If is also my understanding that the enforcement of the zon,fng ordinance is to' be delayed pending future consideration .of a ci ' Nome Occupation Ordinance. The question,,of home occupation is .. a difficult one to deal wi.th for the fiellowing reasons It is difficult to define acceptaf;le usos to be allowed, in residential zonas and the level of activity °uo ;,be allowed onc.;e allowable uses have been established; The second „d.ifficulty is adequately enforcing a home Ocrcupation Ordinance. it is my understanding('that the Note Occupation Ordinancc:'enclosed in firs. A Home Occupation Ordinance for the City of Oroville or for any city is generally eas"er., to administer in that a city encompasses a smaller geographic area With amore homogeneous populatiOn. ',It is generally easier to administer and police a Home Occupation Ordinance within these incorporated areas. the diverse population and'larg'e geographic area of 1" Butte County would make it difficult to assure that we are a small .ihome occupation i n an R-1 areaaof'aradi sel or ons "o achieving complia, hce with the ordinanceg fo'r instance, may he perfectly, logical to tMe ,people 1n°'rtf a o a re.a ;. ; The same regulation of a similar use ih the mountainJareas or Wfarm areas may make little sense to the people in th' se areas'', and, mays the'reforek make compliance difficult, Attitudd's vary areato area. Provision6 of the Ordinance states that there should be no additional alteration or remodeling permitted in connection.. ,. with any home occu at.i on,. I believe that provision could be remodel circumvented by thee individual receiving a :permit tor a single -family or other residential structure and then applying for the K'me occupation. Su:5s-eq4ent alteeatiohs may be made without detection. It would be difficult to prove that a subsequent alteration had been expressly made for the purpose of the .home occupation and ~,could, therefore,,° constitute a reason for the termMation of the home occupation. Provision 13 of the Ordinance states that no home occu, pat'ion shall be permitted which creates ahy electrical disturbance r adversly effecting the operation, of any equipment; located in any dwell,i-ng unit or any property not owned by the persons conducting said home occupation, Again, intei-ference such as, radio and televi"tion interference wog1d i ",quire an inspection and documentation that the source of electrical disturbance was emanating from equipment used in the home occupations -j I have Viewed the penton sito and there is no evidence from ati inspection of tt,e exterior of the property th-'at a business is being conducted, It is my understanding, however that the p;dmplaint emanated from a neighbor that felt that butinessei should be confined to commercial areas. I'believe the major gdestion ,remains the successful regulation _f= +'lie r size and scope of ch home o cupatiahs a;td still maintain the protection of residential zoning to residential areas." Aj 7h, ufie permit system would be cumbersome and be effective only in those,:cases where the individu'al-made applicatii.A fore, ' home occupati-oh. As a practical matter, :however, therE are humorous professohal people and other small businesses that are established throughout th` County which could go undetected until a ,c6mpl aint is 'r'ecei ved. 7o be equitable, an attempt should be made to locate those businesses if an ordinance estab- ti lisping a use, permit proceduro is adopted, if the County had a business li'cehsing procedure it would be possible to ,locate 1 r C5 Meilr0 to: o< hoard of SupOry ,.. rs August, 25, 1077 Page -4- _Y1 %. new and: eaistfng businesses. However, it is' my understanding that Counties are prohibited from requiring business licenses. Establishing a list of allowable uses can be accomplished, he ,possibility that the list will be challenged as to ry bei'nq eit9ier to ;aO1 encompassing or to exclusive would exist and a definition of accept'able home occupation Would necessarily have to be carefully drawn and reviewid by legal assure that the criteria for al l o%,.,Abl a uses wase well docaemen'ted. The latter is especially relevant to the Erainte.nance of the (fiitegrity of the zone in which the use wouldbe ,all,.w(d and should"be -consistent with;maintaini'ng the heap►;, -=i'`s-ty and general welfare of the public. tk `' Jr_ In summary, I certainly a'm sympathet c' with the idea of - —n'aving A,small business that can be conducted within residential i dwellJngs which affords some measure of income for- the other, c; It is"especia1ly appealing in° Butte County where we have numerous persons on fixed incomes who may require additional income, Asiyoucknow:bthefurnished thrquaracteristic,s of the a h a small home occupation, ,, y re changfng and the retired, fixed-income person is becoming a proportionately larger percentage of the County as time goes r aspl;.have, however, some real reservations ag, to the administrative ec.cs and equitable application of 'a home occupation ordinance. My .4xperience from other cities has been that a home occupation r,t best can be a very troublesome and time consuming ordinance. ` ,. If the `hoard wishes to,establish a home occupation ordinance, I certain-l'y' believe tfihat it should be brier and avoid some of xi the pi tfal l s that T believe are built 'in to the ordinance which was enclosed With Mrs. Denton's letter. My suggestion, should you desirl to establish a homt occupation ordinance, would be to alloW lpecified hornp occupations to be conducted entirely 1chin a single-famti"ly'residence allowing rid out storage -- of materials no parking other than that required for the residential district in Which the property lies and disallowing, adve 11.-isinq of any type. Several of those provisions run counter to the concept of conducting a business, but, 1 believe that a straight forward simple ordinance disallowing some of the E,I potentially r*jecti'ionable Features- of a business is the only ` alterhat:'''. . 1n other words, you will have tmake trade offs cbhcerhin6-1undesirab11e features.,,, Ican provide r`urther inforh1ation on this inatter I will be g1a,N' to do to, LA:db 1$ } r r heti•. . .. 6nger-@eparanfatlietmorandun ra: Bette Couai ty Board of Srpervii sbt' ' y roa►: Lawrence J.
