(LPW) (Continued open from March 25, 1993) The hearing was opened to the public. Mrs. Wagner submitted a letter from her neighbors, Robert and Nancy O'Neill, giving their permission to use their access road in order to install and remove a mobile home with the provision that if their property sells before the removal of the mobile home, access to remove it will be written into the deed. The hearing was closed. Staff said the letter would not follow with the title should the property change hands. Staff said the Commission needs to add a condition that this easement is recorded in the deed. Staff said if this property ever divided, the concern over access would be addressed at the time of the parcel map. Chairman Lynch discussed the problems with splitting this property in the future. It was moved by Chairman Lynch, seconded by Sessions, and unanimously carried for approval as follows: A. Find that this project is Categorically Exempt from environmental review; and B. Find that this proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties ,or detrimental to the health and general welfare of the persons ^residing or working in the neighborhood or to the general health, welfare, and safety'of the -County because it complies with the provisions of Code Section 24-304 and specific circumstances are mitigated by the conditions that follow; and C. The mobile home is to be a temporary use on the property pursuant to the requirements of Section 24-304 of the Butte County Code. 5. The Use Permit shall expire two years from the date of issuance of the Use Permit. Upon application, the Planning Commission may grant an extension of the Use Permit not exceeding one year. 6. In the event that the applicant who is residing within the mobile home or the conventional residence, for any reason, moves to another location or is deceased, then in that event, the Use Permit granted herein shall automatically expire and the mobile home shall be removed within one hundred twenty (120) days. In the event the mobile home is not removed within one hundred twenty (120) days pursuant to the terms of the Use Permit, the County shall remove the mobile home and store it at the owner's expense. 7. The applicant is to pay a deposit or post a bond to cover the cost of removal in the amount of $1,500.00 for a single -wide mobile or $2,000 for a double -wide mobile. 8. Meet the requirements of the Building Division of the Butte County Department of Public Works. 9. Have a recorded easement right-of-way a minimum of 15 ft. wide for ingress and exit of the mobile home. 10. Minor changes may be approved administratively by the Director of Development Services upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 11. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Chairman Lynch asked how much access was required by the Fire Department? (LPW) The .Commission waived the reading of the- Staff Findings. A video of the site was shown. Commissioner Nelson asked if the home was on a flag lot? Staff said yes, that the home is under construction. Commissioner Lambert questioned the extra leachfield area on a parcel of less than 1 acre. Staff said this is not a problem. Staff said each of the adjacent parcels have homes on them. Commissioner Sessions questioned the requirements for a 10 ft. driveway? Staff said that materials in the yard will have to be removed to make room for an access drive. Commissioner Lambert asked what the side yard setback requirement was in this zone and if this would affect the driveway area? Staff said the setback is 10 ft. Staff said the setback only affects permanent structures and not the driveway. The hearing was opened to the public. Chairman Lynch said it was not clear on the plot plan submitted regarding the driveway. Mrs. Wagner said the mobile home will be moved onto the property across the neighbors property. She said access will be across the neighbors property and is not a problem. She said she will park her vehicle near the primary residence. Commissioner Lambert asked if the access is from adjacent property, how would the mobile home be removed when the time comes? y BUTTE COUNTY -PLANNING ,COMMISSION MINUTES.-; March 25, 1993 0 Mrs. Wagner said it would be removed the way it was installed. Staff said access would have to be provided if this was for a permanent dwelling. Staff said there might be problems if the County had to remove the mobile. Chairman Lynch said the plot plan shows 24 feet between the primary dwelling and the side property line. Mrs. Wagner said there is a shed within the 24 feet that is going to be removed. Staff said this meeting could be continued to find out the exact footage between the primary dwelling and the property line. Chairman Lynch said he was concerned with using a neighbors property for access because the property could change hands. He said the applicant needs to provide access in case the mobile needs to be removed. He said the applicant has two options, to come back with a plot plan that shows access to the temporary mobile home site for egress or a legal document showing access from the neighbors property. Commissioner Sessions said access is necessary for fire and emergency vehicle access. He questioned whether 10, feet as listed in Condition 9, was sufficient. Chairman Lynch said they would need at least 15 feet to get a mobile out. Commissioner Lambert felt the access should be on the applicant's parcel. She said eventually this could become a permanent dwelling. The hearing was closed. Commissioner Nelson said the Commission needs the access problem straightened out before acting on this project. Staff said if the access is received from the neighbors, the applicant would need an off- site specific purpose easement. The hearing was re -opened. It was moved by Commissioner Lambert, seconded by Commissioner Nelson, and unanimously carried to continue this hearing to April 8, 1993 at 9:00 a.m. - Staff said the applicant will be sent a detailed letter to this effect. ANALYSIS: This project is a request to allow the placement of a mobile home as a temporary second dwelling on property located at 2034 Vista Lane, Durham area. The proposed mobile will bei located to the rear of the property. The proposed mobile will not be placed near any neighboring; dwellings. The proposed location will not cause any hardship on the adjacent properties or result in any land use conflicts. The adjacent parcels are iether residential or planted in orchards. The temporary mobile will be used to house the parents of the applicant. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double - wide mobile home. These amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers. The applicant proposes to place a double wide mobile home on the property. RECOMMENDATIONS: A. Find that this project is Categorically Exempt from environmental review; and B. Find that this proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare, and safety of the County because ; and C. The mobile home is to be a temporary use on the property pursuant to the requirements of Section 24-304 of the Butte County Code. 5. The Use Permit shall expire two years from the date of issuance of the Use Permit. Upon application, the Planning Commission may grant an extension of the Use Permit not exceeding one year. 6. In the event that the applicant who is. residing within the mobile home or the conventional residence, for any .reason, moves to another location or is deceased, then in that event, the Use Permit granted herein shall automatically expire and 1 a the mobile home shall be removed within one hundred twenty (120) days. In the event the mobile home is not removed within one hundred twenty (120) days pursuant to the terms of the Use Permit, the County shall remove the mobile home and store it at the owner's expense. 7. The applicant is to pay a deposit or post a bond to cover the cost of removal in the amount of $1,500 for a single -wide mobile or $2,000.00 for a double -wide mobile. 8. Meet the requirements of the Building Division of the Butte County Department of Public Works. 9. Have a recorded easement right-of-way a minimum of 15 ft. wide for ingress and exit of the mobile home. 10. Minor changes may be approved administratively by the Director of Development Services upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department of Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 11. Applicant must also comply with all other applicable State and local - statutes, ordinances, and regulations. Should you desire to appeal any of the conditions imposed by the Planning Commission, you must do so in writing with the appeal fee of $516.00, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville, California, prior to 5:00 p.m., Friday, April 16, 1993. If you do not appeal and if there are no other appeal within the 8 -day appeal period, your use permit will be issued after April 16, 1993. Recently enacted legislation (AB 3158, Chapter 1706, Statutes of 1990, effective January 1, 1991) requires that the Department of Fish and Game impose and collect filing fees as specified to defray the cost of managing and protecting fish and wildlife trust resources. These filing fees are collected during the environmental review process and are to be paid at the time the County files a "Notice of Exemption" with the County Clerk pursuant to Section 21152 of the Public Resources Code. To increase administrative efficiency, the statute delegated the collection of filing fees to the County Clerk and provided the County authority to collect a $25.00 documentary handling fee. COMMENTS RECEIVED: Butte County Public Works: "None" Butte County Environmental Health: 1) Meet Environmental Health requirements for issuance of a permit to install a sewage disposal system to serve the proposed mobile home. Install the 11 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - February 1, 1993 sewage disposal system as per permit requirements." Butte County Fire Dept./CDF: "Must maintain a minimum of 10 foot wide all-weather driveway to second dwelling." ANALYSIS: This project is a request to allow the placement of a mobile home as a temporary second dwelling on property located at 2034 Vista Lane, Durham area. The proposed mobile will be located to the rear of the property. The proposed mobile will not be placed near any neighboring dwellings. The proposed location will not cause any hardship on the adjacent properties or result in any land use conflicts. The adjacent parcels are iether residential or planted in orchards. The temporary mobile will be used to house the parents of the applicant. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double - wide mobile home. These amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers. The applicant proposes to place a double wide mobile home on the property. RECOMMENDATIONS: A. Find that this project is Categorically Exempt from environmental review; and B. Find that this proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the, general health, welfare, and safety of the County because ; and C. Approve the Use Permit to allow a temporary mobile home as a second dwelling on AP 2 0 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS February 1, 1993 • #040-170-102 (Francis L. Wagner) subject to the following conditions: 1. Occupancy of the mobile home is limited to Mr and Mrs Raymond J. Wagner. 2. No rent is to be charged to the occupant of the mobile home. 3. Meet the requirements of the Butte County Environmental Health Department for domestic water supply and sewage disposal. 4. The mobile home is to be a temporary use ,on the property pursuant to the requirements of Section 24-304 of the Butte County Code. 5. The Use Permit shall expire two years from the date of issuance of the Use Permit. Upon application, the Planning Commission may grant an extension of the Use Permit not exceeding one year. 6. In the event that the applicant who is residing within the mobile home or the conventional residence, for any reason, moves to another location or is deceased, then in that event, the Use Permit granted herein shall automatically expire and the mobile home shall be removed within one hundred twenty (120) days. In the event the mobile home is not removed within one hundred twenty (120) days pursuant to the terms of the Use Permit, the County shall remove the mobile home and store it at the owner's expense. 7. The applicant is. to pay a. deposit or post a bond to cover the cost of removal in the amount of $1,500 for a single -wide mobile or $2,000.00 for a double -wide mobile. 8. Meet the requirements of the Building Division of the Butte County Department of Public Works. 9. Applicant shall maintain a minimum 10' wide driveway. access to the mobile home. 10. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations.
