Supervisor p lowing letters in opposit:ion to the operationofthe Detail sales clemcalol'lant,on Dayton Road: P Bon Tobey Ruby Real. S til.ley Mrs. Helen Parks Mary Merrick Iva Morgan Vera Summers till Cottingham Supervisor Dolan made a report on the situation at this time. The retail sales was legally established. The legal determination comes from thn Planning Comniission's discussion that the sale of fertilizer was appropriate in the "A-10"' tone. There have been concerns from adjoining property owners about Jack's- orchard Supply which seem to center around three things 1) commercial use creating incompatibility with residences and agricultural area; 2) safety concerns about the high speed arterial: road and the fact commercial use of: theproperty will attract large, tracks, personal health concerns because of the loading of fertilize rhead r an, d Chemicals from ove ground and drain off, onto the adjoining properties, and theare, on the otettial of what happens, if the chemicals and fertilizers possibility of some kind of accident and spill.; 3) the' understanding by everyone of what the extent of the use will be. The Planning Commission mi,nutes•indicated agricultural chemical fertilizer insecticide sales. Then thele was an April, 1982 letter defining and narrowing the definition, She suggested that in the future that any potential incompatible use and the question of whether it would be allowable under the toning ordinance should come to the Board rather than the Planning Commission. She suggested that she sit down with the Planning staff to work out some agreement on the use of the property and the safety concerns and any expansion of the use. She was not suggesting that the county, tell `Mi Vanella to move his business but to come to an understanding and containment so there can be co -existence. Mrs. Lord stated there were five other chemical fertilizer plants that are hdt, diiywfiete near residences. She wanted to know why this orie came 100 -feet fx6m their residence: She asked why they were being pushed out. There were two hours when there was the fit Ling of the bulk storage that there were fumes and blowing, residue. She had nose bleeds for three days after that. Last Thursday they again filled the bulk.storage. They have to stay away from their prod-itty. She set out the other conditions she had suffered' after the filling of the bulk, storage„ She felt the o¢ieration should be closed down: 80 BOARD OF 80P,1018098 05Rri - ,lune. 'g CiTL 5 ...-a Larry Lord advised that when he checked into this matter, he. as told that the plant was allowed to move into the: area because of the interpretation of'a gray area in the zoning book. He read from the zoning book, page 49, section 24-75,'part A, subs'ecti.on 3 about agricultural. rocessing plants. He felt that they should have considered page 9, section read from 24-21.34mni es Of ay 4G 1982oand rferredopthe article in the: Chic agriculturalprocessing lints. He r the minutes of May , Enterprise Record on May 29, 1982 about ,this problem, and the overturn of a a tanker and how it might effect Lake Shasta: The truck was loaded with thick propane that wasr used for fertilizer. He wondered if the Board could afford to have this type of use iii this zone surrounded by people. The Environmental Health Director's report was given on 'May 11, 1982, and l he made reference to the comments in the report about the fumes and odor, Supervisor Dolan stated she Would Eike this matter also referred, to.County Counsel, Thecancerns should be answered and a person should not be afraid to use their property or have their health effected by going out their door. , sued this permit legally, At the name time the :ounty has is Del Siemsexc, county counsel, understood the problem as beingthe A countyt that the, this could be placed on this property and issuedca building pernit.haAtSfelt that at this point, the county wolxld be unable to reledt the pe t on the basis that the Planning Commission gave the authorization. They could change the zoning codes to make sure this type of use will not be, permitted. This would give the. count control Over any expansion. Another thing, that could take place is to have the Air pollution Control Officer run a check on the odors and see if there can be; .._ ng in the building permit some immed7.ate . K fief . Unless there was something relative to the distance away from the property line or structures, thete is no control over the Location of the building, There is always the option of Mr, and Mrs. lord pursuing the private nuisance theory. Since the county has taken the position this is a permited use, they cannot go into court on a public nuisance complaint, If the country tried to do this, he felt they would have a lawsuit brought against the 'county. Mrs. Lord stated that ora inally the permit wad for a barn, There have been things moved and hidden behind the two--s{.ory Old house on the property. is t to their house and well, When these people know , T1iis• nex anyone is coming, they move these things The matter wras teferred to County Couh8el, staff and Supervisor Dolan to get this- matter resoloved. 1982 minutes of and meeting discussion was held that f there wa d o the May 4 the so g s to be a Boar ld not be an allowred Mr. La+rel stated that according t p p g zex", this wou inter relation far da.a ensi11 of fertile. use, Bettye Kircher, planning director, stated that when this was originally di§cussed, she told the Board she felt in deferring to Counsel in effect that if the Board cbiose to make the decision there might be. litni.ts .sere is a tided for further interpretation on that,, the if tb g .
