In your memo.,:,of May ,18,, 1978; you ,set out the acus
regarding Solano Rail Car Company and its use of the Southern
Pacific spur track in the, area known as the Round House fol use
of repair of 'rail; cars.
`The Southern Pacific spur track right-of-way lies within
the M-:2 zone, the A-2 zone, and partially within 'the A -R zone in
that: the A --R zone extends to the center of the righto;-way.
According to Bob Ferguson's

Following our phone conversation of last Wednesday, I completed
revision, of the initial study of environmental i6acts associated
with your rezone proposal which will be heard by the hoard of
Supervisors" at 10-30 a.m. on. Tuesday, June 20, 175. The re-
wised initial study is enclosed for your reference.
As x indicated would be the case, we are ,recommoiiding°a pori-
diti_onal negative declaration in connection with your ,rezone
r.+ quest. Please review -the"p,roposed mitigation measures to
de'termine whether they are acceptable.. 'Keep in mind that the
Board: of Supervisors must make the final decision, and that
the", ,r itu:3't de>'termine first of 'all whether the adverse effects
0 tXe proposal are severe enough to be,, considered, "siLgnifican
if" `o°t, a negative declaration t�da. thout conditions could be ;
adopted. If so, either an ElR must be pr. e'pared , or mitigation

This project has generated considerable controversy, among area
residents, who appeared at the Planning Commission hearing
May 8, 1978, to voice their concemsa (See enclosed newspaper
article.) We have :revised the environmental checklist to re-
flect these concerns. Because of potentially significant
environmental, eff eats we are recommending a conditit,'-nal negative'
declaration with mitigation measures to reduce the potential
problems It appears to me that an impact report'would not; be
particularly helpful in this case, since, all the impacts are
already known. The proposed conditional negative declaration is
somewhat innovative in that a rezone i.s not usually subject to
conditions. However, in this case, the M-2 zone has a provision
Luwhich a use permit can be required for objectionable 'uses
(due to noise, glare, etc,). A use permit is conditional, and.
we, are suggesting a use permit requirement 'be invoked in this
case so mitigation measures can be applied to the objectionable
aspeots of the applicants proposal. Some of 'these mitigation
measures may not be acceptable to the applicant4' If so, Mr.
Sam Girdler may express objections to some of the mitigation
measures during the hearing'. The :Board will have to male a
final derision as to
(1) whether the impacts of this proposal are significant.
(2) wn.ether anyy' impacts deemed significant can be mitis
gated to the point where they would be considered
�nsgnifcan,t.

If there are impacts which are considered significant but cannot
be feasibly mitigated; then the Board is obligated either, to
deny the project or require and B.l`.Et. I believe the. proposed
mitigation measures are adequate but may be objected to by the

lished by County Ordinance #621 adopted by the��Board
of Supervisors on June 16, 1958. �
Description section reads "Beginning at the Quarter
Corner., common to Sections 19 and 30 of T19N 94E; thence
southerly along half section line to Quarter Corner
common to Sections 30 sand 31. of said township; thence
easterly to nort,,nva.st corner of said Section 31; thence
southerly' along section line to southeast corner of said
section; thenceeasterly to Quarter Quarter Corner
common to Section 32 of said township . and Section: 5 of
T18N, R4E; 'hence Northerly along. Quarter Quarter ;line to

The Butte County Code,pvovides'that in the event of disputes
over zoning districts boundaries, that (1) Whero such boundaries
are indicated as approximately following street and alley lines,
such street and alley lines shall be construed • be such
boundaries., (2) Where such boundaries are indicated as approx-
imately following lot lines', such lot lines shall be construed"t0
be such boundaries (3) With -respect to property Ahat is not
subdivided, and where a'zoning district bisects a lot,.the loca-
tion of any such boundary,,unless the same is indicated by
limens ons `shown. upon the zoning' district map shall be determined
by the use of the scale appearing on the zoning district map. (4)
If any further uncertainty shall exist, the Board of supervisors
upon written application or upon its own motion, shill determine
the location of such boundaries;

The entire spur was zoned "A-1" in which no restricti6n,s
were imposed. by;, Ordinance 475. Southern Pacific Railroad
was established and in operation on the spur at that time.
August 29, 1955
The entire spur was zoned "A-2" (General) by Ordinance 522.
June 16, 1958:
That portion of the right=of--way located south of the
north line of Section 29` T19N, R4E MDB&M was rezoned to
"M-2" (heavy Industrial) by Ordinance 621.
March 21 , 1960
The west half of the right-of-way located north of the
north`line of Section 29 T191111 R4E MDB&M rezoned by
Ordinance 669 including AP 3 t'-210--01; 35-220-01, and
35-220-02,
- August 15, 1967

Visited parcel and observed that the spur con'tsts of
8500 f of. right.,of -way ,track from Grove Street Orovi„lle
to Ophir Road. There=are assorted frei ht cars parked
and -stored on the first third ( 2800 ft . of track on
Grasse Street t'o Arnold Avenue. On the second ,third of
.track, it isvoidof any cars. Tracks at thisoint grade
up an incline approximately 30 feet to point B (2700 ft.).
After point B,, it levels and'there are more assorted rail-
road freight cars towards Ophir Road (o;nd of track)
The main concern of this report is , witY the first por-
ton of track along Lincoln Blvd., from Grove Street to
Arn;old Avenue (2800 ,ft.) .

Board of Supervisors to evoke Chapter 32 of Butte
County Code regarding nuisance abatement.
August 9, 1978:
Lynn E.' Vanhart, Director of Environmental Health,

Espee Street, Oroville, site of parked rail cars.
-He identifiedhimself and stated he was representing
the people along Lincoln Blvd..` He ;further stated,
he was running for Supervisor. of Butte County. He
referred'' to the amount of cars parked on tracks, that
they should be moved, that crimes are occurring in
and about the railroad cars, that cars should tie
parked further up the track away from populated areas,
and that a fonce should be erected., hiding the cars.
