III, DISCUSSION OV RN'VIR0MOINTAL EVALUATION
This proposal is an amendment of the Butte County Comprehensive
Zoning Ordinance; to modify the space requirements for livestock. in
the AR-, , AR-MH-3, $R-1 and 8Ry3 zones
proposal suggests The staff ro osal s gists that the large residential ekelusionst
of these zon,es.be eliminated, changing the requirement to one dead
of livestook per 8.,125 sq. feet of property, Presently', it three of
the affected, districts, an area equal to the minimum lot size must
be preserved for residential use Without livestock,,, and additional
area is required for livestock. At the Planning Commission meeting
of May 16, 1979 CommissionerRae Wheeler proposed that the criteria
used in the TM �Tim'ber Xountain) zoning series be used: go more
than two animals, be kept per acre on parcels of less than 5 acres
and no more than four animals per acre on parcels of 5 acres, or more«
This alternative to mcdifying the space requirements fon livestock
in: the four zones being considered: warrants serious consideration
since it would relax the restrictions while not allowing excessive
density of farm animals in more populated areas;, thereby minimizing
potential problems with odors, flies, etc.
2b Objectionable odors could be created it neighborhoods where
the pro,poSed change to the four zones would be nplicable. These
potential odors would be from animal fecal material,. In move dense
neighborhoods, in order to Mitigate potential odor, property owners'
with livestock would
need to regularly maintain the livestock areas
to remove or turn tinder the animal droppings. The Environmental
Health Department could be contacted if a livestock owner was negligent
in this regard for investigation of a possible health hazard or
nuisance condition. -Public nuisances can be abated with public funds.
Private nuisances can be abated by a private .individual who can file'
a lawsuit:

by a stream, creek or intermittent drainage. Animal droppings result
in fecal coliform bacteria which) if not controlled, can wash into
