Dear Ms McGilvary, It has come to our attention that the Butte County Public Works Department has an ongoing Code Enforcement Case# PWCE08-0078 on your property regarding placing a fence in the County right-of-way without an encroachment permit. The Department of Development Services was not aware of this action at the time of the issuance of the above referenced Home Occupation Permit — ADM00-0019. This is to inform you that the Department of Development Services will not issue any building permits, which are required for you to be meet the Conditions of ADM09-0019. Until such time as Code Enforcement Case# PWCE08-0078 is resolved, the Department of Development Services will not issue any building permits on this parcel and you may not engage in the Home Salon -Photo Studio use. Description of Approved Use This is a home occupation for a Beauty Salon and Photo Studio. They will provide the following services: hair cuts, hair color, perms, waxing, make up, and in studio portraits. They will have some retail sales of hair care products and make up to salon customers only, no drop-in buyers. There will be no deliveries of any kind; they will pick up all retail items and any items needed for the salon and portrait studio themselves. They will operate between the hours of 8am and 6pm between one to three days through out the week, but no more than three days per week. They will only be servicing a maximum five clients on the days they do operate. They will provide parking on the property for all clients; they have a handicap accessible driveway that is capable of holding up to seven vehicles and a driveway on the south side of our home that is handicap accessible. The business will be located in the south side of the existing home. They will have storage cabinets for all devices and chemicals which will be stored on site, and all potentially hazardous chemicals will be stored in locked storage areas on site. The sign that will be used for the business will be no larger than 3'X 3 it will not be a lit sign. Conditions of Approval (consistent with Butte County Zoning Code Section 24-270) 15. This home occupation is to allow a one -chair in-home beauty parlor/shop within the home on this site. 16. The maximum number of customers per day will be five (5). 17. Operation is limited to three days per week, Monday through Saturday only, between the hours of 8 AM and 6 PM. 18. Only one beauty salon workstation/"chair" and related appurtenances is allowed. 19. No exterior storage related to this use is allowed. 20. Permittee must make a bathroom in the residence available for use by customers. 21. Permittee will maintain all appropriate permits and licenses from the State of California. 22. Prior to any operations, permittee shall receive approval from the Butte County Environmental Health Department for the waste water discharges related to this use into Home Occupation ADM 09-0019, APN 025-250-046 the septic system. The property owner will be required to obtain a sewage disposal permit from this Department to accommodate the additional wastewater load from this proposed use. The sewage disposal system must be installed and certified by this Department prior to any operations. 23. Prior to any operations, permittee will obtain all required building permits from Butte County for any structural, electrical or plumbing modifications required to comply with the correct occupancy category for this use, including compliance a with all handicapped accessibility standards. 24.'Employment shall be limited to members of the family residing on the premises. 25. Work shall be conducted entirely within the residence. 26. On -premises advertising for the home occupation shall be limited to one (1) unlighted sign with not more than three (3) square feet of display area, and such sign shall not be located in any required yard. 27. All equipment, materials and wastes connected with the home occupation shall be contained within a building, except for agricultural products. In exception to the above standards, the following shall apply to all FR (Foothill -Recreational) zones: A. Home Occupations are considered to be accessory to the residential use and are permitted only when the proprietor resides on the premises. B. Not more than one (1) employee or assistant may be engaged for work or service on the premises in connection with such uses. C. Advertising displays shall be limited to one (1) unlighted sign with no more than six (6) square feet of display area. Such sign shall not be located in any required yard.
