MINUTES November 18, 1982
A Butte Count Board of Super�rsors - Rezone from "A -R" (83-21
(Agricultural Residential.) to "AR A1H"° (Agricultural
Residential - Mobile Home) property located in and around
the tol,'nsite of Nord
Attention was directed to "Excerpts from tape of meeting of 9/28.82meeting
of the Board of Supervisors"; the text of which follows:
Mrs_. Kircher reminded the Board of --the State Law effective
the first of the year that mobile home parks must be allowed
in all residential zones and suggested that such an ordinance
be prepared ma

She added that in light of this lair the Board might wish to
instruct staff to also set hearings to allow mobiles (nob
necessarily on foundations) in all zones. The Board instructed
staff to initiate such hearings, �
During the ensuing discussion it was requested by Supervisor �
Saracxni that separate hearings- be conducted for the Wyandotte
Palermo area for mobile home zone because of the many applications
that are being received to place mobiles in the area. Supervisor
Dolan asked that the area now zoned A -R in and around the townsite
of Nord be also rezoned AR -M, noting that the Board's policy
of interim zoning for each .mobile home request was not olily time-
consuming but costly, and this would permit mobiles in areas,that
do not now al1i:)w mobiles.
Staff was instructed to initiate hearings by the Planning
Commission.

It was noted that minutes of the Board of Supervisors as to the reasons for
this zoning application were still not available.
The hearing was opened.
Tom Heyl presented photographs depicting the di,fferenct housing structures
in the Nord area.
Goldie Springer, a resident of the Nord area since 1945, stated that people
need a place to live and. she Feels that those trailexs on blocks will be
improved and she has no - obj ections to having them in her neighborhood:
In response to a question from one of the Commissioners, Mr. Hey:l. said
many others in the area feel the same way as he does abort more mobiles
in. the area. It was suggested by Commissioner Schrader that he get a
petition to that effect.
Chairman Lambert suggested that the area,be rezoned A-5 even though there
would be,many non-conforming parcels.
Hearing no comment to the contrary, she continued this hearing OPEN until
November 18, awaiting minutes of the Board, further study of the A-5
alternative, and the petition from Mr. I-Ieyl.

Commissioner Lambert expressed concerns that the proposed zoning is not
in conformity with the General plan. Commissioners agreed. Hearing no
comments to the contrary, Chairman Lambert continued this hearing OPEN
until November 4, for a recommendation by staff as to.whet'her or not
the General Plan should also be amended,, and for the receipt of minutes
of the Board of Supervisors regarding their action (if available).

Board of Supervisors' Meeting
September 28, 1982
Mrs. Kircher reminded the Board of -the State Law effective
the first of the year that mobile home parks must be allowed
in all residential zones and suggested that such an ordinance
be prepared making approval subject to obtaining a use per
She added that in light of this law the Board might wish to
instruct staff to also set hearings to allow mobiles (not
necessarily on foundations) in all zones. The Board instructed

Saracini that separatehearings p rings be conducted for the Wyandotte -
Palermo area for mobile home zone because of the many applications
that are being received to place mobiles in the area. Supervisor
Dolan asked that the area now zoned A -R in and around the townsite
of Nord be also rezoned AR -MH noting that the Board's policy
of interim zoning for each mobile homy: request was not only time -
Consuming but costly, and this would permit mobiles in areas,that
do not now allow mobiles.
Staff was instructed to initiate hearings by the Planning
Commission.

NORD TOWNSITE - LOW DENSITY RESIDENTIAL
'The Nord Townsite and parcels directly adjacent to it are zoned A-R.
This zoning dates to April and September of 1975. The Planning Staff,
Board of Supervisors and Planning Commission have historically recog-_
nized the low density development and character of: the townsite, despite
the Orchard and Field Crop designation. Scale limitations, combined
with an implicit understanding that the development potential was
confined to a relatively small area, precluded the need to separately
map the townsite, Recognition of and application of Low Density Resi-
dential policies stem from the following policies of the Land Use

Theexsting Oroville Area Land Use .Plan pre -dates the consistency
requirement which went into effect in 1974. Difficulties with consistent
administration of the County's General Plan forced a revision of the Land
Use Element in 1977-75 culminating in the adoption of the present
Land Use Element in 1979. Because of the magnitude of the und
the revision process was divided into tt,ro phases; the first consisted
Of the revision of the text and countywide map and the second consists
of the revision of the urban area land use, maps. All of the major
urban areas have been completed except Oroville. Revision of the ville Oro
Are Land Use Plan has awaited the revisions of the City of OrovillOro
General Plan, a. draft of which is currently under review. Until this
Process is completed, the policies of the revised text assume a greater
role than the map which has been recognized as ineffecti e as a land uuse
policy.
The Upper Palermo - Lower Wyandotte Study Area is shown as Lour Density
Residential in the ex
was isting Oroville Area Land Use Plan. This designation
used by the Planning Commission and Board of Supervisors in zoning

closer inspection, the map designation of Low Density Residential was
not suppotted by the criteria arnd policies of the Land Use Element text.
