdivision (g) Of §51100 defines Timber- land Preserve zone to be an area which is devoted to and used for growing and harvesting timber and compatible uses. Subdivision (h) Of §51100 defines a Compatible, use to be a use which does not detract from the u I se of the property for growing and harvesting timber, Furthermore, §51110.3 indicates that the owner of the land must be able to demonstrate that on each parcel a plan for forest management has been prepared which provides for the 'harvest of timber on the land. In other words, the Le gislature in establishing,the Timber Preserve zone and the laws that apply, was concerned with land and the uses of the land. It is our opinion, thereforej that §5].110.3 which allowed a petition to your Board f Or inclusion of parcels on List B by a. landowner, referred to those persons who are owners of the land. A few weeks later, I received another notice stating that my property was being considered :for TM-20 re-zoning. These notices were received from the Planning Department in the County of Butte, Approximately December the 7th, i made a special trip to oroville and talked to Mr. Dave Flironimus at the County Planning,Department. I asked him what the status Of my property was, and he stated that the property was being considered for TM-20 zoning, and shoved me the map with the different zoning areas that were being proposed, I next attended a meeting on January 9th of the Butte County Plan- ning Commission. At that meeting, they voted that the property be zoned TM-20, 4 to 1 in favor. My understanding, was that it was to go before the Board or Supervisors for a vote sometime in February and I would be so notified by mail. of the date of the meeting. On Saturday, Fob7.�uary 1:1, a neighbor contacted m6 and stated that he had seen in the paper of that date that my property had been re-zoned to 'TPZ-160 This was done approx- imately two weeks prior to the date on the paper. I have not been notified by any Department of the County of Butte that a meeting was going to take place regarding the re-zoniri.g of my property, as I planned on attending the meeting when this matter came up. I strongly ouject to my property being re-zoned without my knom ledge of it and not having a chance to attend the meeting and give my views. No doubt there must have been a clerical error in t}�_e de`signation of this property, since the Planning Commission hard already approved it for TM-20. . Barrett El December 270 1977 An herainafter explained, the nature of Diamond International's rights appear to be such that we would regard it as an owner of timberland subject to ,zoning and one who could, prior to January 1, 1978, petition directly to the board to have its parcels included in 'list "B". As we have previously indicated in our Novwnber 90 19770 letter to Assessor Anderson, we do not believe that, a subdivision should be considered for zoning as timberland , preserve,. On the other hand, an occasional, dwelling on timber- land should not prevent a parcel, from being considered for timberland preserve. Thus# parcels 1, 2, 3 (40 acres) , 5 (except for subdivided portion)' , and 6 should be considered for zoning as timberland preserve', while parcels 3 (6.411 acres--- nonforeat), 41 and 5 (subdivided portion) should not be:. You also ask how parcels 11 20 3 (40 acres), 5 (except for subdivided portion), and G, assuming they are added to 11st OBIR, and the other sixteen parcels on Assessor's list "B" should be taxed. In this regard, you state that the landowners ate being taxed, Diamond International's timber rights are being taxed, and Diamond International will be su); 4-_ct to the yield tax when timber is harvested. We assume that Diamond International similarly owns the timber rights pertaining to these sixteen parcels but that there is other fee ownership of the underlying land. Thus, in each instance, Diamond International's rights are as set forth in grant deeds or other documents of conveyance, and may vary from case to case. What restrictions would this zoning include and specifically would private development be prohibited?
