There are advantages provided by the cluster devol.opment Which include loss utility line extensions, 'fewer lineal feet of roads,' easier provision of public servicers, and the provision of over 700 acres of open space designated for wildlife habitat. 2. The project,,; as proposed, appears to be the least environ- mentally damaging alternative capable of achieving project objectives, 3: The project will result in the construction of a paved road linking "Humboldt Road with the Little Chico Creek Canyon area.. This road could be opened up for public use during an emer- -gency, providing an alternate escape route For canyon resi- dents to the north and east, 4. Nitrate contamination of groundwater is a result of, among other things,', sewage effluent reaching via septic 'tank, disposal systems and groundwater_ storm drainage drywells. Canyon .Park Estates will not have either of facilities, and so it will not contribute these to this pollution in this, manner. The. Canyon ?ark Estates ,sewage system is a "closed" system to the EIR) and will have (See First Supplement monitoring wells surrounding the plant. ITIUAedi-= ate detection of nitrate contamination before it reaches the groundwater will result, with appro- Water Quality Control' priate sanctions from the Board. 3. The Board of 'superv'isors has received the Plan it to ning Area Committee report and referred the Planning Commission for review and recommen- dation. Any regulations adopted pursuant to im- 'report's plementation of that recommendations could be applied to this proj'ect's subsequent approvals. 4. The lawsuit brought by the "Friends" briefed numerous alleged inadequacies.The judge ruled against the petitioners in all cases, stating that the environmental impacts of this project were well documented and sufficiently mitigated (See Appendix Ii) Further pertinent discussion regarding the court's view of the Friends 4f the Foothills' alleged inadequacies is contained in Appendix XI - Decision. APRIL 4 1984, LETTER.. 1. The Department of Fish and Gamehas`r stat d e�hat a11. Nothing in this section should be construed to preclude nominal, normal maintenance activities associated with the natural open space, including but not limited to the thinning of trees, removal of debris, dead animals, etc.;and E. Off road motorized vehicle use of the common area is to be prohibited except- as required in Item b above. 5. By the restrictive covenant, as well as zoning, the development area use shall be restricted as follows; A. The residential building sites as shown on the Specific Plan shall be limited to residential uses and activities. The numbered lots are to be limited to one single family dwelling per parcel; and B. The storage of materials and objects around the residential dwellings as shown on the Specific. Plan shall be limited to those which are accessory to, appurtenant to, and customarily associated with the residential use of those dwellings; and C. All other, accessory structures and/or buildings for which a building permit is required shall be limited to those which are accessory to, appurtenant to and customarily associated with the residential and/or recreational use of the property; and D. The, height of all principal structures as shown on the, development plan shall not exceeda height of two ' (2) ' stories or , thirty-five (35) feet; and Home occupations as defined in Chapter 24-2, of the Butte County Code shall be prohibited; and F.
