Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Lisa Lucas is hereby granted a Use Permit in accordance with application filed: 12/10/96 to allow a preschool center for 24 children as a quasi -public use on property zoned R-3 located on the north side of Burnap Avenue approximately. 500 ft. north -of Lassen Avenue in Chico. 1: Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with,the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to. this use permit, all conditions must be completed by the. Permittee within -24 months of, the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void -and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(c), construction of new small structures not involving the use hazardous substances and with an occupant load of 30 persons or less; and Section 2: Zoning Ordinance Findings. A. The proposed use is a conditional use of the property which pursuant to Butte County Code Section 24-35 will not conflict with, impair or be detrimental to the uses both permitted and conditional in -the R-3 zone and the Medium Density Residential General Plan designation in which it is located and/or adjoins because these land use categories allow for small lot, multi -family and public -quasi public uses; and B. The proposed use would not be unreasonably incompatible with, or injurious to, surrounding properties in that the project is conditioned to reduce associated impacts to a level of insignificance that are similar to existing conditions and uses in the area; and C. The proposed use of the property would not be detrimental to the health, safety, and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County because the proposed use will not create any significant noise or traffic related impacts beyond present levels and operating conditions added will further reduce any associated impacts to a level of insignificance. Section 3: Action A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, approve a Use Permit for Lisa Lucas on APN 007-150-047 to allow a preschool for 24 children as a quasi -public use subject to the conditions listed herein. B. Minor changes may be approved administratively by the Director of Development Services, Public Works or Environmental Health, or their designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions: The child care center shall be limited to a'maximum of 24 children and shall be restricted to operating between the hours of 6:00 a.m. and 6:00 p.m. Monday through Friday. 2. The maximum number of employees is two (2). 3. Prior to issuance of building permits applicant shall install all sewage disposal infrastructure under permit from the En �vironmenta! Health Division (EHD) for the use and meet all regulations concerning the provision for adequate septic system installation and water quality/availability. Prior to issuance of Use Permit submit a final site//plan to Planning Division for review and approval showing two entrances connected by a pull through drive, a minimum of three (3) parking spaces and indicating required landscaping pursuant to the Butte County Code Section 24-240, including, but not limited to, parking lot landscaping. 5. Prior to paving driveway or parking area, the applicant shall provide a permanent solution for drainage and submit construction and drainage plans to Department of Public Works for approval and install the required facilities. 6. Property owner shall sign an avigation easement granting the right of continued use of the Chico Municipal Airport in the airspace above the project parcel and acknowledging any and all existing or potential airport operational impacts. 7. Preschool operator shall. have all clients read and sign a disclosure statement acknowledging that the property is located within 1.25 miles of the Chico Municipal Airport and may be subject to the overflight of aircraft. 8. Building identification and/or addresses shall be installed and maintained in conformance with Public Resources Code 4290. 9. The preschool use shall be inspected by the State Fire Marshall. 10. Provide all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide .A!ith 15 feet vertical clearance. - . 11. ' Prior to issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to county standards, as specified in County Improvement Standards. 12. Prior to issuance of building permits deed to Butte County, in fee simple, 30 feet of right-of- way from the centerline of Burnap Avenue. The right-of-way shall be sufficient for the installation of standard No. S-5 at all street intersections. 13. Prior to issuance of building permits, sign and record an Agreement running with the land postponing the installation of road and drainage improvements on Burnap Avenue to RS - 2A road standard, including but not limited to P.C.0 curb, gutter and sidewalk and the required street section. This agreement must be reviewed and approved by the Department of Public Works prior to recording. 14. Prior to issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural publicly maintained drainage channel and shall provide that there is no increase in the peak flow run. -off to said channel. !f drainage is detained.on-site provide a $4200.00 per acre drainage fee for future permanent facilities. 15. Applicant shall comply with all other applicable state and local ordinances, statutes, and regulations. Scale: 1" = 50' 1 Drawn By: LISA LUCAS I Date: May 1 ,1996 Alternate Koch reiterated the motion: that the County install all the signs from whatever funding source is deemed appropriate, and then obtain reimbursement in an appropriate form from the developers within the NCSP area. Mr. Sanders said the first developers would probably not be concerned with reimbursement for such a small amount of money. Chairman Gerst said the signs need to go up prior to development. Commissioner Campbell suggested amending the motion that the County either install the signs or require the developer to install them prior to development. Alternate Koch said development might occur over several years, and the purpose is to have the notification in place before development occurs. The amendment was not accepted, and Alternate Koch said the motion is for the County to install the signs and recover the costs in an appropriate manner. Commissioner Franklin added: "prior to approval of any subdivisions." Mr. Sanders said installation of signs could be a condition of approval. Chairman Gerst said the main concern of ALUC is that the signs get installed and Planning staff should work out whatever mechanism is necessary for accomplishment. A Request for Consistency Findings for Butte County Use Permit #97-08 (Lucas) on APN 007-150-047: A Use Permit to allow a 24 child preschool on property zoned R-3 (Residential) located on the west side of Burnap Ave., approximately 500 ft. north of East Lassen, in the north Chico area. Staff recommends the Commission find the project consistent with the Chico Municipal Airport Environs Plan. Stephen Betts summarized the Agenda Report. Commissioner Hennigan said the real concentration of people is 26 within 1600 square feet. A public school would not be considered. He would be happier if the school was farther from the airport, since it is in the vicinity if instrument departures and quite near the VOR approach. Commissioner Campbell said there would be some open space around the building which might help an airplane miss the structure. Butte County Airport Land Use Commission minutes - January 15, 1997 3 Commissioner Hennigan said that the difference with this project being a private school versus a public school, is that parents would not be compelled to send their children to a private school. He said an instrument departure from runway 3 involves a right turn over or near the project site, since the prevailing winds are from the southeast and 4 out 5 departures are from 1-3. He wondered if the applicant intends to expand the use. HEARING OPEN TO THE PUBLIC Lisa Lucas said the property is in escrow contingent on the approved Use Permit. She chose the property to meet the needs of the children, to have space to run, and to meet the criteria for the Use Permit. She will also build a home on the property and there are no intentions to expand the use. Ms. Leasure said that any expansion of the number of children would require another Use Permit. Chairman Gerst felt that figuring 13 students per acre was misleading. Ms. Lucas said she intends to open in May and operate 5 days a week from 8:30 a.m. to 5:30 p.m. and has half the clientele lined up already. Alternate Combs described a plane crash which hit a group of children. He was concerned for the safety of children and accidents involving large amounts of fuel on take offs. Ms. Lucas said there are other preschools in similar situations near'airports. Alternate Koch said the request is consistent with the Environs Plan so ALUC would be limited to expressing concerns. Commissioner Franklin said if ALUC feels uncomfortable with this use, the plan itself should be changed. The project would be consistent with the draft policy plan. Commissioner Lambert said the policy plan has not yet been adopted and can still be changed. Ms. Leasure said the document in effect is the current Airport Environs Plan. Alternate Koch thought that concerns based on the draft policy plan should be based on density of use with mitigations such as reinforced building materials and emergency exits as discussed in Page 25 of the draft policy plan. Commissioner Hennigan said that regarding location, the site is outside of the primary accident scatter, so the statistical likelihood of an accident at the location is only very slightly higher than at any random location. There might be an Overflight issue of.perception. Since the facility is private parents can choose another facility. Alternate Koch suggested a mitigation that the clients sign a simple acknowledgment recognizing that the facility is in the Overflight area of the airport. Butte County Airport Land Use Commission minutes - January 15, 1997 4 Commissioner Hennigan suggested calling the facility to the attention of the Fire Marshall so he can be extra cognizant of exits and sprinklers and design. Ms. Lucas said the building would be wood frame and stucco. Alternate Combs asked if borate bombers fly over the site Commissioner Hennigan said the normal flight pattern is to the left and it would be very unusual for a flight over this site. Commissioner Campbell favored a finding of consistency with a condition that the parents be notified of being in the Overflight area. Commissioners Hennigan and Koch were in favor of having the Fire Marshall focus on the facility and perhaps have additional exits. Commissioner Franklin said only existing codes can be enforced. Chairman Gerst was concerned about single event noises and potential complaints. Commissioner Hennigan said the site is over one mile from the runway. Probably the planes making noise would be older designs such as a Twin Beech or a C-45. Alternate Koch said the parents using the facility could choose to go elsewhere if the noise bothers them, since they are not the property owner. There was an explanation of CNEL versus dB. Ms. Lucas said the adjacent properties are a mobile home park for seniors, twelve duplexes and an apartment complex. Alternate Koch said.the concern is for additional noise exposure to more people. Ms. Leasure said the property is zoned R-3 which could allow 27 units to be developed, and with 2 persons per unit, there could be 62.79 persons residing on the parcel without a Use Permit. Alternate Koch said that noise attenuation mitigations could be recommended, but not used for a finding of inconsistency since the property is outside those noise levels. Recommendations can be made for noise attenuation, building construction and exits and notification to parents. Commissioner Franklin thought the concerns being discussed should be part of the policy plan discussion rather than on this project. Butte County Airport Land Use Commission minutes - January 15, 1997 5 It was moved by Commissioner Franklin and seconded by Commissioner Campbell to find the project consistent with the Chico Municipal Airport Environs Plan as per Exhibit A of the staff report, including the requirement for an aviation easement. Commissioner Hennigan said that normal building construction and energy efficient construction would attenuate noise and heavier construction would attenuate noise even more. Ms. Lucas asked if the intent was to keep the noise from coming out of the preschool or into the preschool. HEARING CLOSED TO THE PUBLIC It was moved by Commissioner Hennigan and seconded by Commissioner Lambert to amend the motion to include making a recommendation that a disclosure be provided to parents regarding airport activity. The amendment passed by the following vote: AYES: KOCH, HENNIGAN, LAMBERT, CAMPBELL AND Combs NOES: FRANKLIN AND GERST It was moved by Commissioner Hennigan and seconded by Alternate Combs to amend the motion to recommend a noise attenuation mitigation to meet PG&E energy efficient construction standards. The motion to include the amendment failed. It was moved by Commissioner Hennigan to have the Fire Marshall make sure the structure has adequate egress and fire protection. There was no second to the motion for this amendment. Ms. Leasure said the Use Permit would receive review by CDF. It was agreed that normal permit procedures by the State Licensing Board and the Building Department should address building construction safety concerns. Section 1: ENVIRONMENTAL FINDINGS A. No environmental documentation was submitted at time of review. However, it is not foreseen that there will be any significant impacts at this time. The ALUC finds the project is consistent with the Chico Municipal Airport Environs Plan and that the project is compatible with the viable, responsible operation of the Chico Municipal Airport subject to the following recommended conditions. Section 3: RECOMMENDED CONDITIONS A. Property owner shall sign an aviation easement granting the right of continued use of the Chico Municipal Airport in the airspace above the subject parcel and acknowledging any and all existing or potential airport operational impacts. The property is zoned R-3 (Medium Density Residential). This project is located in Supervisorial District 3. RELATED ITEMS: None FOR: Planning Commission Meeting of March 13, 1997 ABSTRACT: This application is for a Use Permit to allow a preschool for 24 children. The proposed use requires a use permit in the R-3 zone and is a Secondary Use in the Medium Density Residential General Plan designation. Staff recommends approval with conditions and findings contained in this report. APPLICABLE BUTTE COUNTY REGULATIONS: This use permit application is submitted pursuant to Butte County Code Sections: 24-45 (Use Permits) which requires that an application be submitted and a public hearing be held by the Planning Commission. The Commission may grant a use permit when it finds that the proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health or general welfare of the persons residing or working in the neighborhood or to the general health, safety and welfare of the residents of the county; and 24-120,D-3 (Residential Zones -R3) which indicates that preschools require a conditional use permit; and 24-240 (Parking Regulations) which stipulates that preschools provide one (1) space per classroom or office but in no case less than three (3) spaces; and 26-12 (Improvement Requirements -Urban Areas) which stipulates that commercial uses in the Chico Urban Area are required to construct curb, gutter, sidewalks, and drainage facilities identified in the Site Improvement standards pursuant to Chapter 20 of the Butte County Code. PROJECT CHARACTERISTICS: This project is a request for a Use Permit to allow a 24 child, 1500 sq.ft. preschool. The use will occur on a 2.11 acre parcel located on the west side of Burnap Avenue approximately 500 ft. north of East Lassen Avenue, in north Chico. The parcel is presently undeveloped and unkept, with weeds, small trees and other debris. The site is surrounded by a mixture of medium density residential uses including apartments to the north and east, a mobilehome park to the west and single family dwellings to the south. The site is accessed from Burnap Avenue which is unimproved at all locations except in front of the two multi -family apartment units directly to the north of the site which do have curb, gutter, and sidewalk improvements along their frontage. The road frontage of the project site is presently gravel/dirt. The project will utilize a septic system and will connect to a public water supply. The center is intended to accommodate 24 children approximately 2-6years of age and will be a structure developmental learning environment. The center will operate Monday through Friday between the hours of 8:00 a.m. and 5:30 p.m. and wi I employ two full-time teachers. There is -a proposed 10,000+/- sq.ft. play area for outdoor play activities. The applicant is providing 4 parking spaces for the use. All driveways and parking areas are proposed to be graveled. ANALYSIS: This project is conditionally consistent with the R-3 zone as a private school/quasi-public use as discussed by the Board of Supervisors (Discussion Item 87-405). The Board has interpreted that day care facilities and schools shall be allowed in all zones having a provision for quasi -public uses subject to first securing a use permit. The Medium Density Residential General Plan designation indicates that quasi -public uses are Secondary Uses. Careful and deliberate review of the use found there to be no environmental constraints associated with this infill development on a vacant lot. Staff has identified four areas of valid discussion: compatibility with surrounding uses, site requirements, sewage disposal requirements and the need to meet building code requirements for a child care center. Land use compatibility The site is located in an R-3 zone which is the second greatest density zone under the County Zoning Ordinance. This zone is intended to conditionally allow for a mix of residential, public, medical, educational and neighborhood commercial uses. The existing parcel is an undeveloped, unkept island located in an area of existing mixed used medium density residential development. The area presently includes multi -family apartments, a mobile home park, condominiums and small lot single family dwellings. There are no substantial impacts expected to occur in the area because of the variety of development and the large lot size (2.11 ac.) utilized for the preschool. The closest house to the preschool is located on the south property line, approximately 75 fe a school site and se crated b a six foot fence. The most significant impact to this house an other areas of the neighborhood will be noise generated by children playing outside. This is not expected to be a substantial impact because the students will be spending the majority of time in the indoor learning environment and there are existing children playing in the area. Traffic related impacts are not expected to be significant because the use will generate only a maximum potential for 44 trips a day which will have no significant impact on Burnap Avenue or its intersections with Eaton Road or East Lassen Avenue. This infill preschool use will represent a positive impact due its location in a medium density residential area that has remaining growth potential where the demand for child care and preschool services is significant and options are limited. This use will hopefully provide a service to the immediate community .of families which may further reduce associated impacts to other locations in the urban area. The project is located approximately 1.25 miles from the Chico Municipal Airport and within the Horizontal Surface (Overflight Zone). The project site is lo -ca -ted in an area that would be subject to periodic overflights of aircraft. The project was submitted to the Airport Land Use Commission (ALUC) for a consistency review with the Chico Municipal Airport Environs Plan. The ALUC report found the project to be consistent with the Environs Plan and indicated that there are no noise or safety restrictions affecting the project. The Commission did recommend that the property owner sign an avigation easement and have clients of the preschool read and sign a disclosure statement recognizing the proximity to the airport. There is, however, no precedent for the notification of clientele and this may be unsupportable if the applicant opposes the suggestion. Site requirements The State of California requires 35 sq. ft. of space per child indoors and 75 sq. ft. of space per child outdoors for this use which can be accommodated by the property and proposed buildings. The Butte County Zoning Ordinance requires that a preschool provide a minimum of three (3) parking spaces. The preschool will employ two (2) full-time teachers requiring parking spaces. The site plan has anticipated these needs and provides for four (4) parking spaces with additional overflow parking available on-site. A large gravel parking and unloading area is planned for the site and is located entirely off-street. The two-way access along the road will reduce congestion and safety concerns. The Department of Public Works (DPW) has indicated that the project is located in the Chico Urban Area and as such, the DPW is requesting plans for full urban improvements including a half street section, curb, gutter and sidewalk. The applicant has indicated that this condition will be financially difficult (approximately $10,000.00) to fulfill within the two years provided by the use permit due to the limited resources generated by the proposed business. The Commission may wish to consider an extension as was granted the recently approved preschool (UP97-02) on Sacramento Avenue that was a comparable use and scenario. Considering the large parcel size (2.11 ac.) with 200 feet of frontage, the low level impact of the use and lack of such improvements along Burnap Avenue with the single exception of the apartment complexes, staff would not oppose such an extension. Butte County Department of Development Services - Planning Division # 2 The DPW also requires the applicant to provide a permanent solution to drainage which will require the payment of drainage fees ($4200.00/acre) for urban area improvements. A condition has also been added requiring drainage plans for the site if in the future the gravel area is paved. Sewaoe DISDosal Requirements The project was thoroughly reviewed by the Environmental Health Division (EHD). The EHD responded in their letter of December 19, 1996 that the use as proposed for 24 children and two employees is acceptable pursuant to the provisions of the Chico Nitrate Action Plan, Basin Plan Amendment/Septic Tank Prohibition Order. Any expansion of the use would require additional review by the EHD. Other concerns The City. of Chico has commented that this area is prezoned R-2 which allows a density range of 7.1 to 14 dwelling units per acre. They would prefer that the utility of this 2.11 acre lot not be impaired by placing structures in a manner that would impede future development at above densities. The location of the preschool in the southeast corner of the site will not preclude future medium density development of the site. The City has also requested that the project be constructed with a sanitary sewer system connection in anticipation of future sewering of the area and that the applicant sign a waiver of protest to future sewer assessment district fees. These two items could be agreed to by the applicant, however, staff is not recommending these conditions due to the speculative nature of the scheduling of sewer facilities in this area and the additional.cost involved when considering the minor development represented by the preschool. The Butte County Fire Department has commented on the project and will require the applicant to provide an all weather access to the structures, install building identification in accordance with PRC 4290, e iato_tbe-1Aie ENVIRONMENTAL DOCUMENTATION: This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(c), construction of new small structures not involving the use hazardous substances and with an occupant load of 30 persons or less. Smith said a master plan is being developed in conjunction with the Child Care Planning Council. Ideas being discussed include: actively recruiting more child care providers, providing more training for those interested in the field. exploring business partnerships for on-site facilities, and working with school districts for more pre- and after -class programs. Wright proposes that the state hire county directors who would then oversee day care programs run by welfare recipients and serv- ing their children at community facilities. That way. the recipients get affordable child care and can learn a skill at the came time, Wright said. Also, she suggested that those who du receive subsidized day care be required to volunteer time at centers to minimize paid staff needs. That would reduce child care costs. Wright said. While sympathetic to welfare parents. Wright agrees they need to help themselves. He suggested that the requirement for curbs, gutters and sidewalks would be a hardship on the applicant, and the applicant be given five years to complete the requirements or be allowed a covenant. Commissioners Cage and Leland noted they have seen the site. HEARING OPEN TO THE PUBLIC Lisa Lucas said the conditions are acceptable. She would prefer not to have a disclosure requirement for overflights, but would accept the condition if necessary. She would prefer to postpone the street improvements indefinitely or at least for five years. Mr. Lucas said annexation to the City of Chico is not planned in the foreseeable future. There was a discussion of storm drainage and road improvements. Commissioner Mooney was in favor of a covenant since piecemeal improvements can create drainage problems. HEARING CLOSEDTO THE PUBLIC, Chairman Lambert said the disclosure condition should `;require" the applicants to read and sign the disclosure statement not just be "asked." She suggested the following wording: "Preschool operator shall obtain from all clients a signed disclosure statement acknowledging that the property is located within 1.25 miles of the Chico Municipal Airport and subject to overflight of aircraft." The center is intended to accommodate 24 children approximately 2-6 years of age and will be a structured developmental learning environment. The center will operate Monday through Friday between the hours of8:00 a.m. and 5:30 p.m. and will employ two full-time teachers. There is a proposed 10,000+/- sq.ft. play area for outdoor play activities. The applicant is providing 4 parking spaces for the use. All driveways and parking areas are proposed to be graveled. In accordance with State of California Child Care Licensing requirements the entire play area surrounding the house is fenced. # Butte County Department of Development Services - Planning Division # 1 N N ANALYSIS: This project is conditionally consistent with the R-3 zone as a private school/quasi-public use as discussed by the Board of Supervisors (Discussion Item 87-405). The Board has interpreted that daycare facilities and schools shall be allowed in all zones having a provision for quasi -public uses subject to first securing a use permit. The Medium Density Residential General Plan designation indicates that quasi -public uses are Secondary Uses. Careful and deliberate review of the use found there to be no environmental constraints associated with this infill development on a vacant lot. Staff has identified four areas of valid discussion: compatibility with surrounding uses, site requirements, sewage disposal requirements and the need to meet building code requirements for a child care center. Land use comoatibili The site is located in an R-3 zone which is the second greatest density zone under the County Zoning Ordinance. This zone is intended to conditionally allow for a mix of residential, public, medical, educational and neighborhood commercial uses. The existing parcel is an undeveloped, unkept island located in an area of existing mixed used medium density residential development. The area presently includes multi -family apartments, a mobile home park, condominiums and small lot single family dwellings. There are no substantial impacts expected to occur in the area because of the variety of development and the large lot size (2.11 ac.) utilized for the preschool. The closest house to the preschool is located on the south property line, approximately 75 feet from the school site and separated by a six foot fence. The most significant impact to this house and other areas of the neighborhood will be noise generated by children playing outside. This is not expected to be a substantial impact because the students will be spending the majority of time in the indoor learning environment and there are existing children playing in the area. Traffic related impacts are not expected to be significant because the use will generate only a maximum potential for 44 trips a day which will have no significant impact on Burnap Avenue or its intersections with Eaton Road or East Lassen Avenue. This infill preschool use will represent a positive impact due its location in a medium density residential area that has remaining growth potential where the demand for child care and preschool services is significant and options are limited. This use will hopefully provide a service to the immediate community .of families which may further reduce associated impacts to other locations in the urban area. The project is located approximately 1.25 miles from the Chico Municipal Airport and within the Horizontal Surface (Overflight Zone). The project site is located in an area that would be subject to periodic overflights of aircraft. The project was submitted to the Airport Land Use Commission (ALUC) for a consistency review with the Chico Municipal Airport Environs Plan. The ALUC report found the project to be consistent with the Environs Plan and indicated that there are no noise or safety restrictions affecting the project. The Commission did recommend that the property owner sign an avigation easement and have clients of the preschool read and sign a disclosure statement recognizing the proximity to the airport. There is, however, no precedent for the notification of clientele and this may be unsupportable if the applicant opposes the suggestion. Site reauirements The State of California requires 35 sq. ft. of space per child indoors and 75 sq. ft. of space per child outdoors for this use which can be accommodated by the property and proposed buildings. The Butte County Zoning Ordinance requires that a preschool provide a minimum of three (3) parking spaces. The preschool will employ two (2) full-time teachers requiring parking spaces. The site plan has anticipated these needs and provides for four (4) parking spaces with additional overflow parking available on-site. A large'gravel parking and unloading area is planned for the site and is located entirely off-street. The.two-way access along the road will reduce congestion and safety concerns. The Department of Public Works (DPW) has indicated that the project is located in the Chico Urban Area and as such, the DPW is requesting plans for full urban improvements including a half street section, curb, gutter and sidewalk. The applicant has indicated that this condition will be financially difficult (approximately $10,000.00) to fulfill within the two years provided by the use permit due to the limited resources generated by the proposed business. The Commission may wish to consider an extension as was granted the recently approved preschool (UP97-02) on Sacramento Avenue that was a comparable use and scenario. Considering the large parcel size (2.11 ac.) with 200 feet of frontage, the low level impact of the use and lack of such improvements along Burnap Avenue with the single exception of the apartment complexes, staff would not oppose such an extension. # Butte County Department of Development Services - Planning Division # 2 N N The DPW also requires the applicant to provide a permanent solution to drainage which will require the payment of drainage fees ($4200.00/acre) for urban area improvements. A condition has also been added requiring drainage plans for the site if in the future the gravel area is paved. Sewage Disposal Requirements The project was thoroughly reviewed by the Environmental Health Division (EHD). The EHD responded in their letter of December 19, 1996 that the use as proposed for 24 children and two employees is acceptable pursuant to the provisions of the Chico Nitrate Action Plan, Basin Plan Amendment/Septic Tank Prohibition Order. Any expansion of the use would require additional review by the EHD. Other concerns The City of Chico has commented that this area is prezoned R-2 which allows a density range of 7.1 to 14 dwelling units per acre. They would prefer that the utility of this 2.11 acre lot not be impaired by placing structures in a manner that would impede future development at above densities. The location of the preschool in the southeast corner of the site will not preclude future medium density development of the site. The City has also requested that the project be constructed with a sanitary sewer system connection in anticipation of future sewering of the area and that the applicant sign a waiver of protest to future sewer assessment district fees. These two items could be agreed to by the applicant, however, staff is not recommending these conditions due to the speculative nature of the scheduling of sewer facilities in this area and the additional cost involved when considering the minor development represented by the preschool. The Butte County Fire Department has commented on the project and will require the applicant to provide an all weather access to the structures, install building identification in accordance with PRC 4290, and pay the current fee into the West Chico Fire Station Fund. ENVIRONMENTAL DOCUMENTATION: This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(c), construction of new small structures not involving the use hazardous substances and with an occupant load of 30 persons or less. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(c), construction of new small structures not involving the use hazardous substances and with an occupant load of 30 persons or less; and Section 2: Zoning Ordinance Findings. A. The proposed use is a conditional use of the property which pursuant to Butte County Code Section 24-35 will not conflict with, impair or be detrimental to the uses both permitted and conditional in the R-3 zone and the Medium Density Residential General Plan designation in which it is located and/or adjoins because these land use categories allow for small lot, multi -family and public -quasi public uses; and B. The proposed use would not be unreasonably incompatible with, or injurious to, surrounding properties in that the project is conditioned to reduce associated impacts to a level of insignificance that are similar to existing conditions and uses in the area; and C. The proposed use of the property would not be detrimental to the health, safety, and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County because the proposed use will not create any significant noise or traffic related impacts beyond present levels and operating conditions added will further reduce any associated impacts to a level of insignificance..
