I will contact Mr. Estrella and inform him of our stop payment process. We will send him the declaration for a stop payment and get his current and correct mailing address. FYI, our policy on stop payments is: we require a 21 calendar day waiting period, from check issue date. A declaration is sent to the payee for them to complete and sign stating the reason they did not receive the check and correct mailing address. Due to the declaration being a 3 part form and must be an original it cannot be faxed or scanned. Once we receive the declaration back the stop pay is issued on the original check and".the paperwork is forwarded to A/P for reissue. Per the county agreement with the post office, they will not forward any mail from us. The only way we would have known Mr. Estrella changed his address is, 1. he notified us directly or 2. we received return mail from the post office with his current address. We have been experiencing a higher volume of mail either not reaching its destination or taking an extra long time to get there now that the PO has moved their distribution center to Sacramento from Marysville. The information, discussed over the phone with Diane and passed onto Mr. Estrella is not quite what I had intended for Diane to convey. I had also mentioned that the post office will forward mail to a new address for what I believe is currently 6 months ... I had also mentioned that I didn't know when Mr. Estrella's address had changed. I recommended to DiE ne that Mr. Estrella contact the local post office to see if they could identify the current location of the check. Since this was the County's mistake and Mr. Estrella seems to be quite unhappy at this point, I would recommend that once the time requirement for issuing a stop payment has been met, that we go forward with that step. If the ref -and is returned to the County prior to that date, then of course no stop will be needed. I wanted to bring you into this issue at this point since A/P would be processing the stop payment. FYI, our policy on stop payments is: we require a 21 calendar day waiting period, from check issue date. A declaration is sent to the payee for them to complete and sign stating the reason they did not receive the check and correct mailing address. Due to the declaration being a 3 part form and must be an original it cannot be faxed or scanned. Once we receive the declaration back the stop pay is issued on the original check and the paperwork is forwarded to A/P for reissue. Per the county agreement with the post office, they will not forward any mail from us. The only way we would have known Mr. Estrella changed his address is, 1. he notified us directly or 2. we received return mail from the post office with his current address. We have been experiencing a higher volume of mail either not reaching its destination or taking an extra long time to get there now that the PO has moved their distribution center to Sacramento from Marysville. Since this was the County's mistake and Mr. Estrella seems to be quite unhappy at this point, I would recommend that once the time requirement for issuing a stop payment has been met, that we go forward with that step. If the refund is returned to the County prior to that date, then of course no stop will be needed. I wanted to bring you into this issue at this point since A/P would be processing the stop payment. I need a letter from Skycrest Enterprises - Cousin Gary's Homes authorizing release of the deposit to (applicant) Thomas Estrella, in order to process the refund, and the reason for this is because Cousin Gary's Home wrote the check for the $2000 so this is why we are requesting some kind of authorized documentation from Skycrest Enterprises so we can release it to him or else it would go to Cousin Gary's Homes beings they are the ones who wrote the check for the deposit initally. We have contacted all the representatives ie: Skycrest Enterprises dba Cousin Gary's Homes, Redline Installations, Inc., Golden West Homes, and found that all payments have been paid by either the owner, or a relative of the owner. We have created a " Waiver of Interest" form which provided payment information for each of these deposits involved. We have sent these forms to all the Mobile representatives to verify payment status, and have their signatures. Once we receive all the originals back, we will have them on file for future deposit refunds. In Robert Comer's situation, he has stated his Father has passed away, and had several different accounts that have been closed out. He stated that he paid the Contractor, which paid Fleetwood Retail Corp., but cannot find the receipt for proof of payment. 11/1/2010 Page 3 of 7 So ........... Administrative Permit for Thomas Estrella on APN 047-200-032 for a temporary second dwelling to be located at 15297 Reese Road, Chico, on property zoned A-10 (Agricultural, 10 -acre parcels). PERMIT REQUIREMENTS: Approval for a temporary second dwelling is subject to the following requirements: 1. A mobile home certified under the 1974 National Mobile Home Construction and Safety Standards Act. Occupancy of the mobile home shall be limited to Thomas Ronald Estrella. An affidavit attesting to the relationship of the involved parties was submitted with the permit application. 2. No rent is to be charged to the occupant of the mobile home. 3. The temporary mobile must meet the requirements of the Butte County Environmental Health Department for domestic water supply and sewage disposal. The granting of this permit does not remove the requirement of obtaining the appropriate permits from other Divisions, Departments, or Districts. 4. The siting of the mobile home shall be exempt from the site requirements of the residential zoning district, except as required by Butte County Code Chapter 24, and the Butte County Code Chapter 28A. 5. The mobile home is declared to be a temporary use on the property, accessory to the primary unit, and shall not be placed on a permanent foundation. Additionally, a temporary mobile home shall not be permitted on a lot or parcel where there is an approved Second Unit. 6. The permit shall be granted for a term of two years. Extensions of the term for the permit, not exceeding one year for each extension, may be granted if the application for the extension is filed, with the Planning Division, within 60 calendar days prior to the date of expiration. 7. The mobile home shall be vacated upon expiration, or revocation, of the Permit and removed within one hundred twenty (120) days after expiration of the Permit. If it is not removed within one hundred twenty (120) days, the County shall remove said mobile home and store it at the owner's expense. . . 8.
