With this map the only difference would be that the parcels have been mapped. County review would be required for any other divisions except by gift deed, Mr. Hironimus said that parcels would have to be at least 40 acres. There was a discussion of gift deeds and multiple gift deeds. Mr. Schohr wondered if there) vobuld be any impacts on the environment. due to changes that might. come about because of creation of these parcels. Mr. Schohr felt that an ESR should be required. Ernest match, a neighbor of this property, and long-time resident, owner of AP 22-05-029, in Sec. 34, T18N, RIB, and adjacent to AP 22-05-50 noted that the taxes which Butte County Will receivo from the property will dependon how the property is classified--as an ecological reserve or a. wildlife area. Mr. Hatch talked aboutthewater agreementsthat have been made that concern this area. The parcels under discussion are included in those agreements. 14r. Hatch said that the Trust for Public Lands works for public access to lands. Mri Batch: does not favor that improved public access; Then' there is `the subject of mineral and gas and oil rights and setting up oil derricks in bird nesting areas, Mr. Hatch recommended that an EIR be, required. LaurenWard, representing the applicant, explained that the property has been owned for several: generations by the same family and used for rice farming and wild life. The Federal Land Bank obtained the property and the State of California wished to buy a portion, but the Federal. Land Bank would not sell off a piece. At that point the Trust for Public Land became involved, and resold a portion of lams to the State of California with an option to buy, additional acreage. The land will be managed as a wild, life refuge like Gray Lodge. The public will have access from the Gridley Highway. The Trust for Public Land intends to resell the land for farming and duck hunting purposes. The land south of the Cherokee canal is in the Biggs West Gridley Irrigation District and the land to the north, side will be annexed to the Richvale Irrigation District. Tim Kelleher, an attorney representing Trust for Public Lands, said that there were separate parcels to start with which were combined as part of the transaction between the Schohr family and the Federal. Land,Bank. Now theintent is to make them separate'parcels again ,so they can be sold and be back in the ownership of farmers. BUTTE COUNTY ADVISORY AGENCY MINUTES PAGE 14 OCTOBER 31, 1988 It was noted that a parcel map .will.: make it clear where the exact boundaries of these parcels are and there will be no question as to their legality. It was agreed by the.Adv:isory Agency that action could be taken today and that the project meets county requirements. It was agreed that there are mitigation measures to cover the known potential impacts on the environment, Mr, Reid stated; having reviewed the environmental review checklist and the Planning Director's Report of Oct. 28, 1988 1 will make a motion to adopt a negative declaration with environmental mitigations for the Trust for Public Land tentative parcel map to create 3 parcels on AP 21-01=-8 and, 21-01-9 and 22- 05-21, 50 and 52 finding that the project could 'have an effect on the environment but will not have a significant effect in this case provided the required mitigation measures are complied with. Those mitigation measures are items 1,, 2 and 3 as listed within the Planning Director's Report of Oct, 28,, 1988: The motion is made finding that the project is in conformance with the Butte County General'Plan and Butte County Zoning.
