Honorable Board Members:
V'! appeared before the Planning Commission on December 2,
1982, with a request for a rezone to A-5 for the above -referenced
property to establish an agricultural buffer zone adjacent to tine
Hosler Tract. (Thea Hosler Trait is a rural residential
development in an agricultural area

commissioners expressed willingness to consider out request, they
noted that under the present wording of the General Plan (Land
Use Element, pages 73 and 74), they, did not have the flexibility
to approve the application, regardless of itsmerit.
It was pointed out at the hearing that revisions of these
Policies "were
been recommended by County Counsel, and such
revisions were being Looked into" by Y Plannittg staff and_ Board
We concur with County Counsel that changes should be made in
the General Plan to eliminate a possible legal problem with
"zoning by resolution" and to provide a limited measure o'
flexibility in the careful application of buffer zones to those
instances where commercial agricultural operations interface with
small lot residential developments.
With the help of our consultant, Mr. Earl Nelson of Chico,
we have written suggested changes to the General Plan which will
bAtisfy both the County's needs and those of other property
owners in our predicament. These changes would preserve the
intent of the "Chico Greenitie" in preserving tgricitltural land
while making the agricultural land preservation Policies
legally defensible. more

In short, we a.r.e, asking for the following Board actions:
(1) Initiate a revision to the General Plan Land Use
Element as indicated on the attached sheet, and
refer the matter to the 'Planning Commission for
hearings. (This will not commit the County_ to
any particular wording, but will get the process
underway; refinements to the la_nguange can be
made in the course of the hearings)
(2) Refer our rezone application back to the Planning
Commission for reconsideration along with the
General Plan revisions. (This referral is
necessary because of the 90 -day requirement for
Board action on a rezone. It is doubtful the
General Plan revision can be accomplished within
the time period, and this referral will keep the
rezone from expir.ing.)

The basis for our appeal is as fol.low5: The Planning
Commission could not find consistency with the General Plan.
Greenline policies outlined on pages 73 and 74 of the Land Use
Emement as these policies are presently worded. But two
Commissioners acknowledged that the policies contain language
thae is overly rigid and of questionable legality. It was
pointed out at the meeting that revisions of these policies as
recommended by the County Counsel Delbert Si.emsen ,are "being
looked into'l by planning staff and Board members
We believe policies G a) 1, 2, and 4 on pages 73 and 74 of
the Land Use Element should be revised per the recommendation of .
County Counsel, and further believe that such revision will
materially affect our pending rezone.

construction of homes. One dwelling per five acres leaves a largo
area of land open dor infiltration. There are two shallow ditches
,along either side of Hosler Avenue. The general area is drained by
Mud/Sycamore C7eek to the south: Drainage facilities may need to

roadside ditches may be inadequate to accommodate increased runoff
during periods of extended rainfall

Criteria 2: The project site is located approximately 1 mile
west of the Chico Urban Boundary (Greenline) .
Criteria 3 A cohesive 25 acre a:gri'cultural plot will be lost:
potentially 5 residences could be introduced into the area.
Since homesite locations cannot be restricted as part of a rezone
to A-5, there is the potential for further intrusion of residential
uses into intensive agricultural areas. In the event the rezone
were approved, it would be possible to require the location of
homesites near Hosler Avenue and delineation of an. agricultural
buffer zone as part of the subsequent land division.
Additionally; amendments to the Land Use Element text, adopted with
the revised Chico Area Map, clearly indicate that the agricultural
areas that are currently zoned A-20should not be rezoned to allow
smaller parcels. The applicable sections state:
"G, a) In order to carry out the purposes of this policy,
properties located: on the Agricultural side of the
Chico Area Greenline shall subsequently be zoned of
rezoned in accordance with this policy ;as follows
1) All areas which are zoned A-5, A-:10, A-20, A-40 or A-160
on the effective date of this policy shall remain so zoned.
4) After the effective date of this policy, except as
specified in this subsection (a), no property on th:e
Agricultural side of the Chico Area Greenline shall
be rezoned to an A-2, A-5, or A-10 zoning district
classification-"
