Residential) located -on the north side of Shasta Avenue, approximately 2000 feet west of
Esplanade at 436 West Shasta Avenue, identified as AP 006-270-005, Chico. (LPW) (95-

Commissioner Lambert said she would like to have this hem set for public hearing in order to consider the
Nitrate Action Plan, which allows one dwelling per acre in this area. She wanted a representative of the
Environmental Health Dept. to be present. She would like to know exactly what is allowed -- and does the
Nitrate Action Plan relate to the number of bedrooms, bathrooms or number of dwellings per acre?
Mr. Hogan noted that Condition #4 requires compliance with Environmental Health Dept. requirements.
Commissioner Lambert said that Condition #2 requires meeting minimum acreage of the zone, and
Condition #7 requires compHanoe with aH other regulations and statutes. She would not vote for approval
of the request since she cannot be sure that it meets the requirements of the Nitrate Action Plan.
Mr. Hogan said that there was nothing in the file from the Environmental Health Dept. which indicated a
problem. He noted that there is a letter in the file regarding the tennis court, but that is not subject to
second unit requirements.
There was a discusison of whether or not this item should be set for public hearing or continued for 2
weeks in order to discuss the hem with the Environmental Health Department.
Commissioner Lynch suggested adding the following words to Condition #4: 'and comply with the current
Nitrate Action Plan.'
Commissioner Lambert felt it was important to understand the Nitrate Action Plan, and to have specific
comments from the Environmental Health Dept.
Mr. Hogan said that the Environmental Health Dept. is given the same amount of time as everyone else
to respond with their comments. A generic condition is being used if their comments are not available.
Mr. Hogan suggested putting on a future agenda, an update on the Nitrate Action Plan.
Commissioner Lambert was in favor of having the Nitrate Action Plan on a future agenda. She was also
in favor of continuing this particular item for 2 weeks.
It was moved by Commissioner Lynch, and seconded by Commissioner Seegert, for approval of the Minor
Use Permit for Richard Brooks Sr., and modifying Condition #4 to add: 'meet the current conditions of the
Nitrate Action Plan' as follows:

Section 1: Environmental Endings.
The application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt
under CEOA, and;
Section 2: Zoning Ordinance Endings.
A. The proposed location, size, design, and operating characteristics of the proposed use is in
accordance with the purpose of this Ordinance, the purpose of the zone in which the site is
located, the Butte County General Plan, and the development policies and standards of the County;
and
B. The proposed location, size, design, and operating characteristics of the proposed use will be
compatible with and will not adversely affect or be materially detrimental to adjacent uses,
residents, buildings, structures or natural resources, with consideration given to:
1. Harmony in scale, bulk, coverage and density;
2. The availability, of public facilities, services and utilities;
3. The harmful effect, d any, upon desirable neighborhood character;
4. The generation of traffic and the capacity and physical character of surrounding streets;
S. The suitability of the site for the type and intensity of use or development which Is
propos;
6. Any other relevant impact of the proposed use.
C. The proposed location, size, design, and operating characteristics of the proposed use and the
conditions under which it will be operated or maintained will not be detrimental to the public health,
safety and or welfare, or materially injurious to properties or improvements in the vicinity; and
D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 280,
of the Butte County Code.
Section 3: Action.
Subject to the findings indicated in Sedans 1 and 2 of this report, approve the Minor Use Permit for
Balbutin-Hards/Brooks on AN 006-270-005, subject to the following conditions.
1. In no case shall the detached Second Unit exceed 1200 square feet.
2. The property owner must maintain the minimum acreage requirement of the zone in which the
parcel or lot upon which the Second Unit is to be located.
3. In addition to the off-street parldng required for the primary dwelling, two additional off-street
parldng spaces shall be provided for the second unit. A -garage or carport with a maximum
dimension of 20' by 24' Is permitted for larger Second Units (over 640 sq. ft.).

4. Adequate sewer and potable water facilities shall be provided as determined by the Butte County
Environmental, Health Division, and compliance with the current Nitrate Action Plan.
5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Verification
` of ownership residency shall be required prior to permit issuance and annually thereafter by
submittal of a reoorded declaration in a form specified by the Director of Development Services or
designee.
6.. Payment of $75.00 into the West Chico Fre Station fund. Payment of $197.80 into the Cal -Water
fire hydrant fund (based upon 115' road frontage at $1.72 per foot of frontage.)
7. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
Minor changes may be approved administratively by the Director of Development Services upon receipt
of a substantiated written request by the applicant. Prior to such approval, verification must be made by
each Department or Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed to be major or significant in
nature shall require a formal application for an amendment.

INSTRUCTIONS TO ADMINISTRATIVE PERMIT APPLICANTS
1. If applicant is not the owner, written authorization by the owner or other proof of
agency must be submitted in order for the applicant to legally sign the application.
Application shall be considered void if not signed by the owner or legal agent.
2. All items on application shall be filled in as completely as possible. If an item is not
applicable, please indicate by the term "N/A".
3. It is important that the applicant supply an accurate description of the location of
the proposed project, including the following:

Assessor's parcel number(s) (from the tax bills or Assessor's maps).
Street addresses (if available).
Distances and directions to named streets, bodies of water or railroads.
4. Twen 2 ) copies ofa detailed plot plan ofadeq uate scale to clearly show proposed
buildings and improvements shall accompany and be made part of the "Application
for Administrative Use Permit'. The plot plan should be no larger than 11 " x 1 T', be
folded to 8'1/2" x 11", and shall include the following information:
a. A scaled drawing of the parcel(s) boundaries.
b. Location and dimensions of all existing and proposed improvements on
the property, including buildings, driveways, parking areas, wells, septic
tanks and leach fields.
C. Location and name of bordering streets, access roads, nearby crossroads,
streams, bodies of water and railroads.
d. North arrow and scale of drawing. -
5. The "Application for Administrative Permit" is subject to review by County Staff
and approval by the Planning Director. Any special conditions of approval shall
be made a part of the approved "Administrative Permit" and shall be binding on
the applicant. The procedures for County action on Administrative permit
applications are stated in Chapter 24 of the Butte County Code.
6. In approving an Administrative Permit, the Planning Director may include such
conditions as are deemed reasonable and necessary under the circumstances to
preserve the integrity and character of the zone and to secure the general
purposes of the Butte County General Plan and Chapter 24, of the Butte County
Code. In general, said conditions will be listed as standards in Chapter 24 for
each use. In unique situations additional conditions may be added so long as
they are reasonably related to the use for which the permit is requested.

8. Before submitting an Administrative Permit application, applicant is requested to

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Richard Brooks Sr. is hereby granted a Minor Use Permit in
accordance with application filed: Minor Use Permit to allow a second dwelling located at 436
West Shasta Avenue, Chico.
1. Failure to comply. with the conditions specified herein as the basis for .approval of
application and issuance of Permit, constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance, including
Butte County Code Section'24-62.
2. Unless otherwise provided for in a condition to a Minor Use Permit, all conditions
must be completed by the permittee within 12 months of the delivery of the
countersigned permit to the permittee.
3. If any use for which a Minor Use Permit has been granted is not established within
one year of the date of receipt of the countersigned permit by the permittee, the
permit shall be come null and void and reapplication shall be required to establish
the use.
4. The terms and conditions of this permit shall run with the land and shall be binding upon
and be to the benefit of,the heirs, legal representatives, successors, and assigns of the
Permittee.
SPECIAL CONDITIONS:
1. In no case shall the detached Second Unit exceed 1200 square feet.
2. The property owner must maintain the minimum acreage requirement of the zone in
which the parcel or lot upon which the Second Unit is to be located.
3. In addition to the off-street parking required for the primary dwelling, two additional off-
street parking spaces shall be provided. for the second unit. A garage or carport with a
maximum dimension of 20' by 24' is permitted for larger Second -Units (over 640 sq. ft.):
4. Adequate sewer and potable water facilities shall be provided as determined by the Butte
County Environmental Health Division, and compliance with the current Nitrate Action
Plan.
5. Either the existing single family dwelling or the Second Unit shall be owner occupied.
Verification of ownership residency shall be required prior to permit issuance and annually
thereafter by submittal of a recorded declaration in a form specified by the Director of
Development Services or designee.
6. Payment of $75.00 into the West Chico Fire Station fund. Payment of $197.80 into the Cal -
Water fire hydrant fund (based upon 115' road frontage at $1.72 per foot of frontage.)
7. Applicant must also comply with all other applicable State and local statutes, ordinances
and regulations.
Minor changes may be approved administratively by the Director of Development Services
upon receipt of a substantiated written request by the applicant. Prior to such approval,
verification shall be made by each Department or Division that the modification is
consistent with the application, fees paid and environmental determination as conditionally.

Hand Court, at 436 Shasta Avenue, in the Chico area..

FOR: Planning Manager Public Hearing April 24, 1995
ABSTRACT: This application for a Minor Use Permit for Balbutin-Harris/Brooks meets all the requirements of Section
24-280 of the Butte County Code. Staff recommends approval of this request, with conditions.
PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit on a.1.75 acre parcel
located at 436 Shasta Avenue in Chico. The parcel is zoned SR with a General Plan designation of Low Density
Residential.
ANALYSIS: In this application, Balbutin-HarrisBrooks is asking to build a 1200 square foot home, as a second unit.
The second unit is detached from the main dwelling and proposed to be attached to an indoor tennis court. This request
is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second
unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone
in which it lies nor will it be detrimental to the health, safety and welfare of the intended occupants or the immediate
neighborhood.
ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be

natural resources, with consideration given to:
1. Harmony in scale, bulk, coverage and density;
2. The availability of public facilities, services and utilities;

4. The generation of traffic and the capacity and physical character of surrounding streets;
5. The suitability of the site for the type and intensity of use or development which is proposed;
6. Any other relevant impact of the proposed use.
C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under
which it will be operated or maintained will not be detrimental to the public health, safety and or welfare, or
materially injurious to properties or improvements in the vicinity; and
D. The proposed use Will comply with each of the applicable provisions of Chapter 24, Section 280, of the Butte
County Code.
Section 3: Action.
Subject to the findings indicated in Sections 1 and 2 of this report, approve the Minor Use Permit for Balbutin-
Harris/Brooks on AP# 006-270-005, subject to the following conditions.
1. In no case shall the detached Second Unit exceed 1200 square feet.
2. The property owner must maintain the minimum acreage requirement of the zone in which the parcel or lot
upon which the Second Unit is to be located.
3. In addition to the off-street parking required for the primary dwelling, two additional off-street parking spaces
shall be provided for the second unit. A garage or carport with a maximum dimension of 20' by 24' is permitted
for larger Second Units (over 640 sq. ft.).
4. Adequate sewer and potable water facilities shall be provided as determined by the Butte County Environmental
Health Division.
5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Verification of ownership
residency shall be required prior to permit issuance and annually thereafter by submittal of a recorded
declaration in a form specfied by the Director of Development Services or designee.
6. Payment of $75.00 into the West Chico Fre Station fund. Payment of $197.80 into the Cal -Water fire hydrant
fund (based upon 115' road frontage at $1.72 per foot of frontage.)
7. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations.
Minor changes may be approved administratively by the Director of Development Services upon receipt of a
substantiated written request by the applicant. Prior to such approval, verification must be made by each Department
or Division that the modification is consistent with the application, fees paid and environmental determination as
conditionally approved. Changes deemed to be major or significant in nature shall require a formal application: for an
amendment.

PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit on a 1.75 acre parcel
located at 436 Shasta Avenue in Chico. The parcel is zoned SR with a General Plan designation of Low Density
Residential.
ANALYSIS: In this application, Balbutin-Harris/Brooks is asking to build a 1200 square foot home, as a second unit.
The second unit is detached.from the main dwelling and proposed to be attached to an indoortennis court. This request
is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second
unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone
in which it lies nor will it be detrimental to the health, safety and welfare of the intended occupants or the immediate
neighborhood.

First of all, as neighbors who own property next to or near 436 Shasta.
Avenue, we appreciate being notified and having the opportu-.-iity to
share our concerns on the proposed project(s) as we understand it to
be.
After inquiring with your office regarding the notice, we have learned
the perinit the owner is seeking to obtain, would allow for a small
second hr-rae to be put on the property -- more specifically, either a
newer utoblle or conventional structured home. More importantly, we
also le9:rned they are proposing to build a second tennis court on the
p •ope t.y, which they intend to enclose, and understand :if the above
permit is granted, they can move forward with the process of
constructing a second tennis court.
If this Is in fact the case, we strongly object to the project or
projects for several reasons.
First of all, what is the reason for the proposed second tennis court?
We would like to know if the owner intends to operate a business,
specifically a tennis club for teaching tennis l_ssons.
We oppose any addition or expansion to the existing tennis cou'r't,
which already is a disturbing situation, especially for the neighbors
who's properties back up to or are next to the named property.
The bright lights, noise and activity (cars, people, etc.) that we are
currently experiencing would increase, activity that sometimes begins
very early in the morning and continues late into the evening.
Most importantly, though, is the negative effect we perceive a second
tennis court would. have on our property values. An eye sore to say
the least.

District representatives have reviewed the information, contained in your memorandum dated March 7, 1995
regarding the Brooks Use Permit which will allow a second dwelling. District representatives have determined
that the proposed project will:negatively impact Chico Unified School District and, therefore, warrants further
environmental analysis.
The District recognizes that Senate Bill 1287 (SB 1287) may adversely impact the City's authority to impose
the following requested mitigation measures by rescinding court precedents established via the Mira, Hart and
Murrieta cases; but that issue is yet to be resolved. In addition, any restrictions which may be imposed by SB
1287 may be eliminated if Assembly Constitutional Amendment 6 (ACA 6) fails to win the support of the
majority of California voters. Based on this information, the District requests that the following comments be,
included in the project approval record and requested mitigations imposed to the extent allowed by law.
SCHOOL FACILITIES FOR NEW STUDENTS GENERATED BY THE PROPOSED DEVELOPMENT
Settin
The Brooks application proposes 1 additional residential unit. Applying the District's .43 student yield factor,
this development will generate approximately one school age child.
Utilizing current District actual student enrollment data and projected student enrollment data from already
approved new residential development, each elementary, junior high and senior high school in the District is
filled to capacity. To accommodate a 50+ percent.increase in student enrollment in recent years, the District
(1) reutilized existing school facilities, (2) utilized interim elementary school facilities, (3) placed relocatable
classrooms on existing elementary school campuses, (4) instituted multi -track year-round education in three
existing elementary schools, (5) occupied one new urban elementary school on a year-round schedule, (6)
occupied one new elementary school on a traditional school schedule, (7) is in the process of constructing a
third elementary school, (8) has placed interim facilities on the secondary campuses pending the availability

of new school facilities, (9) acquired a site and has planned to build a new junior high/middle school and (10)
has planned to expand one existing senior high school.
The District continues to be a participant in the State School Building Program wherein the cost of constructing
new school facilities is shared by the State and by the local district in a pro rata fashion. The State-wide need
to construct new schools far exceeds available pro rata State funding; therefore, needed new Chico Unified
School District school facilities have not been provided in a timely manner. Local Chico Unified School
District revenues generated from school impact fees, coupled with the proceeds from the general obligation
bonds approved by the voters in April 1988, will meet the student housing needs generated by local birth rates
and previously approved residential developments but will not meet the student housing needs generated by new
development. The District anticipates housing increasing numbers of students in interim facilities until funding
becomes available to construct new schools.
Impact of,Proposed. Development: on Chico Unified School District Schb Is
Since District elementary, junior and senior high schools are filled to capacity, it is evident that students
generated from Brooks Use Permit application cannot be served by existing facilities. In addition, there is
currently no funding mechanism that will enable the District to provide facilities for these students.
Based on the District's .43 student yield factor per average (1,532 square feet) household, the 1 residential unit
proposed in Brooks Use Permit application will yield approximately one student that must be housed in District
schools. The District projects that larger residential units will yield more than .43 students per household and
smaller residential units will yield less than .43 students per household. To adjust for the higher student yield
factor in larger than average households and the lower student yield factor in smaller than average households,
the District utilizes a mitigation cost based on square footage of habitable space in each household.
This project must be consistent with the .City of Chico General Plan and the impact on the District must be
recognized and addressed in the project approval process.
Mitigation of Impact on Chico Unified School District Schools
The District is opposed to City approval of the proposed Brooks Use Permit application unless the project fully
mitigates its impact on the District.
Acceptable mitigation measures include:
• cash or in lieu equivalent (land or school facilities), approved by the District, which is equal to the full
mitigation cost as described below;
• imposition of a controlled phasing of single or multi -family residential development to coincide with
provision of adequate school facilities; or
0 denial of the project.
The 1993/94 per habitable space square foot cost to fully mitigate the impact of each residential unit is $4.45
per square foot. This amount will be adjusted as needed to reflect the impact of inflation, school facilities
needs, regulatory changes and other cost influencing factors. The full :mitigation cost of $4.45 per square foot
of new residential development will include school impact fees (currently $1.72 per square foot). The school
impact fee will be supplemented with an appropriate amount of cash or in lieu equivalent (land or school
facilities) approved by the District. The combination of school impact fees and cash or in lieu equivalent must
fully mitigate the impact of the development on District schools.
Since the school mitigation cost established by the District is based on habitable square footage of the
residential unit and District representatives are not informed of the exact habitable space of the residential unit
in the proposed development, it is not possible to confirm the total cost of the mitigation at this time. The
following calculation is provided to allow one who is knowledgeable of the habitable space of each residential
unit in the proposed development to make her/his own calculations:
CALCULATION
Total habitable space in residential unit(s) times the current cost for full mitigation in effect when paid ($4.45
per square foot in 1993/94) equals total mitigation.
For example:
1 unit @ 1,200 square feet/unit x $4.45 = $5,340; or
1 unit @ 1,532 square feet/unit x $4.45 = $6,817; or
1 unit @ 1,800 square feet/unit x $4.45 = .$8,010.

24-280 of the Butte County Code. Staff recommends approval of this request, with conditions.
PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a Second Unit on a 1.75 acre parcel
located at 436 Shasta Avenue in Chico. The parcel is zoned SR with a General Plan designation of Low Density
Residential.
ANALYSIS: In this application, Balbutin-Harris/Brooks is asking to build a 1200 square foot home, as a second unit.
The second unit is detached from the main dwelling and proposed to be attached to an indoor tennis court. This request
is consistent with the intent and requirements of Section 24-280 of the Butte County Code. Upon review of this second
unit application, staff has determined that the proposed second unit will not significantly impair the integrity of the zone
in which it lies nor will it be detrimental to the health, safety and welfare of the intended occupants or the immediate
neighborhood.
ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to. be
Categorically Exempt under CEOA Section 15303 (Class 3)(a).
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing will
be mailed to the nearest 10 property owners
RECOMMENDATION: Staff recommends approval of the application for a Minor Use Permit for Balbutin-Harris/Brooks
on AP# 006-270-005, subject to the following findings and conditions.
Section 1: Environmental Endings.
The application for a Minor Use Permit to allow a Second Dwelling Unit is Categorically Exempt under CEOA,
and;
Section 2: Zoning Ordinance Findings.

3. In addition to the off-street parking required for the primary dwelling, two additional off-street parking spaces
shall be provided for the second unit. A garage or carport with a maximum dimension of 20' by 24' is permitted
for larger Second Units (over 640 sq. ft.).
4. Adequate sewer and potable water facilities shall be provided as determined by the Butte County Environmental
Health Division.
5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Verification of ownership
residency shall be required prior to permit issuance and annually thereafter by submittal of a recorded
declaration in a form specified by the Director of Development Services or designee.
6. Payment of $75.00 into the West Chico Fre Station fund. Payment of $197.80 into the Cal -Water fire hydrant
fund (based upon 115' road frontage at $1.72 per foot of frontage.)
7. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations.
Minor changes may be approved administratively by the Director of Development Services upon receipt of a
substantiated written request by the applicant. Prior to such approval, verification must be made by each Department
