Commissioner Lynch said the occupant on #3, Amy Hoar, has passed away and this is a good opportunity to track what happens to the temporary second dwelling. He said people need to understand that there is a need for this type of use, but it should not be abused. BUTTE COUNTY._PLANNING COMISSION MINUTES'- November 17, 1993. Bob Bryson - (Item determined to be categorically exempt from environmental review) Use Permit to allow a mobile home as a temporary second dwelling on property zoned AR -MH -5 (Agricultural Residential - Mobile Home - 5 acre parcels) located approximately 1 1/2 miles south of Foothill Blvd., on the east side of Dunstone Drive, identified as AP 028-190-021, Oroville. VIDEO TAKEN The Commission waived the reading of the Staff Findings. A video of the project site was shown. Commissioner Nelson asked how large the mobile would be? Staff said the applicant is proposing a double wide mobile. Staff briefly explained the "temporary mobile home" section of the Code. Commissioner Lambert asked if this application should be for an agricultural worker? Staff said that agricultural workers are allowed with an affidavit, with the Building Department of Public Works, but can only be considered in agricultural zones (A-5 etc.). Staff said the affidavits do not come to the Commission for review and/or. conditions. Staff said the AR zones are residential, not agricultural. Commissioner Nelson asked if this was a temporary use, or a way of masking a permanent use to allow an employee? Commissioner Lynch said the applicant needs to understand if there is a change in occupancy -of either dwelling, there would have to be an application for a new Use Permit. Commissioner Nelson again asked if this request masked a permanent use? Staff said they did not think so, that there have been instances where the mobiles have been removed after a change of ownership or when someone has passed away.' Staff said there is possibly some abuse of this section of the Code, but for the most part the permits are granted where needed. Commissioner Lynch said there is a possibility of abuse, but there is also a need for this provision in the Code. The hearing was opened to the public. Paul Farris, representing the Bryson, said that Mr. and Mrs. Hix Bryson are in their 70s and need help with their ranch. He said the applicants agree to all of the condition. Commissioner Lynch questioned the fact that the owner, applicant, and property owner are listed as Bob Bryson. Mr. Farris said that Hix and Katherine Bryson are the property owners and live in the existing home. He said Bob Bryson and family will occupy the temporary home. ANALYSIS: The project is a request to place a temporary mobile home as a second dwelling on property located at 319 Dunstone Drive in the Oroville area. The proposed mobile is to be located along the southern property line, approximately 120 feet back form Dunstone Drive. The proposed mobile will not be located near any neighboring homes: This placement should not cause any undue hardship on the neighboring properties. Installation of the mobile home at this location also should not result in any land use conflicts or incompatibility of land uses. The adjoining parcels are currently utilized for pasture land and cattle grazing. The applicant states that the additional mobile will be utilized by his son to assist him in taking care of his ranch. The applicant leases the 650 acre pasture across the street from the project site to graze cattle. The temporary mobile home provisions under section 24-304 of the Butte County Code were adopted to allow families to take care of one other and still maintain independent living quarters and privacy. The application clearly meets the intent of the Temporary Mobile Home ordinance. Temporary Mobile Homes also come under County Code Section 24-47 concerning the issuance of the Use Permit. . Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The code also makes provisions for the County requiring a bond or deposit at the time of application of sufficient size to cover removal expense of the mobile home. This is to ensure that the tax payers at large (via General Fund) are not charged those expenses should the county be forced to remove the mobile 2 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - March 21, 1991 home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed form the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping,decks, awnings, and physical site characteristic. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $2,000.00 for a single and $3,000.00 for a double wide mobile home. These amounts seem reasonable to insure that the mobile home s removed at no cost to the County or the taxpayers. This project is categorically exempt from environmental review nd appears to conform to the requirements of the Butte County Code Section 24-304 regarding the placement of a temporary mobile home.
