If during construction; further archaeological remains not identified within the .March 4, 1990 archaeological surveys are encountered, a professional. archaeologist shall be consulted and colistruction shall cease until a full examination is completed. (M) 32. The final golf course design shall include 'a 50 foot undisturbed rough around the edg ,s of the vernal pool to be used as a buffer area, (M) w 33. An avigation easement shall be provided to the Chico Municipal Airport prior to recordation of the Final Map. (M) 34. All members of the Golf Association shall be notified of the treated water p the golf course operation. This shall be included within the CC&Rs. All ponds shall be posted to identify that the water has been treated. (M) 35. A 20 foot minimum fully landscaped setback shall be provided to separate Hicks Lane from the parking lot. Landscaping shall include mounding or berming and shrub hedges in conjunction with the trees and wall. The parking lot area shall be revised to include 150 parking stalls with the remaining area to be landscaped and devoted to passive open space. Final landscaping plans shall be approved by the Planning Department prior to FinalMap recordation. 36. All residences shall require a two car garage and the driveway shall be utilized as tandem parking to meet the PUD standards for off-street parking: 37. Enter into an agreement with the County and pay a $1,500.00 per acre mitigation fee (unless modified) for drainage impacts prior to final map recordation. (M) 38. Apply for and obtain Waste Discharge Requirements from the California State Regional Water (duality Control Board, Central Valley - Region. b. Develop and obtain approval of a Reclaimed Wastewater Usage Plan. from Butte County and State agencies for usage of reclaimed water. C. Locate reclaimed wastewater ponds separate from areas of residential development. d. Provideseparationdistances between domestic water supply facilities and sewage treatment, transport and disposal facilities and areas in compliance with Butte County and State of California requirements. e Provide a satisfactory plan to control access to wastewater treatment, storage; and disposal areas by chilldren. Designate one area of the golf course for wastewater and irrigation. 46. There is no pump noise. They are submersible pumps and are located 5 feet below around. The pumps tum on 5 minutes, twice per hour. During the run time, there is a faint sound of water passing out of 1/8" orifices. A person needs to be about 5-10 feet from the. filter to hear this sound. The pipes are buried in a blanket of gravel, which is why the sound is muffled, The filters in Paradise are very close (3 feet) to dwellings.: There have been no complaints about odor or noise. ANALYSIS - This project is a request to rezone 221 acres from Sit -1 to PUD (Planned Unit Development), located on the west side of Hicks Lane; approximately one (1) mile north of Sycamore Drive. Approval of a PUD also constitutes approval of the Tentative Subdivision Map for the sU -ject property. The proposal includes 199 residential homes, 22 of which are designated as duplexes. An 18 hole golf course, driving range, clubhouse, children's play area. pool and shuffleboard/bocce and tennis courts are also proposed. for the site. Project density i* .90 dwelling units per acre with average lot sizes of 10,800 square feet. It is the intent of the applicant to develop this project as a private, gated community that would allow each homeowner to select two outside persons to be members of the Golf Course Association. A community well will be used for the, domestic water supply and will be Used to supplement the : alf course ponds. The applicant is also proposing an on-site sewage disposal/treatment facility. 1✓ach home will contain an individual septic tank on its parcel. Effluent from the septic tanks will then be transported to a common sewer collection line that will terminate at the on-site 2 treatment facility. The treated water will then be stored in the golf course ponds and eventually be used to irrigate the turf.. CCandRs and a CSA will be established for the maintenance of all improvements on-site. The purpose of the PUD is to allow flexibility and diversification in site development by permitting innovative and superior design and mixed uses that are not found in a standard subdivision design. The project design is basically a loop road system with homes being clustered in the center of the site. Good buffering is provided by the golf course between the smaller lots of this project and larger neighboring lots. Both the PUD and 5R-1 (existing %On't d) zoning designations are listed as "conditionally consistent zones" within the General Plan Land Use Element. This conditional criteria appears to be met by the site design and ,conditions added to this proposal. Even though the residential density (.90 dwelling units per acre) is less than the maximum permiti.ed under the existing zoning (1 dwelling unit per acre), there is some concern with the overal'i land use intensity for this site. The addition cif a golf Course with two (2) additional outsid : members per household will create more activity than what would normally be expected with a'standard residential PUD. However, the number of golfers using the facility at one time is limit �d by the number of holes. In the worst case scenario, 100-130 people could be expected to be either on the golf course, waiting to get one, using the driving range, or utilizing other amenities of the facility. In addition, if a golf course tournament was scheduled, additional increases in land use intensity could occur. Daily, it can be expected that at least half of the golf course activities will be used by the residents of the subdivision. With the high demand for golf course use, this ratio could vary daily. Despite the fact that the project site is not within an Urban Area that requires curb, gutter, and sidewalk, the project does have an urban setting, Heavy pedestrian traffic can be expected, and to ensure public safety it is recommended that sidewalks or walking paths be provided to connect. the residences: In addition, there is some concern with two areas of the project's exterior buffering. First, since a parking lot is hot normally expected in a residential neighborhood, particularly in a 1 acre area, it is recommended that a 20 foot iriinimum la mscape buffer be provided between the parking lot and Hicks Lane. 'By 'incorporating mounds/berms and landscaping as screening; the impact of a parking lot within a suburban/semi-rural atmosphere will be minimized: The 2,37 parking stalls are more than adequate to meet the intent of the PUD zone and proposed uses on-site. The applicant 'has indicated that no outside tournaments would occur. Some residents of the PUD can be expected to either walk or take their private: golf carts to the Clubhouse, thereby eliminating the need for so many parking stalls, Therefore, Staff recommends that the parking lot be reduced to include a maximum of 150 stalls, with the remaining area being utilized as passive open space. The other area of sensitivity that should incotporate screening is the sewer 3 a .r treatment/water system/RV storage area. Solid decorative. block walls should be utilized to provide for visual and acoustical buffering for the neighbors. A final area of potential conflict deals with the Children's play area being'located adjacent to the clubhouse and swimming pool. Even though this location does provide for a beneficial focused recreational area, there could be some supervision, safety and noise conflicts with the other uses. If the applicant wishes to keep the play area at its present location, adequate supervision and safety features will need to be provided, particularly appropriate fencing separating the pool area. Consideration may want to be given to relocate the p'ay area to a centrally located area, in the 'vicinity of bots 113 to 155, The applicant prepared an "Expanded Initial Study" with .recommended mitigation measures as part of the original application. However, when staff completed its review, there was a recommendation to prepare an EIR due to the cumulative traffic and drainage impacts on the North Chico Area. The applicant appealed the EIR requirement to the Board of Supervisors who subsequently upheld the appeal. Staff then prepared mitigation measures based on the applicant's study and responsible agency comments. The sewage disposal plan has been reviewed and the concept; has been tentatively approved by the appropriate agencies. The applicant has designed the project so that no increase in drainage will occur. The site will be designed to utilize the ;golf course ponds as storm drainage holding ponds. Since the site is planned for development and there are no noise sensitive environments in the area, 'there are no foreseen significant impacts within this area. The current zoning would have the potential to allow for 221 dwelling units on the 221 acres. Even tho»gh this request is for only 200 dwelling units, the addition of a golf couirse has the potential to increase the hind use actiYity and intensity over a normal 1 acre development request. Currently the SR -1 Zun ng allows for golf courses with approval of a use permit. The concern, however, is with the combination of both uses creating an overall more intensive development than would normally be expected under an SR -1 Zoning.
