TII. DISCUSSION OF ENL11RONM,?NTAL EVALUATION
Phis ;project is the addition of a Homq Occupation 0 din. e to the,
OomprehensiV'e,, V,,oia48' Ordinance No. 1°75O of the Butte Go=ty Code;
^r The ordinance would allow businesses in e fisting residences and,
`Vould not genevate` ;extensive physical deVelopment or alterations of.
\property. Home businesses would be 'likiited,to those categories listed
ordinance. A number of zoning districts where businesses 'are
not presently allowed would, be opened up to, ,the possible establish-

be allowed in all di. tricts _,allowing resideZ,:,s except in cased where
such use might .,be o'bj ectionable because of noise, odor; smoke, dust,
hright light,,vibration, pollution{y traffic congesta.on unsafe' a :c ssy'
or the handling of explosives or dangerous materialo. such cases
a use permit shall be required
There are a number of advantages as well as possible drawbacks to thin
t'ype of ordinance. One a&,_rant&ge is in allowing work 'to be conducted -
in homes, thus, saving overhead costs; the consumers of the various
Goods and r8ervices could benefit from competit'avely-pprioed product.
Another advantage is in allowing a family to supplement its 'income
through a home business. One possible drawback is that there would
be somo competition created for businesses in established commercial
zones and areas. Another potential 61fect is - that home occupations
may generate traffic on a regular basis within neighborhoods; the rd-

S:, Activities permitted by the home occupation ordnance are
secondary or accessory use which are compatible with and
carried on in conjunction with the primaryresidential use. These
k secondary uses are therefore not. considered confliUto with the General.
Plan c'f
-. 10 iSome home occupations may involve the use of httrdous, toxic
or explosive chemicals. Thi,,, aspect of, the oda„oration is anti c:a-
pated to be reviewed;;, as 'part of the i:s'e permit application and approval
procedure, so the use permit requirement is viewed as "a mitigation.
measure:, as it allows j'iripsition of conditions necessary to protect`
public safety.
12 Some home ocr.-tipations may be objectionable to the surrounding,
n6igbbors. ii.he use permit requirement can be invoked in such
bases.

,, p t complied with, tberevocation
prodedue, Section, 24-62 of the Butte County Zoning Ordinance, would
allow anyone the opportunity to submit a complaint to the Planning
Director.” ,After verifying that a violation exists, the Planning Director,
would send writ'tewihotice to the violator requ68ting compliance with
the terms of the home occupation ordinance and the particular conditions
of the use permit issued. fo.r the home occupation. 1f the violator does
not comply within the allotted time period, a publia hearing would be
held regarding the violation or violations of the home occapat!.,o ordi-
nance. The possible result would be the abatement of the Iome bbl siness
if it is proven to be a public nuisance. .
13a, f Additional traffic may be generated by the home businesses.
If a home business creates a great demand for a particular
product, the delivery' of the goods to a retail outs •,t may be prefer-
able to causing traffic problems in a residential. area: Similarly, (
if a service-oriented home business creates too Much traffic or
could, be anticipated "-to create a great Ileal of traffic, the business
should be relocated in an appropriate zone or in a zone where the use
is allowable by use permit. Potential traffic hazards (sight dis.-
tances, etc.) will 'be studied: on a project by project basis in cases
where the use permit requirement is involved.

Our only concerns, arising OuL of discussions with area, `-1
farmers and residents, are°these:
' 1. There is concernin the farm community ,
and in tes -
dential neighborhoods that this -May lead to a trend of „cre;ping
commercialism `c into areas" which should hot become" Commercial,.
As long as the ordinance conditions are enforced, outside employ--
ees are not allowed, and use permits are denied where they would
encourage such trends in inappropriate places, this should not be
a problem. We only urge you to keep this potential dxfficulty s n
mind. .
° 2 ; \,, Traffic from customers may be the greatest potential,
problem, Tha City of Chico deals with this by carefully con-
