Planning Con m, County of Butte AUG 2 183 No. 7 County Center Drive Orovillei Calif. oraviilo, Cali ornlq Subject: Abandonment of Portion of Lindo Avenue, Chico Gentlemen: As I understand, the motion.passed by your Board on August 23, 1983, with regards to the abandonment requested by Parks and Stewart was a motion of intent to approve the requested abandonment provided the applicants grant a deed for ingress and egress to the County of Butte for that portion of Lindo Avenue that lies between East 9th Avenue and; the Market parcel. Abandonment,,,, are merely an official release of any rights or interest that the public agency may have acquired as a result of the original subdivision. By granting an abandonment the f County is making no statement or claim as to the status of fee title. Becauseof possible real property fee title interests that the heirs of the original subdivider may still have, the actual title may be very clouded._ Since before an abandonment, and even after one is accomplished the applicants do no possess title to the street. Consequently, they are not in a position to gvant a deed to the County. One can't grant or sell something he doesn't own: The County would be receiving a worthless piece of paper. I sincerely request that the entire abandonment be denied, since the following potential public uses exist: 1 Creekside corridor, Nicking, equestrian, jogging and relief from urban monotony. J 2 Access to Lindo Channel for erosion protection projects, flood clearing and gravel removal 3. Longitudinal recreational bike paths. 4. Traffic and accident problems on Mangrove Ave, which will be aggravated by the business expansion that this abandonment would allow due to increased space for required parking. 5. Decrease in area available for public parking. 6. Possible presently unforeseen public utility needs The above reasons should bb more than sufficient to prevent your Board from being able to make the findings legally necessary to grant this abandonment, Board of Supervisor -2- August 23, 1983 County of 8,utte To legally grant an abandonment your Board must fid that there is no present or future public need for the easement. Requiring thht a portion of the requested abandonment remain a public easement it a contrad ition of .the required findings and could not be legally del -ended. Since your '3oLtrd at least recognizes the traffic problem involved in this issue, I would like to suggest O'n alternate procedure. It i5 mandatory that,the portion of Lindo Avenue .that connects the'Markel parcel with East 9th be kept in public trust.: The Board's very motion affirms V16't foct. Why don't you just abandon only that portion of Lindo Avenue east of the Market parcel and delete the portion between East 9th and the Market parcel.
