Staff said the date of the original application has been included in the new forms and appears at the bottom of the old form. Staff said the issue of temporary mobile homes will be discussed in more detail at the end of the meeting. Commissioner Bergman asked what does temporary mean? Staff indicated that the purpose of the section is to allow care to be provided for someone unable to care for themselves. It is the intent of the section to have the mobile home removed when care is no longer needed. The older permits were not required to bond for removal. If the occupancy changes, the applicant would have to apply for a new Use Permit. Commissioner Nelson said some of the renewals are for daughters of the applicants and he questioned if this was proper? Staff said yes, it can be a relative or close friend, however the permit is supposed to be for a disability or caretaker type provision. Commissioner Bergman said he thinks this provision is developing into something contrary to the Zoning Ordinance. He asked if there was any requirement for a doctor's certification as to the disability? Staff indicated that an affidavit was required indicating that there is a disability. Staff said more details will be discussed later in the agenda under the Miscellaneous item. Chairman Lambert reiterated that the item will be discussed, in detail, later on the agenda. These renewals are the same as the Commission has been approving, and she would hesitate to change the process today. She said she agrees the Commission should furhter discuss the issue. It was moved by Commissioner Bergman, seconded by Chairman Lambert, to have more discussion and action on the consent agenda to be discussed with the miscellaneous item at the end of the meeting. Commissioner Lynch felt that a commitment has been made by the County to allow these Use Permits and to allow for their renewal. He did not feel the Commission could deny these. _____ BUTTE COUNTY PLANNING COMMISSION MINUTES - January 13, 1994 Commissioner Bergman said it is within the power of the County to condition renewals. He said the ones that were not bonded, should be bonded before renewal and the renewal applicant should have to prove the disability. Chairman Lambert said she would- hesitate to deny these renewals. Commissioner Nelson said he did not mind discussing these later. He said one of the problems is that there are similar renewals currently being processed at the Planning Office that will be on the next agenda and any decision on these renewals could have an affect on them too. Commissioner Lynch said the Commission will have to involve the Board of Supervisors to change the Ordinance in order to require bonds and medical certificates. He did not think they should hold up the current renewals. Staff said renewal is a discretionary action. The Ordinance is silent as to requiring medical proof. Staff suggested the Commission consider these renewals on their merits as they have done in the past and noted that according to the way the ordinance is written, renewals are adopted by Use Permit. It does not give the Planning Commission the authority to add conditions without going through the use permit process, but does allow the Commission to approve or deny renewals. Commissioner Bergman withdrew his motion and Chairman Lambert withdrew her second. U 0 n BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - October 8, 1987 Department of Forestry: "None" ANALYSIS: The Squires have proposed to install a 840 sq. ft. mobile on their property to house their son and daughter-in-law. Mrs. Squires is legally blind, and would benefit greatly from having her son and daughter-in-law in close proximity. The "Aunt Minnie" provision (24-304) was adopted to allow families to take care of one and other and still maintain independent living quarters and privacy. The application clearly meets the intent of the temporary mobile home ordinance. Temporary mobile homes also come under County Code Section 24-47.concerning issuance of a Use Permit. Installation of a mobile home at this location should not result in any land use conflicts or incompatibility of land uses. There are currently three houses along Laub Road all of which are located west of the proposed mobile. Northeast and south of the mobile are agricultural land, principally field crops. The mobile is now on-site being served by an electrical cord running out the front door. The family had to move the mobile from its location in Redding and is fully cognizance of the need for County permits. It appears to be located approximately 45 ft. from centerline. Although centerline is difficult to pinpoint on this property, since the road stops west of the mobile home area. The mobile home will be served by a new driveway off of Laub Road, constructed to Department of Public Works standards. The permit can be conditioned to place the mobile no closer than 50 ft. from the centerline. Because of Mrs. Squires disability, and family work arrangements, no one is expected at the hearing. The Planning Commission should not interpret this as lack of interest in the permit. Staff will contact the applicant prior to the hearing regarding the applicant's comments on the conditions of approval. Butte County Code _ _ j Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to ensure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site -2- BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - October 8, 1987 3 for administrative costs and storage costs, it appears that a reasonable deposit would be $1,000 per single -wide and $1,500 for a double -wide mobile home. These amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers. The applicant proposes to place a single -wide mobile home on the property. Recommendations: A. Note that this project is categorically exempt from environmental review; and B. Find that this proposed use of the property complies with Butte County Code Sections 24-47 and 24-304 specifically, the use will not impair the integrity and character of the A-40 zone, not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health,'welfare and safety of the County; and C. In the event the mobile home is not removed within one hundred twenty (120) days pursuant to the terms of the Use Permit, the County shall remove the mobile home and store it at the owner's expense. 6. The applicant to pay'a deposit or post a bond to cover the cost of removal in the amount of $1,000.00. 7. Driveway must conform to County standards. 8. Install new sewage system under permit and inspect -ion from the Health Department. 9. Connect to existing well for domestic water supply. 10.
