If applicant is not the owner, written authorization by the owner or other proof of j agendy must be submitted in order for the applicant to legally sign the application. Application shall be considered void if not signed by the owner or legal agent. 2. All items on application shall be filled in as completely as possible. If an item is not applicable, please indicate by the term "N/A". 3. It is important that the applicant supply an accurate .description of the location of the proposed project, including the following: a. Assessor's parcel number(s) (from the tax bills or Assessor's maps). b. Street addresses (if available). C. DistanCes and directions to named streets, bodies of water or railroads. 4. Twenty(20) copies ofa detailed plotplanofadequate scale to dearly show proposed buildings and improvements shall accompany and be made part of the "Application for Administrative Use Permit'. The "Application for Administrative Permit" is subject to review by County Staff and approval by the Planning Director. Any special conditions of approval shall be made a part of the approved "Administrative Permit" and shall be binding on the applicant. The procedures for County action on Administrative permit applications are stated in Chapter 24 of the Butte County Code. 6. In approving an Administrative Permit, the Planning Director may include such conditions as are deemed reasonable and necessary under the circumstances to preserve the integrity and character of the zone and to secure the general purposes of the Butte County General Plan and Chapter 24, of the Butte County Code. In general, said conditions will be listed as standards in Chapter 24 for each use. In unique situations additional conditions may be added so long as they are reasonably related to the use for which the permit is requested. 7. ALBERT AND SHIRLEY JOHNSON, ADMINISTRATIVE USE PERMIT, AP 042-050-073, request to allow a senior citizen dwelling unit located on the west side of Nord Avenue approx. 2000 ft. north of Henshaw Avenue in the Chico area. There was no one present for this item. There were no problems with this application. It was moved by Mr. Sanders, seconded by Mr. Erickson and carried unanimously to recommend approval of the Administrative Use Permit for a senior citizen dwelling unit for Albert and Shirly Johnson on AP 042-050-073, subject to the findings and conditions listed in the Agenda Report dated January 25, 1995. Section 1: Environmental Findings. A. Find that this application for an Administrative Use Permit to allow a Senior Citizens Dwelling Unit is Categorically Exempt under CEOA, and; Section 2: Zoning Ordinance Findings. A. The proposed use of the property will not significantly impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with or injurious to surrounding property or detrimental to the health, safety, or welfare of the persons residing or working in the neighborhood, or the general health, safety and welfare of the County; and B. Find that this application meets the requirements of Section 24-202 of the Butte County Code with the following conditions. Section 3: Action. A. Subject to the findings indicated 'in Section 1 and 2. of this report, approve the Administrative Use Permit for Albert & Shirley Johnson on APN 042-050-073, subject to the following conditions of approval. B. Conditions of Approval: The "living area" meaning the interior habitable floor space area of a dwelling ,unit including basements and attics, but not including a garage or any accessory structure, shall not exceed . 1,200 square feet. 2. The senior citizen dwelling unit is intended for the sole occupancy of one (1) adult 62 years of age or over or two (2) adult persons, one of whom is,62 years of age or over. An affidavit of compliance with the age requirements'of this section shall be recorded in the office of the Recorder prior to issuance of building permits. Said affidavit shall include the legal description of the lot or parcel and shall constitute a covenant running with the land, binding upon the original owners and their heirs, successors and assigns, limiting the occupancy of the senior citizen dwelling unit to the conditions described in this section. 3. The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel containing the unit is created in compliance with the existing zoning and subdivision ordinances and the resulting density is in conformance with the General Plan. ■ Butte County Development Review Committee Minutes 0 February 13, 1995 - 1 ■ 1_ . 4. Two off-street parking spaces shall be provided for the senior citizen dwelling unit in addition to the parking spaces required for the primary. dwelling unit. 5. Adequate sewer and water facilities shall be provided subject to the approval of Environmental Health Department. 6. All site development standards as required by the zoning district in which the unit is located shall be met. 7. The senior citizen dwelling unit shall be a conventionally constructed building or a mobile home that complies with the National Manufactured Housing Construction and Safety Standards Act of 1974, except that in the "A", "FR", and "TM" series of zones a mobile home, as defined in Section 24-21.28, may be used. Travel Trailers and recreational vehicles shall not be allowed as a senior citizen dwelling unit. 8. The Butte County Fire Department requires that the applicant provide an all weather access for a 40,000 pound fire apparatus to all structures. All new structures must meet the Fire Safe Regulations of Butte County and PRC 4290. 9. The approval of this permit constitutes approval only to the extent that the project complies with the Butte County Code and all other applicable regulations. 10. The requirements of all concerned governmental agencies having jurisdiction by law, including but not limited to the issuance of appropriate permits, shall be met. Note: Minor changes may be approved administratively by the Director of Development Services upon receipt of a substantiated written request by the applicant. Prior to such approval, verification must be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. BUTTE COUNTY DEVELOPMENT SERVICES DIVISION NOTICE OF PROPOSED ADMINISTRATIVE PERMIT APPROVAL Notice is hereby given that the Butte County Planning Manager is proposing to grant an Administrative Permit to allow a detached Senior Citizen dwelling unit for Albert and Shirley Johnson on property zoned A-5 (Agricultural), identified as Assessors Parcel #042-050-073 located on the west side of Nord Avenue, approximately 2000 ft. north of Henshaw Avenue in the Chico area. The permit will be granted subject to the following conditions: The "living area" meaning the interior habitable floor space area of a dwelling unit including basements and attics, but not including a garage or any accessory structure, shall not exceed 1,200 square feet. 2. The senior citizen dwelling unit is intended for the sole occupancy of one (1) adult 62 years of age or over or two (2) adult persons, one of whom is 62 years of age or over. An affidavit of compliance with the age requirements of this section shall be recorded in the office of the Recorder prior to issuance of building permits. Said affidavit shall include the legal description of the lot or parcel and shall constitute a covenant running with the land, binding upon the original owners and their heirs, successors and assigns, limiting the occupancy of the senior citizen dwelling unit to the conditions described in this section. 3. The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel containing the unit is created in compliance with the existing zoning and subdivision ordinances and the resulting density is in conformance with the General Plan. 4. Two off-street parking spaces shall be provided for the senior citizen dwelling unit in addition to the parking spaces required for the primary dwelling unit. 5. Adequate sewer and water facilities shall be provided subject to the approval of Environmental Health Department. . 6. All site development standards as required by the zoning district in which the unit is located shall be met. 7. The senior citizen dwelling unit shall be a conventionally constructed building ora mobile home that complies with the National Manufactured Housing Construction and Safety Standards Act of 1974, except that in the "A", "FR", and "TM" series of zones a mobile home, as defined in Section 24-21.28, may be used. Travel Trailers and recreational vehicles shall not be allowed as a senior citizen dwelling unit. 8. The Butte County Fire Department requires that the applicant provide an all weather access for a 40,000 pound fire apparatus to all structures. All new structures must meet the Fire Safe Regulations of Butte County and PRC 4290. 9. The approval of this permit constitutes approval only to the extent that the project complies with the Butte County Code and all other applicable regulations. 10. The requirements of all concerned governmental agencies having jurisdiction by law, including but not limited to the issuance of appropriate permits, shall be met. Note: Minor changes may be approved administratively by the Director of Development Services upon receipt of a substantiated written request by the applicant. Prior to such approval, verification must be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for an amendment. Persons wishing to comment on the project may submit written comments to the Butte County Planning Division any time prior to March 1, 1995. The Planning Manager shall consider all comments in determining if the application meets all of the above conditions and criteria. Upon finding that the proposed use does or will. meet all of the conditions and criteria, the Planning Manager will approve the request on March 6, 1995. Any interested person may appeal the decision of the Planning Manager by submitting a written appeal, accompanied by $250.00, to the Butte County Development Services Department at 7 County Center Dr., Oroville, CA 95965 prior to 4:00 p.m. March 14, 1995. If you do not appeal and if there are no other appeals within the 8 day appeal period, the Administrative Permit will be issued after March 14, 1995.
