Motion was made by Comnissioner Schrader, seconded by Commissioner Bennett,
to recommend amending, as follows.
Sec. 24-21.28 'Mobile Home. A housing structure transportable in: one or
more sections, designed and equipped to be used with, or without, a founda-
tion system. Mobile home does not include recreational vehicle, commercial
coach, factory built housing as defined in. Section 19971 of the Health
and Safety Code or a mobile home certified under the National Mobile Home
Construction and Safety Standards Act of 1974 '(42 V. S. Section 5401 et sect.)
placed on a foundation system)pursuant to Section 18551 of the Health and
Safety Code.

Mary Jones, 19 Mulberry Drive, Oroville, felt that mobiles not on footings
should be allowed in tall zones,
Del Ellis, 1741 Tehama Ave., Oroville, said that mobile home parks in all
zones would degrade the area.
Elmer Jones commented that the going price of $2,000 to :Hove a mobile
would discourage those on wheels from moving.

MOBILE HOMES IL ZONES
TO Planning Commission
Staff Findings, 10/21/$2
The use of mobile homes in various zones has itself been,problematit
for the County. The interim procedures have been frequently employe(i
to accomplish this purpose. This somewhat questionable practice
consumes time and financial resources. The distinction between
zones which permit mobile homes and those which exclude them are
based largely upon aesthetic and class considerations. Because this
varies fl-om community to community, neighborhood to neighborhood,

spot zoning. Planning is concerned with fundamental issues of
use, f1ensi'y, environmental quality, resource protection and the
efficient delivery of services. State legislation, improved design
Of mobiles and an:.absence of clear standards leads the Planning
Department to recommend that any differences in zoning as it relates
to the type of residential structure involved be eliminated.
Several considerations arise as a result of this endeavor. For ex-
ample, should all mobiles and recreation vehicles be considered a.
"residential structure" or "single family dwelling" for the purpose of
zoning dofi.nition, or should only 'those mobiles, which ,could other-
wise be iyllowec! in the zone if placed on a permanent foundation system,

allowed to be placed on a foundation system, pursuant to Section 1.3551

do not meet the aforementioned requirements.
Additionally, staff recommends the Commission consider amending all
those zones that require a minimum of 500 sq. ft. for a mobile, %.e.

Sec. 24-21.10 Dwelling., single family: Is a building with one
or more habitable rooms which are designed to be occupied by one
family with facilities fox living, sleeping, cooking, eating and
sanitation. For the purpose of this ordinance factory -built
housing as defined in Section 19971 of the Health and Safety Code
and a mobile home certified under the National Mobile Home Con-
struction and Safety Standards. Act of 1974 (42 U.S.C. Section 5401
et. seq.), placed on a foundation system,- pursuant to Section 18551

Staff Findings October 21., 1982
The thrust of State legislation in recent years has been to expand
the opportunities for mobile home use. To this end the legislature
in 1980 enacted lavas which required 'local governments to treat
mobile homes constructed -to 1974 federal standards and placed on
a foundation to be treated the same as a conventional dwelling
for the purposes of zoning; TtAe County modified its definition
of a mobile home for this purpose.
In 1981 the legislature added Section 65852.7 to the Government Code.
This 'Section requires that local governments allow mobile home
parks to be established in all zones which are also designated for'
residential use in the General Plan, The law also goes on to indi-
cAte that local governments may require a use permit, The law,
basically, says that mobile home pars must be added to the list of,
conditional uses in residential zones shish implement residential
Land use designations.
There was still a question of how this was to be related to the
General Plan land use designations where residential use is either
a secondary type of activity or appeared to be impractical. I;hamples
included the Orchard and Field Crop, Timber Mountain, and Agri-
cultural Residential designations. A mobile home park with one
acre or larger parcels is unrealistic and may actually conflict with
other politics,. The Office of Planning and Research indicated that
it was their view that this linkage required mobile home parks
only in those zones which implemented residential land use designa-
tions (i.e., Low Density Residential, Urban Residential, etc.) where
the use and density were appropriate; '
The Board of Supervisors on 10/5/82adopted an interim ordinance imple-
menting Government Code Section 658527 with the requirement of a
use permit, and also initiated this hearing.

Recommendations:
A. Note that this project is Categorically Exempt from
Environmeptal Review; and
$i Vinci that the legislature enacted legislation mandating mobile
home parks in all residential zones which implement
the residential policies of the General Plan; and
C. Recommend the Board of Supervisors adopt the ordinance
identified as Exhibit :-' (attached)) providing for the
consideration of mobile home parks in all residential
zones; and that the Board of Supervisors adopt the
ordinance identi-fied as Exhibit B defining mobile
home ;mobile home park and recreational vehicle park
and revisions of all zones- implementing the action.

Staff Findings- October 21, 1982
The thrust of State legislation in recent years has been to expand
the opportunities for mobile home use. To this end the legisl-�ture
in 1980 enacted laws which required local governments to treat
mobile homes constructed -to 1974 federal standards and placed on
a foundation to be treated the same as -a conventional dwelling
for the purposes of zoning. The County modified its definition
of a mobile home for this purpose.
In 1981,the legislature added Section 55852.7 to the Government Code.
This Section requires that local governments allow mobile home
parks to be established in all zones which are also designated for'.
residential use in the General Plan, The lair also goes on to indi-
cafe that local governments may require a use permit. The la -W
basically, says that mobile home parks must be added to the list of
conditionaluses in residential zones shish imtlement residential

There was still a question of how this was to be related to the
General Plan land use designations where residential use is either
a secondary type of activity or appeared to be impractical, Examples
included the Orchard and Field Crop, Timber Mountain, and Agri
cultural Residential designations , A mobile home part: with one
acre or larger parcels is unrealistic and may actually conflict with
other policies. The Office of Planning and Research indicated. that
it was their view that this linkage required, mobile horse parks
only in those zones which implemented residential land use designa-
tions, (i.e., . Low Density Residential, Urban Residential, etc.) where
the,use and density were appropriate.
The Board of Supervisors on 10/5/82adopted an interim ordinance imple-
mentiixg Government Code Section '558527 with the requirement of a
use permit, and also initiated this hearing.
The interim ordinance limited the consideration of Nibbile home
