' ._:. •_ • 83-157 A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, ADOPTING A SPECIFIC PLAN PURSUANT TO GOVERNMENT CODE § 65350` WHEREAS pursuant to the provisions of Government Code §653:50, et: seq., public hearings were held before the Butte County Board of Supervisors on a proposed Specific Plan for Bidwell I Heights and; ft WHEREAS,, the procedures of the Califo:Lnia rnvironmerta Quality Act and ;=-he Butte County Resolution implementing the act, - have been met, and the hereinafter, listed matter was discussed with testimony and documentation presented by the public, and various county, local, and, state agencies; and, WHEREAS;, the Draft Environmental Impact Report provided an adequate analysis for the Specific Plan for Bidcwell Heights. Water Quality Concerns With Residential Development in Foothills East of Chico, Butte County REPORT: Mr, John L.uvaas, Jr„ representing the "Friends or ';he Foot- hills", requested that the Board hold a special hog in the Chico or Paradise area. The purpose of such a hearing would be to review the cumulative effects on Water quality from proposed subdivisions in the Butte County foothills, Mr. Luvaas states That water qualify is threatened by sewage contamination, runoff, siltation, overdraft of ground water, and blockage of natural stream channels. The Board can deal with sewage contamination, as well as erosion and siltation, through wastedischarge requirements. However,- ground water overdraft, runoff,, and blockage of natural stream channels are not within the Board's normal Functions= The staff report discusses those areas in which the Board has j uri sdi cti on. RECOMMENDATION A special hearing is not necessary to protect water, quality. STAFF REPORT Board-Butte County Relations Board staff and Butte 'County staff have enjoyed good working relations. Unfortunately, subdivisions are proposed and brought to the County's permit process one at time. This makes it difficult to analyze cumulative impacts of proposed projects as requested by Mr. Luvaas. All major subdivisions which do not discharge to a municipal sewer system, apply for, and receive WDRs or waivers from the Board. These WDRs or conditions on the waivers prevent or mitigate adverse impacts. The following is a discussion of the major foothill subdivisions mentioned by Mr. Luvaas: Canyon Park Estates (109 lots on'1050 acres in Little Chico Creek Canyon) WORs Were adopted in February 1983. Soils in the area are not good for standard septic tank/leachfield systems. The proposed system Will discharge 22,000 >gpd of domestic sewage from septic tanks to stabilization ponds and spray irrigation. WDRs provide for impermeable evaporation ponds in order to 'protect ground eater andprevent surface water contamination. During the spray irrigation season, the WDRs provide safeguards to control runoff of contaminated water. Erosion hazard is high. Last winter, with severe rains, large amounts of erosion were ,caused, mainly at the roadways. Complaints were received. Staff contacted the project consulting engineers, Rolls, Ellis and Rolls, and were told that soils Would be stabilized after the rainy season. Although construction has not started, staff Will inspect the project site to ensure that proper erosion control measures are taken before 1 October 1983, Bidwell Heights (337 lots on 1000 acres 10 miles east of Chico on Doe Mi 11 'Ridge) The subdivision has not filed an application for WDRs. We understand that 'Butte County cannot issue ,a Plan Development until prior approvals are obtained from the Countyy Health Department and our Board. The method of seWage disposal has not been determined; The proposed subdivision contains very limited areas of suitable soils.
