Staff entered the memo dated November 27 with the December 4 attachment and the memo
dated. December 6, 1990 it to the record. Staff had one change on the wording for Condition #28
on. the Dec- 'ber 6th rremo for further clarification to change "provide a legal (government
entity)" to '_ .'m a CSA adequate to insure the operation, maintenance, or repair of the sewage
collection treatment and disposal facilities and for the domestic water system."
Chairman .Forbes said'there were two hAters received in opposition to this project from Mr. Barry
Myers and Mr. Fred Brooks.
Commissioner Lynch notedthat both of these letters were written after the hearing was closed o
November 15, 1990. n
Chairman Forbes said at the last meeting the Commission passed a Motion of Intent for approval
of this project. He said the hearing was Continued to adopt a final nlot.ioti,
Commissioner Lynch asked how does the Commission put it timeline on the monitoring of the
mitigation measures?
Staff said the monitoring program is tied to the map,

Staff said this was covered in Condition #46.
Commissioner Lynch said Condition 446 was not the same as the original. Condition 4-23 and he
requested that the Mosquito Abatement District be put back into Condition #23,
Staff said that Mosquito Abatement will have to approve the design of the ponds,

Tom Reid said that this is always a risk with any development. There was a discussion on the
system and how it is designed.
Commissioner Lambert asked staff if there were plans for an Area Plan?
Staff said there is the anticipation of an Area Plan for North Chico. Staff said that this has been
discussed with several property owners.

1. An initial study has been completed in compliance with CEQA.
2. Said Study and comments received thereon identified potentially significant
environmental effects that the project may have had but:
A. Revisions in the project plans or proposals made by or agreed to by the
applicant would avoid such efforts or mitigate such effects to a point where
clearly no significant effects would occur, and
b. There is no evidence before the County that the project as revised may have
a significant effect on the environment:
1 The proposed zoning is consistent with the Butte County General Plan because of
the overall topography of the area in question; and
B, Recommend the Board of Supervisors adopt a Negative Declaration with mitigation

design resolution and other accepted engineering standards;

10. Street lighting shall be provided in accordance with Butte County requirements,
accepted design criteria, and recommendations of PG&E.

with California State Regional Water Quality Control Board, Code of Butte County,
California Health and Safety Code; acid other applicable codes and regulatiaXas
governing the design construction and operation of the facilities.
23. Develop and obtain approval of a Reclaimed Wastewater Usage Plan from Butte
County Environmental Health, Mosquito Abatement District,,and State agencies for
the usage of reclaimed wastewater.
24: Provide a Community Water Supply System in compliance with the California State
Safe Drinking Water Act and County of Butte requirements.
25. The applicant shall comply with all other applicable State and local statutes;
ordinances, and regulations;

standards, or walking paths that provide access to all residences within the golf
course, in order to provide for internal pedestrian traffic safety.

neighboring properties and local streets by using a combination of large- shrubs (to
create a hedge) and trees, 'The screening details shall be reviewed and approved
by the Planning Department prior to recordation of the Filial Map.

a. Any portions of the sewer treatment facility located above the ground and
capable of creating noise (such as pumps) shall be provided with enclosures
or other noise reduction measures so as to reduce 'lle noise levels if needed.
Prior to recordation of Final Map, the applicant stall provide information as
to the expected noise levels created from the treatment facility.
b. All landscaping improvements for conditions 28 and 31 shall require posting
of a 100% Performance Bond for materials and labor for a one (1) year
period after completion and approval of the installation. The Bond shall be
posted prior to issuance of building permits.
Form a CSA adequate to insure the operation, maintenance or repair of the sewage
collection, treatment and disposal facilities and for the domestic water system. As
a minimum creation the entity shall:
a Insure financing of operation, repair and maintenance.
b. Provide qualified individuals and operational procedures for facility operations,
repair and maintenance.
C. Provide adequate resource to comply with all monitoring and othe., �tegional
Water Quality Control Board Waste Discharge Requirements.
d. Provide adequate resources for facility inspections and resorts for a (County
Service Area or other maintenance entity.
e. provide adequate resources and/or mechanism to insure adequate funding of
a major sewage treatment and a disposal facility replacement or reconstruction
if necessary.
L Provide a liability risk assessment for review by the County of Butte.
Indemnify the County of Butte and County Service Area or other government
entity for all claims and liability that may occur relative to the sewage disposal
facilities,
29. Prior to final map recordation, a revised copy of the CCC&Rs shall be provided and
include the changes indicated in the March 16, 1990, letter from Tom Wrinkle:
Article IV Section 4 (Signs) of the CC&Rs shall be modified to incorporate the size
and time limits for signage as identified with the related ordinance for this project.

devoted to passive open space. Final landscaping plans shall be approved by the
Planning Department prior to Final Map recordation..
36. All residences shall require a two car garage and the driveway shall be utilized as
tandem parking to meet the PUD standards for off-street parking:

fee (unless modified) for drainage impacts prior to final map recordation. (M)

Mitigation Monitoring Agreement shall be estabEshed between the Army Corps of

A video tape was shown of the site. The Commission waived the reading of the Staff Findings.
Commissioner dstrowski asked how staff arrived at -the density as stated in the analysis?
Staff .said the density was figured on all the property, and not just the area for the dwellings.
John Mendonsa, Public Works, said that he was concr..rned with Condition 29 requiring a CSA be
formed for roads. He said that Public Works is not in a 'position to maintain a private road. or
roads. He said if a CSA isformed, it is administered by the Board of Supervisors and a County
liability. He said that Public Works does not want to be involved in a CSA for private roads.
Staff noted that the Board has formed a District for a private subdivision in the past..
Mr. Mendonsa said that particular District was formed for sewage disposal including a private road
that was to be made into a public road:
Commissioner Lynch asked if the alternative would be to bring the road up to County standards
and dedicate the road to the County?
Mr, Mendonsa said there were other alternatives besides forming a CSA,
Commissioner Matson said on Condition 42 regarding the protection of vernal pools, the CC&Rs
is not the place to provide protection. He said it was too easy to change the CC&Rs. He
suggested that this condition be tied to the Articles of Incorporation.
Staff said the condition can be put un the final map and the word, "CC&Rs" stricken.
The hearing was opened to the public.
Tom Wrinklvt� Sierra Vest Surveying, said that with thin type of subdivision he did not think it was
necessary to form a CSA for road maintehance,
Commissioner Matson said that, any conditions of a permanent natur^ should not be handled
through CC&Rs
Mr. Wrinkle said the applicont does not want a public road running through the subdivision;
Commissioner Matson said the condition would be better uv�der the Articles of Incorporation.

Mr. Wrinkle said there is a question on whether or not there is a vernal pool in the area. He said
the area where the vernal pool is supposed to be has been incorporated into the golf course so the
area will not be disturbed. He said they have been working on this project for two years. He said
the applicant agrees with all the conditions except #28. He said they are objecting to the
decorative block wall. He said he bould prefer decorative fencing or heavy landscaping instead
of a block wall. He said the wall would be out of place with the subdivision. He said the sewage
facilities are underground 4nd only the lid 1 ft. above the ground will be visible.
Staff said there is an existing residence adjacent to this property
and theblock wall is to protect
the neighbors from possible noise. Staff said they would not object to landscaping screening this
from public view instead of a block wall if the facility was located primarily underground and
minimal noise was expected.

regarding veinal 'pools.
Chairman Forbes suggested on Condition 12 that the wording be "pay assessraents" instead of "pay
off assessments". This was agreeable with the applicant,
Mr. Merz said the monitoring program of mitigation measures is a State haw. He explained the
reasons for the program.
Bill Cheff, Public Works Director, commented on Condition 29 saying he did not want to be in
charge of maintenance on private roads. He said Public Works is in charge of most CEAs in the
County. He said he was not in favor of a CS.A for road maintenance and he did not want a CSIk
to maintain water and sewer systems. He did not mind a CSA that provided funds for Heallh
Department inspection fees for the water and sewer treatment system, but did not want the Covaty
to have to maintain the systems.
Chairman Forbes; asked Mr. Cheff for suggestions on maintaining the roads other than forming a
CSA.
Mr. Cheff said most subdivisions nave a Home Owners Association with maintenance agreements
regarding the roads.
Commissioner Lambert asked why the Commission is concerned with the maintenance of private
roads. She understood the Commission's concern about maintaining :the sewer and water systems.
Mr. Cheff said the roads will be inspected by the County as they are installed.
Commissioner Lambert suggested the Comtrission add to the end of Condition 22 "and small be

Commissioner Lynch suggested the Commission add to Condition 28a to spell out the inspection

ANALYSIS:
This project 18 a requestto rezone 221 acres from SR -1 to PUD (Planned 'UdAt'Deveiopmeat),
located on the west side of Hicks Lane, approximately one (1) mile north of Sycamore Drive,
Approval of a PUD also constitutes approval of the Tentative Subdivision Map for the subject
property. The proposal includes 199 residential 'homes, 22 of which are designated as duplexes.
An 18 hole golf course, driving range, clubhouse, children's play area, pool and
shuffleboard/bocce and tennis courts are also proposed for the site. Project density is .90
dwelling units per acre with average lot sizes of 10,800 square feet. It is the intent of the
applicant to develop this project as a private, gated community that would allow each homeowner
to select two outside persons to be members of the Golf Course Association.
A community well will be used for the domestic Water supply and will be used to supplement the
golf couno ponds. The applicant is also proposing an on-site sewage disposal/treatment facility;

be given to relocate the play area to a centrally located area in the vicinity of Lots 113 to 155.
The applicant prepared an "Expanded Initial Study" with recommended mitigation measures ar
part of the original application.. However, when staff completed its review, there was a
recommendation to prepare an ER due to the cumulative traffic and drainage impacts i n the
North Chico Area. The applicant appealed the EIR requirement to the Board of Super, sors
who subsequently upheld the appeal. Staff then prepared mitigation measures based on the

Dear Mr. Painter;
After review of the Ochinero rezone, we are poncerned
with the following items:
1. The discharge of water into Mud Creek;.
2 The construction design of the water hazards at
the golf couse.
3. The design of the sewer treatment ponds (location
not shown on map).
Historically, Mud Creek is an .intermittent channel
drying up in the summer and therefore, not a mosquito
problem. This proposed development will add summer flows to
this channel. The existing potholes in Mud Creek will
provide a suitable habitat for mosquito breeding4

low -flow channel in the area of Mud Creek that is impacted
by their urban run-off water. Prior observations have ahown
that inadequate sine slope in the design of sewage treatment
and decorative ponds will result in vegetation growth along i
the edges of these ponds. This will provide a favorable
habitat for mosquitoes. At such time as plans for the
sewage system are devbloped, we would like to 'revlse such
plans in detail.
As condition of approval, we request that sufficient
slope be required in these ponds to alleviate the potential
for nosquito 'breeding. Yearly maintenance should be
required to )seep all ponds from becoming a public nuisance
(a breeding place for mosquitoes).

We have received your transmittal dated 27 December 1989 regarding the subject
development. Your comments in this transmittal indicated that the application
had been deemed incomplete. Therefore we had not taken any action regarding the
development.
On 20 March 1990 we received a Report of Waste Discharge and Filing Fee for
Fairway Estates from Slerra West Surveying, which is acting as the agent for Mr.
Ochinero. Two methods of wastewater disposal were proposed in the application:
1) Use of sand filters with subsequent disposal to a leachfield ;and 2) Use of
sand filters with subsequent effluent irrigation. If the first alternative is
to be instituted, we would consider the application incomplete due to inadequate
soil and groundwater information. If the second alternative is to be used, we.
believe the information is adequate to begin drafting waste discharge
requirements (WDRs). However, WDRs cannot be adopted 'until all CEQA provisions
are satisfied.
We do have some concerns regarding the development that must be addressed before-
requirements can be finalized. These concerns include the following:
1) Wastewater flow for the development was estimated at 45;000 gallons per
day. This appears to be a low estimate for this number of residences..
Justification for these numbers is given in Mr. Steve Werts' conceptual
plats, but these numbers are not accepted by the County Health Department,
and in our opinion are not appropriately conservative. If the develo)er
would consider deed restrictions to limit the sale of lots, or some other
mechanism that would limit sales until flow data could be established,
Board staff would consider writing the permit for the proposed 45jOOO
gallon per day flow.
2) The
cip tided initial study for the development indicates that a homeowners
a will be formed: A homeowner association is not adequate to
be named as a legal entity for Waste Discharge Requirements. A Community
Services District or County Service Area trust be formed to allow us to
complete Waste Discharge Requirements.
3) No details have been provided concerning the management of stormwater from
this development. Stormwater collection and discharge must be addressed
as part of final design:
