Present: Stephen Lucas, Associate Planner, Lynn Richardson, Record Secretary Also Present: Mr. and Mrs. Short, Mr. and Mrs. DeBock ITEMS FOR CONSIDERATION A. Staff recommended approval y Sheryl Short - (Item determined to be categorically exempt from environmental review) Minor Use Permit to allow a second unit on property zoned A -R (Agricultural Residential) located on the south side of Keith Lane, approximately 800 feet west of Garner Lane,. at 4261 Keith Lane, identified as AP 047-300-034, Chico. (SL) (95-196) Mr. and Mrs. Short were present. Mr. Lucas said this project conforms to the A -R zoning and requirements of Butte Code Section 24-280. Laurie DeBock said she is opposed to this permit. She said the mobile home was brought in without permits and faces onto her property from above. She submitted and read an opposing letter from Melissa and Edward Hardesty. She submitted a signed petition from the neighbors opposing this permit because of inadequate leach field, increased stress on the local aquifer, increased density, precedence set for rental units, decreased property values, and inadequate notification of neighboring residents. Mrs. DeBock said the mobile home is an eyesore. David DeBock said the neighborhood is opposed because this can lead to a rental and was placed on the property before obtaining any permits. He said the window of the mobile home is above the fence line. He did not want a 2nd unit next door. He said he wants Mrs. Short to meet septic and water requirements as required for a new dwelling. Mrs. Short said she contacted Planning, Building, and Environmental Health for over a year. She said the County has been to the property and there were no problems with septic clearance or water clearance. She said the second unit will be for her in-laws and is not intended for a rental unit. Mr. Lucas noted a memo from the Health Division stating the property can accommodate this unit. He briefly discussed the difference between a temporary second unit and permanent second unit. He said this application is for a permanent second unit and can be used as a rental. He said this requests meets the Requirements in the County Code. He said staff's recommendation will go to the Planning Commission on consent agenda. He recommended the neighbors attend this meeting to voice their concerns. Mr. DeBock requested the County require a 50 ft. setback from the property line. ■ BUTTE COUNTY PLANNING SERVICES MEETING ■ MINUTES ■ PAGE 1 ■ Mr. Lucas suggested recommending visual screening with landscaping, trees, etc. He told Mr. DeBock that the law requires a minimum 5 ft. setback. Mrs. DeBock said she wants a visual barrier and she wants the mobile home set back further on the property. Mr. Lucas suggested a 30 ft. setback. Mrs. Short was not in favor of, this, she said she has plans for her yard. She said she would have to go home and measure the distance before agreeing to it. Mr. Lucas said he was just trying to find a solution to the conflict before this goes to the Commission. Mrs. DeBock did not think there would be sufficient room within 16 feet to have an awning and trees. Mr. Lucas said he will recommend a condition that the carport be placed on the side of the mobile home and that the applicant plant a visual barrier of trees. Mrs. DeBock said she would still like the mobile home moved further away from the property line. Mr. Lucas said the application meets the requirements for a second dwelling unit and he confirmed the action recommended ighe staff report and requested this.item be set for the next Planning Commission meeting of August 24, 1995 on consent with the addition of the following conditions: 1. Applicant to plant sight obscuring'. landscaping. 2. The garage ;and carport.are to be placed -at the side of the mobile. 3. Require a setback for the mobile home at between 16 and 30 feet with the final determination to be made by Planning staff. The purpose of the setback is for screen ing/visability. (SL) (95-196) Mr. Hogan stated the original application was for a Minor Use Permit to allow a permanent second dwe The Planning Commission directed staff to re -notice the application as a request for a temporary seg dwelling and hold a Planning Services meeting and set conditions for a temporary second dwelling three additional conditions beyond those normally required.l Mrs. Short asked about Condition 10 regarding the sight obscuring trees, do the trees have to be approved by the Planning Division prior to being planted? She said the trees have already been planted. Mr. Hogan said there are.different kinds of,Eucalyptus .trees and it would depend on which kind Mrs. Short planted. He,said:if the type planted does, not meet the screening requirements, she could be required to re -plant another type of tree. He said she could bring in leaves from the trees to allow staff to determine which type they are or a planner could visit the site. He noted that there was no one present in opposition to this permit. Mrs. Short said with the requirement for screening, why do they have to put the carport at the side of the house instead of in the back? Mr. Hogan said this condition was in response to a concern by the neighbor and is a matter of visibility. Mrs. Short said she set the mobile home back 16 feet from the side property line so she could. have the carport at the rear of the mobile. She said with the requirement for screening, she did not understand why she can not have the carport where she wants it? logan explained that placement of the carport was settled on at the Planning Commission, with the ibor present, where the neighbor is not present today, he did not feel it was -appropriate- to remove this ition. Mrs. Short asked what right the neighbors have to dictate conditions? She said four of the five complaints by the neighbors were adopted as. conditions. Mr. Hogan said in approving a Minor Use Permit, one of the findings is compatibility with the neighborhood. Mr. Hogan explained the bond procedure for removal of a temporary mobile home. Mrs. Short asked about what happens if they do not remove the mobile home within the 120 days Mr. Hogan said staff will work with the applicant and if needed extra time can be allotted. II. Notices have been sent to adjacent property owners, and a meeting was held with the Planning Manager. He submitted a letter dated 8-24-95 from 5 neighbors in favor of the project and a letter dated 8-21-95 from 2 neighbors who do not object to the request. Commissioner Seegert asked if the Commission has the option of making this a temporary permit? Mr. Hogan said no, the application is for a permanent second dwelling. He said the Commission can discuss this application, allow the public to speak, and can remove the item from the consent calendar and direct staff to publish and notice this item for a public hearing at the Commission. Commissioner Lambert said she was willing to pull the item from the consent calendar and publish for a public hearing. Commissioner -Seegert asked about the State requirements allowing second dwellings? He asked if they were allowed in all zones? Mr. Hogan said the County has to allow for second dwellings in acceptable zones. He said they are not allowed in the ag. zones. He said they can not disallow State second dwellings, but they can restrict it to particular zones. Chairman Nelson said one of the letters states this dwelling is for the care of elderly parents. He asked if on this basis the Commission can grant a temporary use? Mr. Hogan said the Commission can not change the application. They can take the item off the consent calendar and advertise it for a public hearing. She said if this permit is granted the dwelling could be used as a rental in the future. She said she talked to real estate agents and was told this will bring, down the value of her property. She submitted a letter from her husband. She said this permit would set a precedent if allowed. Sheryl Short, the applicant, said at the Manager's meeting she agreed to lower the mobile home, agreed to plant trees to screen it from the neighbors view, and to move the carport to the side. She said she is not willing to move the mobile home further into the property. She said she has plans for landscaping her back yard. Chairman Nelson asked if she would have a problem making this a temporary use? Ms. Short said she was told by the Planning Office that temporary permits were no longer being issued. Commissioner Lynch said if the applicant received misinformation over the phone and is willing to go to a temporary permit, there should be no extra fees. Mr. Hogan said a temporary mobile home permit is an Administrative Permit issued over the counter and does not come before the Commission. He -said there normally are no E nditions other than those minimums required by the Zoning Ordinance, for furtheback requirements or screening. Commissioner Lynch. said he is hearing that the objection is the unit will be permanent and could become a rental. Mr. Hogan said normally temporary uses do not require conditions that a permanent dwelling would require. Commissioner Lambert said she was in favor of pulling the item and ask that this be held as a public hearing. Ms. DeBock said if this was a temporary use, with a condition for screening, then she would not contest the permit. Mr. Hogan said -the Commission ca an pprove the permit today or pull this item and publish for a public hearing, or they can send it back to the Planning Manager to consider a temporary permit, if Mrs. Short would change her_application.' Ms. Short said she was against the suggested 25' setback. Chairman Nelson asked if Ms. Short would object to this going back to the Planning Manager as a temporary dwelling? Ms. Short said no, she would not object to making it a temporary use. She said the only problem she has is moving it 9 more feet into her back yard. Chairman Nelson said this is one of the problems because of the size of the lot. Commissioner Lynch asked when the application was made? Ms. Short said she talked to staff about it one year ago, and the application was made in April 95. Commissioner Lambert said the, -problems with an over the counter permit is there is no notice, no hearing, no appeal, and no recourse. She said she wants this to go to a public hearing. She said an -Administrative Permit does not give both sides a chance to be heard. It was moved by Commissioner Lambert to pull this item from the consent calendar and direct staff to hold a public hearing. The motion died for lack of a second. Commissioner Lynch said to avoid red tape, send this back to staff for a temporary second dwelling, because staff knows the concerns and it would be the simplest way to handle this. Mr. Hogan said this item could go back to the Planning Manager as a temporary permit application, the Commission could direct staff to notice property owners and hold a hearing with added conditions. DISCUSSION - Ted Crawford with the. Butte County Fire Department to discuss fire safe regulations. Mr. Crawford handed out Fire Safe Regulations 4290. He said he is the one that sees the applications and recommends the conditions.. He said he would like to see all new dwellings as fire safe as they can be. He discussed the 30 ft. clearance regulation and where it is applied. Commissioner Lynch said on a lot 90' x 500', with a 1-5 ratio there would not be a very large building envelope with a 30 ft. clearance requirement. Mr. Crawford said this is true, but he hopes these lots are few in the County. Commissioner Seegert said a quarter acre lot in the Oaks Subdivision could not obtain a 30 ft. setback clearance. He asked if the fire danger was considered the same for a d_. subdivision as it is for a rural parcel in the wildlands? Mr. Crawford said yes, the danger is the same. He said they try to apply the regulations to the subdivision, boundary. Mr. Hogan discussed the General Plan revisions that are in progress. He said they are trying not to plan for land uses that would compromise fire safety. Mr. Crawford said it has been determined that a 30 ft. setback is what is safe. If you keep a 30 ft. setback from your house and it is maintained as a fire safe area, a fire can not burn from the wildlands right up to the side of your house. Commissioner Seegert said the backyard is not usually the problem. He said it is usually the side yards that need the clearance. He discussed putting in hydrants as often as possible. Mr. Hogan discussed spreading the cost of hydrants among the people who will benefit from the hydrants. He said he thinks the General Plan update will allow the County to 0 target areas where hydrants should be required up front. Commissioner Lynch said they need to look at site requirements in the zones. He said they need to be concerned with areas in the foothills that are not served by public water. . Ms. Short said no, she would not object to making it a temporary use. She said the only problem she has is moving it 9 more feet into her back yard. I _ _ -- Chairman Nelson said this is one of the problems because of the size of the lot. Commissioner Lynch asked when the application was made? Ms. Short said she talked to staff about it one year ago, and the application was made in April 95. Commissioner Lambert said the problems with an over the counter permit is there is no notice, no hearing, no appeal, and no recourse. She said she wants this to go to a public hearing. She said an Administrative Permit does not give both sides a chance to be heard. It was moved by Commissioner Lambert to pull this item from the consent calendar and direct staff to hold a public hearing. The motion died for lack of a second. (SL) (95-196) Mr. and Mrs. Short were present. Mr. Lucas said this project conforms to the A -R zoning and requirements of Butte Code Section 24-280. Laurie DeBock said she is opposed to this permit. She said the mobile home was brought in without permits and faces onto her property from above. She submitted and read an opposing letter from Melissa and Edward Hardesty. She submitted a signed petition from the neighbors opposing this permit because of inadequate leach field, increased stress on the local aquifer, increased density, precedence set for rental units, decreased property values, and inadequate notification of neighboring residents. Mrs. DeBock said the mobile home is an eyesore. David DeBock said the neighborhood is opposed because this can lead to a rental and was placed on the property before obtaining any permits. He said the window of the mobile home is above the fence line. He did not want a 2nd unit next door. He said he wants Mrs. Short to'meet septic and water requirements as required for a new dwelling. Mrs. Short said she contacted Planning, Building, and Environmental Health for over a year. She said the County has been to the property and there were no,problems with septic clearance or water clearance. She said the second unit will be for her in-laws and is not intended for a rental unit. Mr. Lucas noted a memo from the Health Division stating the property can accommodate this unit. He briefly discussed the difference between a temporary second unit and permanent second unit. He said this application is for a permanent second unit and can be used as a rental. He said this requests meets the Requirements in the County. Code. He said staff's recommendation will go to the Planning Commission on consent agenda. He recommended the neighbors attend this meeting to voice their concerns. Mrs. Short was not in favor of this, she said she has plans for her yard. She said she would have to go home and measure the distance before agreeing to it. Mr. Lucas said he was just trying to find a solution to the conflict before this goes to the Commission. Mrs. DeBock did not think there would be sufficient room within .16_ feet to have an awning and trees. Mr. Lucas said he will recommend a condition that the carport be placed on the side of the mobile home and that the applicant plant a visual barrier of trees. Mrs. DeBock said she would still like the mobile home moved further away from the property line. Mr. Lucas said the application meets the requirements for a second dwelling unit and he confirmed the action recommended in the staff report and requested this item be set for the next Planning Commission meeting of August 24, 1995 on consent with the addition of the following conditions: 1. Applicant to plant sight obscuring landscaping. 2. ' The garage and carport are to be placed at the side of the mobile. 3. Require a setback for the mobile home at between 16 and 30 feet with the final determination to be made by Planning staff. The purpose of the setback is for screening/visability. II. There was concern expressed both verbally and by petition, that the neighbors of the applicant feel that the proposed second unit would create a visual impact to their properties. If the Commission feels that no further hearing is warranted, then approval of the application with the suggested conditions is appropriate. DISCUSSION: As the Commission may recall when discussion of changes to the second unit ordinance occurred late last year, the main point that was raised by staff and County Counsel was the pre-emption of local control by the state. In brief, the state law indicates that the jurisdiction must provide locations where second units would be allowed. The law provides for requiring a permit process and strongly suggests, if not require, approval of all permits. The surrounding properties are large lot residential units with considerable space between houses. The neighbors felt that allowing a second unit to be located 16 ft. from the rear property line would invade their privacy and lower property values. After much discussion at the Planning Manager meeting, tentative agreement was reached that the proposed use would be acceptable if the following conditions were added to the Permit. Applicant shall plant and maintain sight obscuring landscaping along the rear property line that will reach a height of 20 ft. within a period of two years of issuance of permit. The type of landscaping shall be approved by the Planning Division and be planted within 30 days of issuance of the permit. 2. The setback from the rear property line for all structures shall be 25 feet. 3. The proposed carport shall be constructed to the side of the second unit and not be within the 25 ft. setback. She is a very pleasant 57 -year-old housewife with a chief complaint of pain in the 1¢ow back and down the left lower extremity with numbness into the sole of her foot that she has had over the ,past eight or nine months. Her leg hurts more than her back. Thank you for sending along a lumbar myelogram, with CT to follow, that is consistent with a ruptured disk on the left at LS -S1 which is rather large. There is decreased disk space at L5-S1. She has no difficulty with bladder control. The right leg is okay. Sjnce her myelogram, the pain has been slightly improved. She has a lot of trouble getting around and can do none of her housework, and often has difficulty sitting for long enough to urinate. PAST MEDICAL HISTORY: She has had a tonsillectomy, gallbladder operation, incisional hernia repair, and hysterectomy for benign disease. She says she tends to get pneumonia after general anesthesia. She has hypertension, gout,and arthritis. Medications include Xanax, Kaon, Meclomen, Allopurinal, and Aldoril, also Robaxin and Vicodin. She has no drug allergies, but codeine makes her sick to her stomach. PHYSICAL EXAMINATION: She is obese. The low back has no deformity or tenderness to light percussion. Motor examination shows no weakness in hip flexors, quadriceps, ankle dorsiflexors, or EHL, but there is weakness in the left ankle plantar flexors in that she cannot get her heel up off the floor in toe stand testing. This test is normal on the right side. Deep tendon reflexes are 2+ at both knees and the right ankle, 1+ left ankle. Plantar response is flexor bilaterally. IMPRESSION: Left S1 radiculopathy, possibly with some also on the right side. I recommend that we do an operation to remove the mass effect on her nerves, probably a ruptured disk. There was concern expressed both verbally and by petition, that the neighbors of the applicant feel that the proposed second unit would create a visual. impact to their properties. If the Commission feels that no further hearing is warranted, then approval of the application with the suggested conditions is appropriate. DISCUSSION: As the Commission may recall when discussion of changes to the second unit ordinance occurred late last year, the main point that was raised by staff and County Counsel was the pre-emption of local control by the state. In brief, the state law indicates that the jurisdiction must provide locations where second units would be allowed. The law provides for requiring a permit process and strongly suggests, if not require, approval of all permits. The surrounding properties are large lot residential units with considerable space between houses. • The neighbors felt that allowing a second unit to be located 16 ft. from the rear property line would invade their privacy and lower property values. After much discussion at the Planning Manager meeting, tentative agreement was reached that the proposed use would be acceptable if the following conditions were added to the Permit. 1. Applicant shall plant and maintain sight obscuring landscaping along the rear property line that will reach a height of 20 ft. within a period of two years of issuance of permit. The type of landscaping shall be approved by the Planning Division and be planted within 30 days of issuance of the permit. 2. We object to the granting of this permit with our objections based on the following points: 1.) The building which is the subject of the permit is an eyesore to those who live in the wdsiting residences on Michelle Court. It is placed cirectly next to the fence which faces all of Michelle Court's homes, making it obtrusively visible to residences on that street. 2.) If allowed to remain at the present site, such a regulation will allow, and encourage, other residences of Keith Lane to move mobile homes into similar positions on their properties, thereby changing the neighborhood to one equivalent to that of a small mobile home park. 3.) The new residence would improperly impose on the existing septic conditions, even with the required, proposed changes. Given that this is a newly:Naced residence, it should be required to meet those stands set for nm housing, i.e. several hundred feet of leech line per residence. Otherwise it would have a negative impact on the environment, which is an event that is prevented with the current new - housing septic requirements. 4.) When splitting the lot equal to 2.5 acres at 4262/4261 Michelle Ct., the ownerlbuilder was required to spend thousands of dollars to meet the soil engineering and water monitoring standards, as imposed by Butte County, so that that a second residence could be built on the second half of the property. All of the strict requirements were met to place a new residence on a 1.2 acre lot, and yet the building which is the subject of the proposed permit does not need to meet these standards to co-e)ast with another house on a similarly- sized lot. Please weigh the above objections heavily when you consider granting Vol a Minor Use Permit to Sheryl Short for the above-mentioned property. While appearing to be a simple request, this proposed building would . have a severly negative impact on the neighborhood in the ways. that are outlined above. There was concern expressed both verbally and by petition, that the neighbors of the applicant feel that the proposed second unit would create a visual impact to their properties. If the Commission feels that no further hearing is warranted, then approval of the application with the suggested conditions is appropriate. DISCUSSION: As the Commission may recall when discussion of changes to the second unit ordinance occurred late last year, the main point that was raised by staff and County Counsel was the pre-emption of local. control by the state. In brief, the state law indicates that the jurisdiction must provide locations where second units would be allowed. The law provides for requiring a permit process and strongly suggests, if not require, approval of all permits. The surrounding properties are large lot residential units with considerable space between houses. The neighbors felt that allowing a second unit to be located .16 ft. from the rear property line would invade their privacy and lower property values. After much discussion at the Planning Manager meeting, tentativeagreement was reached that the proposed use would be acceptable if the following conditions were added to the Permit. 1. Applicant shall plant and maintain sight obscuring landscaping along the rear property line that will reach a height of 20 ft. within a period of two years of issuance of permit. The type of landscaping shall be approved by the Planning Division and be planted within 30 days of issuance of the permit. 2. The setback from the rear property line for all structures shall be 25 feet. 3. The proposed carport shall be constructed to the side of the second unit and not be within the 25 ft. setback. We object to the granting of this permit with our objections based on the following points: 1.) The building which is the subject of the permit is an eyesore to those who live in the exisiting residences on Michelle Court. It is placed directly next to the fence which faces all of Michelle Court's homes, making it obtrusively visible to residences on that street. 2.) If allowed to remain at the present site, such a regulation will allow, and encourage, other residences of Keith Lane to move mobile homes into similar positions on their properties, thereby changing the neighborhood to one equivalent to that of a small mobile home park. 3.) The new residence would improperly impose on the existing septic conditions, even with the required, proposed changes. Given that this is a newly -placed residence, it should be required to meet those standards set for nM housing, i.e. several hundred feet of leech line per residence. Otherwise it would have a negative impact on the environment, which is an event that is prevented with the current new - housing septic requirements. 4.) When splitting the lot equal to 2.5 acres at 4262/4261 Michelle Ct., the owneribuilder was required to spend thousand of dollars to meet the soil engineering and water monitoring standards, as imposed by Butte County, so that that a second residence could be built on the second half of the property. Al of the strict requirements were met to place a new residence on a 1.2 acre lot, and yet the building which is the subject of the proposed permit does not need to meet these standard to co -exist with another house on a similarly- sized lot. District representatives have determined that the proposed project will negatively impact Chico Unified School District and, therefore, warrants further environmental analysis. The District recognizes that Senate Bill 1287 (SB 1287) may adversely impact the County's authority to impose the following requested mitigation measures by rescinding court precedents established via the Mira, Hart and Murrieta cases; but that issue is yet to be resolved. Based on this information, the District requests that the following comments be included in the project approval record and requested mitigations imposed to the extent allowed by law. SCHOOL FACILITIES FOR NEW STUDENTS GENERATED BY THE PROPOSED DEVELOPMENT Setting The Short application proposes 1 additional residential unit. Applying the District's .43 student yield factor, this development will generate approximately one school age child. Utilizing current District actual student enrollment data and projected student enrollment data from already approved new residential development, each elementary, junior high and senior high school in the District is filled to capaCounty. To accommodate a 50+ percent increase in student enrollment in recent years, the District (1) reutilized existing school facilities, (2) utilized interim elementary school facilities, (3) placed relocatable classrooms on existing elementary school campuses, (4) instituted multi -track year-round education in three existing elementary schools; (5) occupied one new urban elementary school on a year-round schedule, (6) occupied one new elementary school on a traditional school schedule, (7). is in the process of constructing a third elementary school, (8) has placed interim facilities on the secondary campuses pending the availability of new school facilities, (9) acquired a site and has planned to build a new junior high/middle school and (10) has planned to expand one existing senior high school. The State-wide need to construct new schools far exceeds available pro rata State funding; therefore, needed new Chico Unified School District school facilities have not been provided in a timely manner. Local Chico Unified School District revenues generated from school impact fees, coupled with the proceeds from the general obligation bonds approved by the voters in April 1988, will meet the student housing needs generated by local birth rates and previously approved residential developments but will not meet the student housing needs generated by new development. The District anticipates housing increasing numbers of students in interim facilities until funding becomes available to construct new schools. Impact of Proposed Development on Chico Unified School District Schools Since District elementary, junior and senior high schools are filled to capaCounty, it is evident that students generated from Short Minor use permit application cannot be served by existing facilities. In addition, there is currently no funding mechanism that will enable the District to provide facilities for these students. Based on the District's .43 student yield factor per average (1,532 square feet) household, the 1 residential unit proposed in Short Minor use permit application will yield approximately one student that must be housed in District schools. The District projects that larger residential units will yield more than .43 students per household and smaller residential units will yield less than .43 students per household. To adjust for the higher student yield factor in larger than average households and the lower student yield factor in smaller than average households, the District utilizes a mitigation cost based on square footage of habitable space in each household. This project must be consistent with the County General Plan and the impact on the District must be recognized and addressed in the project approval process. Mitigation of Impact on Chico Un'if'ied School District Schools The District is opposed to County approval of the proposed Short Minor use permit application unless the project fully mitigates its impact on the District. Acceptable mitigation measures include: • cash or in lieu equivalent (land or school facilities), approved by the District, which is equal to the full mitigation cost as described below; • imposition of a controlled phasing of single or multi -family residential development to coincide with provision of adequate school facilities; or • denial of the project. The 1993/94 per habitable space square foot cost to fully mitigate the impact of each residential unit is $4.45 per square foot. This amount will be adjusted as needed to reflect the impact of inflation, school facilities needs, regulatory changes and other cost influencing factors. The full mitigation cost of $4.45 per square foot of new residential development will include school impact fees (currently $1.72 per square foot). The school impact fee will be supplemented with an appropriate amount of cash or in lieu equivalent (land or school facilities) approved by the District. The combination of school impact fees and cash or in lieu equivalent must fully mitigate the impact of the development on District schools. The following calculation is provided to allow one who is knowledgeable of the habitable space of each residential unit in the proposed development to make her/his own calculations: CALCULATION Total habitable space in residential unit(s) times the current cost for full mitigation in effect when paid ($4.45 per square foot in 1993/94) equals total mitigation. For example: 1 unit @ 1,200 square feet/unit x $4.45 = $5,340; or 1 unit @ 1,532 square feet/unit x $4.45 = $6,817; or 1 unit @ 1,800 square feet/unit x $4.45 = $8,010.
