The proposed mobile is to be located approximately 210' south of Lower Wyandotte Road and approximately 60' west of the easterly property line. The second dwelling unit will be over 120' from the existing mobile home on the project site. This placement should not cause any undue hardships on the neighboring properties. Installation of a mobile home at this location also should not result in any land use conflicts or incompatibility of land uses. The adjoining parcels are developed with single family dwellings on acreages greater than 2.5 acres. The applicant states that the additional mobile will be occupied by his mother-in-law, Betty J. Smith. The Aunt Minnie Provisions 24-304 was adopted to allow families to take care of one another and still maintain independent living quarters and privacy. The application clearly meets the intent of the Temporary Mobile Home Ordinance. Temporary mobile homes also come under County Code Section 24-47 concerning issuance of a Use Permit. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the Code Section. The Code also makes provisions for the County requiring a Bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that taxpayers at large (via the general fund) are not charged those expenses should the county be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the county removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and visible site characteristics. Taking the median figures and adding a small amount for administrative costs and sewage costs, it appears that a reasonable deposit would be $1,500.00 per single wide and $2,000.00 for a double wide mobile home. These amounts seem reasonable to insure that the mobile home is removed at no cost to the county or the taxpayers. The applicant proposes to place a double wide mobile home on the property, so a $2,000.00 bond should be assessed. This project is categorically exempt from environmental review as required by the California Environmental Quality Act in accordance to Public Resources Code Section 15303, Class 3. The project also r 3UTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - January 19, 1989 r conforms to the requirements of the Butte County Code Section 24- 304 regarding the placement of a temporary mobile home. I understand that you have recently renewed the bond for another 12 months and that you may need to hold on to it until it matures next year to avoid penalties. When you are ready to cash in your bond you will need to bring the check back to our office so that we may sign off on it as well as the bond is payable to John or Sandra DeWees and Butte County Planning Commission. Over the past several months our department has lost several key clerical staff due to budget issues. We are in the process of cross -training remaining staff to process these refunds and other fiscal requests. We appreciate your patience with our department as we worked to process your refund. If you have any questions, please contact me at 538-6571. Page 1 of 1 Lewellen, Diane From: Michelena, Mark Sent: Tuesday, February 17, 2009 12:22 PM To: DeBrunner, Deborah Cc: Lewellen, Diane; Jolliffe, Stacey Subject: ADM 89-28 - Temporary Mobile Home Deborah, The applicant/owner (Mr. DeWees) for ADM 89-28 has requested a refund of his $2,000.00 deposit (CD). He know longer owns the property. We have been waiting for the new owners to apply for a new AMD (Temporary Mobile Home), convert to a permanent 2nd dwelling or remove it. The new owners applied for the Temporary Mobile Home (ADM09-0003) on Friday (2/13/09). The application included the $2,000.00 deposit (check). The department now needs to begin the refund process. The history on this is that Mr. DeWees sold the property last February and did not work out the logistics on having the new owner deal with converting the Aunt Minnie, removing it or converting to a 2nd dwelling. We informed Mr. DeWees that we will not return his deposit until the new owners resolved the issue. Thank you.
