This rezone follows action by the Board of Supervisors (3/.3/82) changing
the General Plan designation from High Density Residential to Commercial.
The applicant originally proposed C-2 (General Comm ercla1.) zoning.
After consultation and assurances that existing uses could remain though
under a light commercial zone, the -ezone application wa,s amended to
C-1 (Light Commercial)
The mcm0ra:ndum of January 6, 1933 outlines the reasons, why an alter -tion
of the zoning request occurred. Attached is a ;J,rtteal from Thomas E.
Edgar confirming the change.

based on the attached memorandum and initial sturly.

construction of a large nut processing facility and
nett storage warehouse. The property was used as a
nut processing facility by The American Walnut
Company, Inc. until about 1978; shortly thereafter
it was used as an air-conditioning fabrication and
warehouse facility. Both of these previous usages
were industrial in nature.. Use Permit Number 80-51
was issued to the Applicants on April 3 1980 for
use as an "antique shop, cabinet woodworking shop
and public storage facility." on August '3, 7.982
the Butte County Board of Supervisors changed the
land use designation for the property to

A related project to this project is a rezone application,
currently in abeyance, from S -R to M-1 (Light Iiidustrial) on
this parcel and an adjoining parcel. A portion of that initial
study stated the following:
Light Industrial (M-1) zoning in an area surrounded by
homes and small orchards would possibly lead to some
conflicts of land uses. If the General Plan is amended
for only this 2.4 acres, it would result in an island of
industrial surrounded by residential land use designations.
The existing facilities represent a nonconforming use
which was established prior to the S -R zoning.

Item 10: This application for a use permit is for a
use permit to change a nonconforming use to a use of the
same or a more restricted nature pursuant to Butte County
Code Section 24•-37(B). This parcel of real property was
formerly owned by American Walnut Co., Inc. which operateld a
nut processing facility on the premises ,for many years prior
to the time the property was zoned S -R in approximately
1968. American Walnut Co., Inc. continued •wo operate a nut
processing facility on the premises Until sometime in 1978.
Since that time the property has been vacant except for
storage of certain personal property formerly owned by
American Walnut Co., Inc., now owned by Foothill Capital
Corporation. The present owner of the property, Foothill
Capital Corporation, obtained -title to the property after
default by American Walnut Co., Inc. in the repayment of a
loan made by Foothill Capital Corporation to American Walnut
Co., Inc. Applicant. James Fowler has, entered into an agreement
to purchase the parcel in question with the intention of
leasing the property to applicant McClelland Air Conditioning
upon the condition that the property can be used for McClelland',s
purposes,.
The continued use of the land and building by American
Walnut Co. r Inc. as a nut processing -facility const'ittzted a
pre-existing nonconforming use pursuant to Section 24-31 of
the Butte County Code after the property was zoned S -R since
although the 8--R zoite permits "agricultural uses" the nut
processing use could only be considered an "accessory use"
under the definition of agriculture contained in Section 24-
24.1. Section 24--21;1 provides that such accessory uses
must be secondary to use in the normal: agricultural activities
carried out on the premises. Since the nu.t processing
operation was the primary use of the premises, the continued
use for that purpose after the rezoning to S -R was a nonconforming
use.
No notice of abandonment of nonconforming use has been
sent to the owner so far as applicant is aware.
It is submitted that the use by McClelland Air Conditioning
will be of a more restri,cted�nature than the prior nonconforming
use as a nut processing facility since the prior use presumably
involved delivery of nuts in bulk by large trucks, 'hulling,
sorting, cleaning, padkaging and sales of nuts with the
attendant traff=ic, dust and, . noiseThe proposed u,se.by

is then loaded on trucks to be installed and armembled in

and the office related to these activities. It is submitted
that the proposed use is more restrictive than the prior use
