ORDINANCE No. 600 AN URGENCY GENCY BASISNCE OF THE CITY OF PROVISIONSREGULATING THE , STATE Or ESTABLISHMENTNIA, ADOPTING ON A�� UR '� OPERATION OF ADULT ENTERTAINMENT FACILITIES WHER, AS, on November 20, 1980, the Seaside City Council adopted Ordinance No. 571, as an amendment to Ordinance No. 289, otherwise known as the City of Seaside Zoning Ordinance, in order to specifically regulate the establishment and operation of adult entertainment facilities, and WHEREAS, on September 17, 1981,`the Seaside City Council adopted Ordinance No. 591, otherwise known as the "Official Zoning Ordinance for the City o_" Seaside", and WHEREAS-, the adoption language contained in Ordinance No. 591 repealed Ordinance No. 289 and all of its amendments,, which inadvertently included the Adult Entertainment Ordnahce, and WHEREAS, the Seaside City Council desires to restore all of the provisions of the former Adult Entertainment Ordinance in order to continue to regulatra the establishment and operation of adult entertainment 'facilities:: NOW, THEREFORE, the City Council of the City of Seaside does ordain as fol l owe SECTION I.- FINDING'S The City Council makes the following findings regarding the establishment of adult bus nes ses;= 1_, Certain uses of real property, variously described as adult book stores, adult motion picture facilities, figure modelstudios, adult cabarets, adult motels and massage parlors have serious objectionable characteristics which, iil such uses were allowed to become concentrated in certain areas of she City of Seaside, may have adverse effects upon the character of such areas and adjacent neighborhoods; Ordinance No. 6000 0 Page -2- 2. Permitting the concentration of adult businesses may tend to create` and foster a "skid -row" atmosphere in neighborhoods and areas within the City; 3. Permitting the concentration of such adult businesses In residential zones, or in zones adjacent to schools, churches, or public recreational areas,. or within close proximity of such uses, may expose minors to such facilities and this may adversely affect such minors due to their immaturity; 4. Special regulation of adult businesses uses is necessary to insure that such uses will not contribute to the blighting or downgrading of zones i'n which they are permitted, adversely affecting property values and deterring or interfering with the development and operation of other businesses within the city; 5: T"ere is a higher incidence of crime, especially crimes ajains. the person, in areas in which adult businesses are permitted to cluster or become concentrated, and that such crimes and the incidence thereof increase in the late evening and night hours, requiring increased effort on the part of .public safety personhel to police such act Ivities, with resultant costs to the City. §E TION 2 O�FTNITIONS For the purposes of this Ordinance, the follvging definition's shall apply, unless the context oth'e`rwise requirest 1. PUBLIC DISPLAY OF CERTAIN MATTER PROHIBITED 1. Materials offered for sale from newsracks shall not be displayed in a manner which exposes to public view photographs or illustrations of "specified sexual activities" or of poses which empLasize or direct the viewer's attention to "specified anatomical areas," The provisions of this subsection shall not apply to any newsrack placed in a location covered by Penal Code Section 313.1. 2. No person shall place, maintain, display or exhibit or permit -the public to view it any ter =er any material which exposes to public view photographs or illus- at ons of "specifi`ed sexual activities'" or of poses whichemphasize or direct t. viewer's attention to "specified anatomical areas_," As used herein, "exposes to public view" means exposes to the view of persons inside or outside the building in which said material is placed, maintained or displayed. SECTION 5, CONDITIONAL USE PERMIT Any adult 'business, the location of which is otherwise permitted under this Ordinance, shall be a use subject to first obtaining a Conditional Use Permit, as defined in Article XXIII of the Zoning Ordinance, subject to the following Criteria 1, That the proposed use will not be contrary to the public health, peace; safety; morals; comfort and general welfare of persons residing or working in the zone or district in which the use is proposedy Ordinance No. 600 Page -7- 2. That the proposed use will not result in creating a "skid -row" atmosphere in zones or districts in which it is proposed; and 3. That the proposed use will not be contrary to any program of or neighborhood conservation, nor interfere with any Economic Development Program of urban renewal in the zones or districts in which it is proposed. SECTION 6. NONCONFORMING USES Any adult business in existence on the effective date of this Ordinance shall constitute a presently -existing nonconforming use 'hereunder. Such uses shall be subject to regulations contained in Article XXIV of the Zoning Ordinance. SECTION 7. AMORTIZATION I. Within thirty-six (36) months of the effective date of this Ordinance, all nonconforming adult businesses shalljeither be discontinued or made to conform to the provisions of this Ordinance, except that such nol=hforming uses may be permitted to continue for a period not to exceed an additional 24four tWent - J' ( )month period upon the granting of a conditional use permit, upon application nihety (90) days prior to the expiration of the present thirty-six (36) month use; Pursuant to Article XXIII of the Zoning Ordinance.- 2. In addition to the criteria contained in Article XXIII of the Zoning Ordinance and Section 5 of this Ordinahce the Planning Commission must 'find, in determining whether a conditional use permit should issue, the followitig: a. That the user if continued, will not create a public nuisance, as defined in Section 3479 and 8480 of the California Civil Code,, b That the tenant, sub -tenant, lessee, sub -lessee, owner or other person, firm, partnership, 8ssociationy or corporationwho owns. or operates such use is obligated under a lease or other binding Ordinance No. 600 Page -8- rental agreement for the premises, which 'obligation was entered into before June 30, 1979, for a period exceeding five (a) years; and c. That the use represents an investment of money in leasehold and other improvements to such an extent that denial of such permit would result in undue financial hardship. SECTION 8 If any section, subsection, clause or phrase of this Ordinance is, for any reason, held to be invalid by a court of competent jurisdiction, either in its application to any person or to any circumstance, such decision shall not affect the remaining po rions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, sub- section, clause and phrase hereof, irrespective of any adverse decision relating to any section, subsection, clause hereof; and to this end, this Ordinance is severable. SECTION s Any ordinance or parts of any Ordinance that are in conflict with this. Ordinance are hereby repealed. SECTION 10 This Ordinance shall take effect and be in full force and effect imme- diately after adoption by the City Council of the City of Seaside for a period of time not to exceed one hundred and twenty (120) days.
