Hogan, Planning Manager DATE: August 3, 1995 PURPOSE: Administrative Permit on. AP# 047-580-020 for a temporary second dwelling to be located at 4589 Munjar Road, in an A-10 zone. PERMIT REQUIREMENTS: Approval for a temporary second dwelling is subject to the following requirements. 1. Occupancy of the mobile home shall be limited to Frieda Randlett, mother. An affidavit attesting to the relationship of the involved parties was submitted with the permit application. 2. No rent is to be charged to the occupant of the mobile home. 3. The temporary mobile must meet the requirements of the Butte County Environmental Health Department for domestic water supply and sewage disposal. The granting of this permit does not remove the requirement of obtaining the appropriate permits from other Divisions, Departments or Districts. 4. The siting of the mobile home shall be exempt from the site requirements of the residential zoning district, except as required by this Section, and the Butte County Code Chapter 28A. 5. The mobile home is declared to be a temporary use on the property, accessory to the primary unit, and shall not be placed on a permanent foundation. Additionally, a temporary mobile home shall not be permitted on a lot or parcel where there is an approved Second Unit. 6. The permit shall be granted for a term of two years. Extensions of the term for the permit, not exceeding one year for each extension, may be granted if the application for the extension is filed, with the Planning Division, within 60 calendar days prior to the date of expiration. 7. The mobile home shall be vacated upon expiration, or revocation, of the Permit and removed within one hundred twenty (120) days after expiration of the Permit. If it is not removed within one hundred twenty (120) days, the County shall remove said mobile home and store it at the owner's expense. 8. The Permit may be revoked if any of the terms or conditions of the Permit are violated or if any acts or omissions of the permittee in connection with the use authorized by said Permit constitute a public nuisance. 9. The applicant must maintain a bond or deposit in the amount of $1,500 for a single -wide mobile home or $2,000 for a double -wide mobile home. I am still checking on whether we have liability or are immune from a damages suit for giving the deposit to the wrong person, but I would recommend that DDS require the gentleman requesting the deposit to show proof of both the transfer from his mother in law to his wife and proof that his wife is deceased. The former should exist in the form of DMV transfer documents and the latter in the form of a death certificate. DDS may also elect to require him to prove that he is the registered owner of the mobile home, to which he should have perfected the title within a reasonable time after his wife died. He may not have taken this step, however, if it has been destroyed or is of such a low value, at this point, that he is going to junk it instead of sell it. In any event, it goes without saying that you should not return the deposit until the mobile is off the property. Further, if the current deposit amount you require is not enough to pay for removal and disposal of a mobile home, the required deposit amount should be raised. The actual amount is not set forth in 24-295.10, it says "adequate to cover removal expense." If DDS is not requiring a sufficient amount to cover removal, then DDS is violating the requirement set forth in the ordinance. Yvonne, Joe — we have a widower who says his mother-in-law (now deceased and living in a 2nd dwelling via an "Aunt Minnie) had deeded the trailer to her daughter, his wife (also deceased). The widower is working with Carl Durling and making arrangements to remove the 2nd dwelling from the property and would like a refund of his deposit for the Aunt Minnie. Cheryl raised the question of proof of ownership and refunding him the deposit. The original check was paid by Mid -Valley title as part of the escrow on the trailer. We have renewals by the wife, and then after she died, the husband (widower) for the mother-in-law's dwelling. What level of proof/assurance do we want to determine that he is entitled to the refund? Do you see the need to consult with County Counsel? Yvonne, Joe — we have a widower who says his mother-in-law (now deceased and living in a 2nd dwelling via an "Aunt Minnie) had deeded the trailer to her daughter, his wife (also deceased). The widower is working with Carl Durling and making arrangements to remove the 2nd dwelling from the property and would like a refund of his deposit for the Aunt Minnie. Cheryl raised the question of proof of ownership and refunding him the deposit. The original check was paid by Mid -Valley title as part of the escrow on the trailer. We have renewals by the wife, and then after she died, the husband (widower) for the mother-in-law's dwelling. What level of proof/assurance do we want to determine that he is entitled to the refund? Do you see the need to consult with County Counsel? PERMIT REQUIREMENTS: Approval for a temporary second dwelling is subject to the following requirements. 1. Occupancy of the mobile home shall be limited to Frieda Randlett, mother. An affidavit attesting to the relationship of the involved parties was submitted with the permit application. 2. No rent is to be charged to the occupant of the mobile home. 3. The temporary mobile must meet the requirements of the Butte County Environmental Health Department for domestic water supply and sewage disposal. The granting of this permit does not remove the requirement of obtaining the appropriate permits from other Divisions, Departments or Districts. 4. The siting of the mobile home shall be exempt from the site requirements of the residential zoning district, except as required by this Section, and the Butte County Code Chapter 28A. 5. The mobile home is declared to be a temporary use on the property, accessory to the primary unit, and shall not be placed on a permanent foundation. Additionally, a temporary mobile home shall not be permitted on a lot or parcel where there is an approved Second Unit. 6. The permit shall be granted for a term of two years. Extensions of the term for the permit, not exceeding one year for each extension, may be granted if the application for the extension is filed, with the Planning Division, within 60 calendar days prior to the date of expiration. 7. The mobile home shall be vacated upon expiration, or revocation, of the Permit and removed within one hundred twenty (120) days after expiration of the Permit. If it is not removed within one hundred twenty (120) days, the County shall remove said mobile home and store it at the owners expense. 8. The Permit may be revoked if any of the terms or conditions of the Permit are violated or if any acts or omissions of the permittee in connection with the use authorized by said Permit constitute a public nuisance. 9.
