Present: Barry Hogan, Planning Manager, Lynn .Richardson, Record Secretary Also Present: Mrs. Camgeni and Sons, Mr. and Mrs. Hansen 1. ITEMS FOR CONSIDERATION A. Randall and Janelle Watkins - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a Bed and Breakfast Home on property zoned A -R (Agricultural Residential) located at 528 Paseo Companeros, identified as AP 040-340-020, Chico. (SB) (95-187) Mr. Hogan read a fax was received from Mr. Watkins withdrawing this project. Mr. Hogan accepted the request for withdrawal and vacated this hearing. B. Mae Cangemi - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a second dwelling on property zoned A -R (Agricultural Residential) located at 775 Plumas Avenue, identified as AP 031-211-026, Oroville. (SB) (95-190) Mrs. Cangemi was present and said she agreed with the conditions. Mr. Hogan said no letters have been received objecting to this project. He noted that the applicant and family were present. He said the application meets the requirements for a second dwelling and he confirmed the action recommended in the staff report and requested this item be set for the next Planning Commission meeting of September 14, 1995 on consent. C. Lloyd Hansen - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a second dwelling on property zoned A -R (Agricultural Residential) located at 21 Buehler Avenue, identified as AP 068-210-109, Oroville. (SH) (96-01) Mr. and Mrs. Hansen were present. Mr. Hogan said one letter has been received stating a concern regarding adequate water pressure in the area for this dwelling. He said the comments received from OWID indicate there is sufficient water pressure in the area to approve this request. Mr. Hogan said there is an additional condition requiring Oroville Union District school fees of $1.72 per square foot. He said the applicant would need to go to the school district and talk to them. Mr. Hansen asked if the second unit could be larger than 1200 square feet? Mr. Hogan said the State law states that 1200 square feet is the maximum a second dwelling can be and is determined to be adequate. ■ BUTTE COUNTY PLANNING SERVICES MEETING ■ MINUTES ■ PAGE 1 ■ Mr. Hansen asked if the primary dwelling is small, could the primary dwelling be considered the secondary dwelling and the new dwelling be made larger than 1200 square feet? I Mr. Hogan said staff is willing to work with him on which one is considered the second dwelling. He said the site plan would have to be revised to reflect which one is the second dwelling. Mr. Hansen said according to his figures, the proposed second dwelling will be very close to 1200 square feet. Mr. Hogan said he should have the Building Division run the figures. If the proposed dwelling is over 1200 square feet, Mr. Hansen needs to write Planning a letter to change the existing dwelling to the second dwelling and submit a new site plan. Mr. Hogan said one letter had been received voicing concerns regarding water pressure in the area and this concern had been answered by OWID. He noted that the Mr. and Mrs. Hansen were present. He said the application meets the requirements for a second dwelling and he confirmed the action recommended in the staff report and requested this item be set for the next Planning Commission meeting of September 14, 1995 on consent adding a new condition "Applicant to pay appropriate Oroville Union School District fees of $1.72 a square foot." APN 040-340-020, File 95-187: A request for a Minor Use Permit to allow a Bed and Breakfast Home located at 528 Paseo Companeros, Chico. The property is zoned A -R (Agricultural -Residential). This project is located in Supervisorial District 4. RELATED ITEMS: None FOR: Administrative Hearing August 28, 1995 ABSTRACT: Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Minor Use Permit to allow a bed and breakfast home in an Agricultural -Residential zone. The bed and breakfast home will occupy an existing 4 -bedroom, 3 -bath, attached 3 -car garage, single-family residence on a 2.15 acre parcel. Three bedrooms will be open to the public. The property is located within an "A" flood zone. Domestic water will be obtained from a well located on the property. Sewage disposal will be handled by on-site septic tank and leach lines. The Land Use Flement of the Butte County General Plan designates the property as Agricultural - Residential. Surrounding parcels are zoned A -R (Agricultural -Residential) and have a Butte County General Plan designation of Agricultural -Residential. Surrounding land use is rural residential and agricultural (orchards). An unused railroad right-of-way makes up the southern boundary of the subject property. The land south of the railroad right-of-way is zoned M-1 (Light Manufacturing). ANALYSIS: This project will have a minimal impact on the surrounding neighborhood. Three bedrooms will be open for use to the public. No studies have been published that have determined the number of average daily automobile trips that a bed and breakfast home generates. A motel, which performs somewhat the same function as a bed and breakfast home, generates approximately 4 to 14 vehicle movements per day per occupied room. The lower figure of four vehicle trips per day per occupied room is probably closest to what a bed and breakfast home will generate, though it may be somewhat on the high side. If all three rooms of the proposed bed and breakfast home are occupied this would mean an additional 12 vehicle trips would be generated each day. These twelve additional vehicle trips will have an insignificant impact on the neighborhood. Off-street parking for this project will not be a problem as the property has ten off-street parking spaces. ■ Butte County Department of Development Services - Planning Division 0 AGENDA ITEM The flood potential originates from Comanche Creek, approximately 287 ft to the north of the property. An "A" flood zone is one in which no base elevation of flooding has been determined. No flooding occurred on the property during last winter's heavy rainfalls. Sewage disposal will be handled by an on-site septic tank and leach line system. Domestic water is obtained from a well located on the property. The Butte County Division of Environmental Health has recommended several conditions for this project. The first condition is that the applicant obtain a "Permit to operate" a food facility. The permit is required so that. the applicant can prepare and serve breakfast to guests staying at the proposed bed and breakfast Breakfast will be the only meal that will be served. The second condition is that the on-site septic system meet Division of Environmental Health's requirements. This will require increasing the size of the exiting system under a County sewage permit ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Notices of the hearing will be mailed to the nearest 10 property owners. RECOMMENDATION: Staff recommends that the Planning Commission approve the Minor Use Permit for a Bed and Breakfast Home for Randall and Janelle Watkins on APN 040-340-020, subject to the findings and conditions listed in Exhibit A. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Section 24-62. 2. Unless otherwise provided for in a condition to a Minor Use Permit, all conditions must be completed by the permittee within 24 months of the delivery of the countersigned permit to the permittee. 3. If any use for which a Minor Use Permit has been granted is not established within two year of the date of receipt of the countersigned permit by the permittee, the permit shall be come null and void and reapplication shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shalf be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Fmdings. A. This project is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. ■ Butte County Department of Development Services - Planning Division ■ 3 A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage and density; 2. The availability of public facilities, services and utilities; 3. The harmful effect, if any, upon desirable neighborhood character, 4. The generation of traffic and the capacity and physical character of surrounding streets; 5. The suitability of the site for the type and intensity of use or development which is proposed; 6. Any other relevant impact of the proposed use. C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Fxhibit A, Minor Use Permit for Randall and Janelle Watkins to allow a Bed and Breakfast Home is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: 1. The Minor Use Permit is approved subject to the site plan on file in the Planning Division office. 2. On the surface a Bed and Breakfast appears to be a low impact quiet type of use. However, my property which borders Paseo Companeros is zoned for industrial use. I am currently developing this property and feel that a conflict could result from mixing these types of uses. I am opposed to a Bed and Breakfast,.if it will cause me to have to spend money and energy to defend or use my property because it was allowed on the adjoining property. The Paseo Companeros neighborhood has a history of being very active in opposing anything that they feel impacts their neighborhood. In fact, they have used litigation as a means to try to accomplish their goals. Currently I am experiencing a trespass problem along the border with Paseo Companeros that I hope to resolve by fencing and no trespassing signs. It is my goal to be a good neighbor and not impact my neighbors and I expect the same from them. If you can assure me that this type of use of the property will not cause conflicts for my property then I -do not oppose..their request. However if,you cannot, then I am strongly opposed to this permit. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. NOTE: "Minor changes may be approved administratively by the Director of Development Services upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for an amendment."
