Butte County Code Section 24-303 (the Aunt Minnie provision) was adopted to allow families to take care of one another and still maintain independent living quarters and privacy. The application clearly meets the intent of the temporary mobile home ordinance. Temporary mobile homes also come under County Code Section 24-47 concerning issuance of a Use permit. Installation of a mobile home at this location should not. result in any land use conflicts, or incompatibility of land uses. The mobile home will be located at the rear of the site, behind the existing residence, and will satisfy all setback requirements. When reviewing temporary Use Permit applications, staff also considers future uses of the property. This parcel is approximately 0.67 acres in size. Under the current General Plan designation of Orchard and Field Crops and the zoning designation of A-5 there is no possibility of further subdivision of the property. The proposed mobile home appears to comply with the seven conditional requirements listed in Section 24-304. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to ensure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course', if the applicant removes this mobile home voluntarily., then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double -wide mobile home. I am confused. First off you say my permit was renewed on 2/25/05 for a year, but expired on 10/23/05. That is not a year. Secondly, when I did not receive a bill for the upcoming year, I called and was told there were no longer Aunt Minnie permits, and that I didn't need it. I am not happy that due to your offices lack of knowledge and the inability to get a bill out, I am now required to pay $155.00. If this is true that the code is still in effect I would like a copy of it please. Also, if it is in effect then I want to know about people renting out their seconde dwelling. The people across from us at 1960 and 1962 Reed lane are also supposedly on an Aunt Minnie. My understanding was that the owner of the property had to live on the property and that the second dwelling had to be under so many square feet or a mobile home and that neither residences could be rented out. If this is correct and the Aunty Minnies are still active then those people are in violation. The owner does not live there, their son does and they rent out the main residence. If I have to abide by these codes, then so shall everyone else. Both our dwellings are mobiles and we are here to aid in the care of my now 71 year old father who is confined to a wheelchair and lives alone. If they are not required to have an Aunt Minnie then we shouldn't be either. Please advise me of this and get me a copy of the code. I would also like an explanation as to why I have not been billed in the past if I truly owed. this. There is also another house down around the corner who recently built a huge, what appears to be a garage with living quarters in it. How do they get away with that?? As they say, 'Good things come to those who wait'... after reviewing the information from our research, since your temporary mobile home was converted to a 2nd dwelling unit in 2006 (by putting the mobile on a permanent foundation). Therefore, no additional 'Aunt Minnie' fees should be charged to you after that period of time. Therefore, your fee owed is $0. As for your bond that was filed as required by our code, it appears that it may have been a rider on your homeowners insurance with State Farm. You may want to check with them and make sure that you are no longer paying for this. Please confirm your receipt of this email. Also, please keep this email for your records. In this letter it states that we have not paid any renewal fees for the last 5 years resulting in a bill of $299.30. In February of 2005 1 received a letter from your agency regarding this same situation. I then emailed a T. Upton in your department regarding the fact that we had been told that we no longer were required to have this permit. She responded that she was checking into it and would get back to me in the next week. That never happened. I emailed her again and she stated she had been on vacation and was looking into it, and that I should wait to hear from her. I never heard from her again. I also included in my email, that our neighbors across the street at 1962 Reed Lane, were also supposedly on a second dwelling permit and that they were renting out the original home and that their son was living in the second dwelling. She was supposed to let me know the outcome of this, as I had stated to her that we were doing the correct thing and living here to take care of my disabled/elderly father and they were not. The renting of that home continued until approximately 2- 3 months ago, and now the primary home is vacant. I never heard anything more, so I assumed all was taken care of. Guess it was just that she wasn't doing herjob. Once again) am requesting to see the code that states that this is still in effect. I am also requesting a a reduction or waiver in the 3/2/2010 Page 3 of 4 P. past due fees. I understand your statement of "Due to our recent budget situations", but perhaps you can understand mine also. Due to my recent budget situations, (i.e. my husband having a pay cut and reductions of my hours at work), receiving a bill of $299.30 and then another $87.00 due in October is not possible. As stated above, I tried to resolve this problem several times to no avail. I also asked that the problem at 1962 Reed Lane, be resolved, again to no avail. I am trying to save the County/State money by living here and taking care of my destitute father. If it weren't for me, he would have to be placed in a rest home, and that would be paid for by Medi -Cal as he has no money. Once he passes, his mobile will be destroyed or removed and we will not do the wrong thing, like renting it out or something like our neighbors. I also have a question regarding the bond that you are asking for. I am assuming that was set up by my Mom, who has since passed away (who we also took care of at home), and my Father has no recollection of where the documents would be. It seems to me that you should already have a copy of that in the file. I have contacted the agency that I believe it was drawn through and they are looking into it, but without more information, they are kind of stumped. Any help that you can be in this matter is greatly appreciated. Let's see if we can all come to some sort of realistic settlement here There is no way we can pay $299.30 in one sitting, unless you would like me not to feed my family. We are all suffering in this wonderful economy, as I am sure you are well aware, and just getting through they daily living is taxing at times, then you get hit with something like this and it creates a devastating effect on a family. (the Aunt Minnie provision) was adopted to allow families to take care of one another and still maintain independent living quarters and privacy. The application clearly meets the intent of the temporary mobile home ordinance. Temporary mobile homes also come under County Code Section 24-47 concerning issuance of a Use permit. Installation of a mobile home at this location should not result in any land use conflicts, or incompatibility of land uses. The mobile home will be located at.the rear of the site, behind the existing residence, and will satisfy all setback requirements. When reviewing temporary Use Permit applications, staff also considers future uses of the property. This parcel is approximately 0.6.7 acres in size. Under the current General Plan designation of Orchard and Field Crops and the zoning designation of A-5 there is no possibility of further subdivision of the property. The proposed mobile home appears to comply with the seven conditional requirements listed in Section 24-304. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiringa bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home.. This is to ensure that the taxpayers at.large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the' bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would-be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double -wide mobile home. These amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers. The applicant proposes to place a double -wide mobile home on the property. 2 ` 0 BUTTE COUNTY PLANNING COMMISSION STAFF FINDING May 10, 1989 Recommendations: A. Note that this project is categorically exempt from environmental review; and B.
