During discussion on tIarch 26, :1980 on Mr. Burch'.; rezone project„
lie stated that his property was determined by Co=iission action
to be Low Density Residential. The minutes for that elate read
"Rural Residential". The tape recordings for that date are of
VOOr quality and the motioll itself can not be hearr.1.. All of the
discussion, however, involves Low Density Residential for Mr.
Burch's property with the dividing Line between Low Density
Residential and Rural. Residential to be the east -west centerline
of Section 6. It is recommended that the minutes be amended to
clarify the issue.
Motion was made by Commissioner Bbnnett, seconded by Commissioner Wheeler,
that minutes of July 25, 1979 be corrected to read as follows Beginning
With the 3rd word in line 8 "to terminate the Rural. Residential classifica-
tion in Section 6 at the east -Wrest centerline; thus placing Mr. Burch's
property in the low density category."

The change has been fYoing on for two years,.
Bettye Blair, planning direetor, stated that the exhibits 1r)
the resolution include the two private projects, John ,kicinke and I'ob rd
Vermillion and William Drew, The Board has findings that were prepnred
by the Environmental. Review Department. She asked that these findings
be corrected as they refer to the rezone for West- highway 32 and this
is only a General. Plan amendment,
Ms. Blair stated that a point of inc--nation is that the Craig
Mooretown Ridge General Plan amendment is part of the project and not part
of a separate action,
Supervisor Wheeler stated that she diad have some areas of
concern, She would send here concerns back to the Planning Commi.salon
and staff for a list of priorities.
Vice Chairman Winston advised that the Board had received a
letter. from Fred Sebastian relating to "TM zones.' Mr. Sebastian is to
be advised that the General Plan is an on-going, matter of study and any
inequities that appear can be taken care of in an orderly process,
Ms. Blair stated that the boxed off areas will keep the
existing designations on the General Plan, These are study areas and
the Planning Commission has established priorities for study in these
areas. These are for study purposes only;.
Vice Chairman Winston advised that; any communications received
regarding the General flan are to be automatically referred to the Planning
;Department by the Admini.strative Office,
Supervisor Dolan felb that when rezones come up in the study
areas, the Planning Commission aid the Board should pay attention., to the
tent and policy statements within the General Plan.
On motion of Supervisor Moseley, seconded by Supervisor W11eeler
and carried, finding that comments and recommendations from the public
have been attachedto the draft environmental impact report, Which includes
the environmental, impact reports prepared for the North Esplanade and West
Highway 32 as well as the environmental impact report integrated within the
text of the Land Use Element, that written responses Lo significant e,nv
mental. Dints v g iron -
P , raised by the comments, have been prepared and attached to
Ithe draft environmental. impact report, the final env;ronmental impact report
as certified as having been completed in compliance with the Califo�:nia
/nvironmental Quality Act, the State Environmental Review Guidelines and
he }3t:tte County Environmental Review Guidelines.
On motion of Supervisor Moseley, seconded by Supervisor Wheeler
and carried, the Butte County Planning Commis `

There was no formal motion, but sta�Pr nvas instructed to carry these r,ec-

Commissioner Bennett: commented ( 95) that both North Esplanade and Highway
32 land been heard and reheard from both sides and made a motion to send
the Land. Use Element back to the Board, with changes as recommended in the
memorandum mentioned earlier, and including North .Esplanade and Highway
32 projects. Commi9sioner Lambert secondod the motion (:dor purpose of
discussion).
Both Commissioners Lambert and Max expressed the opinion that both North
Esplanade an(] Highway 32 project should go back for public hearings prior
to thoir submittal to the Board. Commissioner Lambert expressed concern
that there is still no d:efijiitio:n of "a viable parcel" in the Element.

Butte County Farm Bureau relative to the closed hearing previously held
by the Board. The Board also received a letter=rcen;Bob revio s

Chairman Lemke read fir. Broyden's letter at this time. He

5. Nick Garcia. Mr- Garcia agreed with Mr. Blake and Mr.
Corvallo. Ile felt there had bodn a major change in the map the last two
weeks. Ile has been told it was just a policy change and fits the
criteria of the text. 110 felt -that this was a drastic change. lie felt
this map would oncourage growth -to the rich Production lands of the
county and discourage growth in the nonproductive areas Of the county.
Under the original Proposal I'lir, P"OPOVtY WAS Placed under orchard and
field OrOP. Ile opposed this placement. Ile had tho agreement of every
Commissioner that this was bad grazing land. Everyone on the Planning
Commission.agreed that the best uoo for his prolifty was rural -residential.
Up until -the last meeting, he thought -that- his p=roperty was at lGmt
in rural residential. Now with the ohaneos his property is in three
categories. He was told that the reason :for the changes was that they
followea -the natural boundaries. The three different categories do not
follow any natural boundaries. Ile hoped that this would be sent back
for more input from the public. He wanted to know what his lands best
use and wliat catogory it will be placed in. Thio plan if; completely
unworkable. A
SuPervicor Winston stated that there have been 14 hearings
On this matter. As far as he was concerned the Board war going to make
a decision on the Plan. Ile did not think it should be 0ant back to the
Planning Commission.
Supervisor Wheeler stated that all the testimony has been
given to the Board. Before she makes a decision she will go through
thq 1 -!an and apply 11 , it to the individual needs.
Mr. Garcia stated that the majority of his lana falls in the
40 acre minimum category. 110 wondered if this requirement would be retained.
6. Cecil Johnson. Mr:. Johnson stated that it was his intention
to place 60% of about 5tO00 acres of land into an estate for the benefit
Of the community and charity. lie stated that he was amazed at the chagess
that were to be presented to the Planning Commission. It seems as though
the protection of the green belt is being done away with. Ile felt that
everything should be done to protect the viable farmland in the county.
All of the people he has contacted regarding the new Nap do not like it.
One thine that should be considered is -that the size of parcels will be
dictated in accordance with the slope and other Properties such ass
Percolation that would permit dovelopment4 Ile felt that the minumum
requirement for marginal land should be taken out of the Plan. Mr*
Johnson spoke regarding grazing land,. Grazing land roprenents about 56%
of the total land under consideration. The income doveioped from this
land is $qoo,000 which represent -
a1 roy-imately 6/10 of 174 of the total
agricultural income. There is 6�l

of grazingo If the county denies the use Of land in this area the land
that is not'viable for grazing there will be problems. This is a clear
case of inverse condemnation* With this land restricted to any kind of
division , it is less than worthless. lie Selt that home8iteo should be
developed on this property.

Mr. CrQninger stated that if the Map is adopted there will be
the criteria of rural residential versus open grazing* He wondered if
person would have to come in for an amendment 311 their property did
not fit the 40 acre minimum.
Supervisor Winston stated that before the map is adopted,
they will be looking vqry carefully at it.
Mr. Ringel as%ad what the procedure was for having his
property changed? lie will talk with Planning Counsel and EnVironmenta],
Health.
Chairman Lemke recommended that the hearing be continued to
give the Board time to look into all requests that have been made to

people stand up and preserve agricultural land. He did not feel that
grazing land soils should be preserved. To adolt the map would be to
preserve grazing and destroy vina loam soils.
8. Louise Ahart. Ms. Ahart felt that grazing was important.
She felt that planning was important. She is fighting development among
the grazing area. She felt that development should be placed near i e
cities and not out in the farming community.
Mr. Galicia agreed with Ms. Ahext that there was a need for
grazing. Ile did not feel, however, that the area should be zoned to
-a 40 acre minimum parcel. Ile felt that as growth continued people should
be encouraged to move toward that area. He felt that the Williamson
Act was fair because it gave people the choice regarding their property.
Mr. Johnson endorsed Mr. Garcia's comments. If the Board

He noted that a telegram had been received from Bruceteil, Giler, Osser,
Fresco and Shames, owners of "Section 23 on Lake Oroville", objecting to
the change from Rural Residential to Open and Grazing.
He also read a letter from Butte County Farm Bureau, Gerald M. Geiger,
President, requesting that the Commission recommend a minimum of Rural
Residential to the Board.
He added that,based upon discussion with Counsel and subsequent research,
it appears that of the parcels now in process there is a vested right
with tentative approval, but *Oithout tentative approval. the COurtty
would have no recourse except to deny a project that comes up for hear-
ing after the Land Use Mapoand Element are adopted,

to give people a chance to look at the new map.

Opponents: Bill Geddis stated (475) that he alone had 3 subdivisior.

the other. He asked that all applications currently on file be given
special consideration.
Cecil Johnson, 18207 Santa Cecil,a, Fountain Valley, Ca. said (15-1-15)
that of- 5 000 acres that he owns and another 1700 in which he has
in interest only about 150 acres now remain in Rural Residential since
the map was changed. He asked that all his property north of Cohasset
be placed, back in the Rural Residential category.
Don Blake,, realtor of 1891 Robinson Street, Oroville questioned (105)
that the southeastern part of the county should be placed into a
designation that has a 40 -acre minimum because the soil has no agri-
cultural value --that it would. be much more realistic to allow development
such as that which would be allowed under Rural Residential.

Russ Cronin er, with Riegel F Associates, echoed the comments of Bill
GJe c s anT-commented that there are many spots within the Opon Grazing
designation that should be considered Rural Residential. He a1:so asked
that the words "lot splitting" be stricken from Page 21, Line 21, of
the Land Use Element text, and added that there remained too many
discretionary items to be handled by the Department heads.
Joe Vandervoot, 2854 Olive Highway, attorney representing Charles Gow;
Richter Bros., Dave Mathews and other property owners in the Oregon-.
Gulch -Oregon City area., asked that this matter be continued two weeks in
order to permit him to become better informed as to what is happening to
his cli.entst properties. It is his understanding that several. Properties
have been bisected by th.e land use designation lines on the new map.
Dave Mackey, 655 Nelson Avenue, Oroville, expressed concern about, his
property on Stringtown Road on which there is a. pending application
for a subdivision.
Nichplas Garcia, 3300 Grubbs Road, Oroville, (15-1-436) stated that his
1712 acres are now designated in three different categories on this new ma
and again set forth his reasons why all his holdings should carry the
Rural Residential designation.
Forest Scntt, 5313 Clyde Court, Sacramento, said that he had talked to

was good, but now the people have been misled by the criteria,
`Thb-hearing was closed. Commissioner Bennett said that there is no way
this`'will ever be resolved ---lacking the wisdom of Solomon; which we
do not have --to give everybodyLwhat they want. In order to get this thing
off of dead center everybody in this room has to recognize that the .Board
of Supervisors has the final decision and they are going to have hearings --
public hearings, on, this. Those of you that have disagreements can still
go to the staff with your problems and describe the. You will have a
chance to appear before the Board once they consider this whole thing.
And I think, that in view of all the agonies we have gone thru for two
years, I'd like to propose, by resolutuon, that this map be forwarded
to the Board of Supervisors. His motion was seconded by Commissioner
Lambert.

explained that the interim zone covering the South Chico Area would likely be
extended so that it would not lapse October 10.
Mr. Van Duzen, Route 1, Box 184-, owner of 380 acres which has been in his
family since 1894, asked that the plan permit him to have parcels from 1 to
40 acres for the whole acreage, It was explained to Mr. Van Duzer that
sucha designation would not appear to conform -to 'the criteria contained in the
new Land Use Text for Rural Residential. (1 to 40 acres)
The Commission tentatively accepted the proposal presented by staff earlier

man for the Butte County Farm Bureau with more than 2500 family members.
In response to his question as to the meaning of "development" as used on
Page 42 of the Land Use *te,\,t, under "Flood Control", chairman. Wheeler said
that to h1fli it meant "hazard to 'iuman live --residential development." The
other Commissioners generally agreed.
Mr. Gilman stated that the Bureau feels that there is too much Rural Resi-
denti,al--thattheir Land Use Committee as well as the Agricultural Advisory
Committee, recommended that Rural Residential be changed to Open Grazing and
that Rural Residential be confined around already developed areas. He
added, "You cannot apply the criteria in tile document you just blessed and
come lip with all this rural residential."
Jim Snowden (370) Wild 1,ife Biologist for Fish and Game Department, again
pointed out the adverse effects of rural residential designation will have
on wild life which will result in adverse effect.-, on -tile economy of the area.

the farmers have enough trouble now without having to work around all those
rural rosidential pursuits. lie introduced:
Hugh Santos, lst Vice ProsIdent of the Bureau, who called attention to a letter
from the Planning Department, dated dune 6, 1979, about which there was some
misunderstanding of what tonight's, meeting would cover. In response, Mrs.
Blair read minutes of the June 19 Board of Supervisors' meeting as follows:
"On motion of Supervisor Wlnston, seconded by Suporvisor-Moseley
and cgfr,ied,,a motion of intent to approve the text of the, Land Use
Element as amended on reprift February 1.979 was approved and the amended
Land Use Element was referred back to the P.anning Corrmissioll, for
consideration of the amendments and requestod the Planning Commission
hold aOditional public hearing on the Land Use Map for the beiiefil of -
those that have had no input into the Land Use Map changes and that
this is to be additional hearing or hearings as necessary."

most of the people in the county and should be adopted as is --that there is
tremendous pressure to develop in some areas.
