A use permit was approved for a shopping center in July, 197✓•. If this rezone -is not approved, then the use permit will be in effect. The E.I a Ra was prepared and it already covered the site that was previously zoned C-2 mr` Nelson suggested that the prior E.1.'R. be used for this rezone. Comments set out in the letter from Phil Mace, attorney at law, explained by Mr. Nelson. Mr. Nelson stated that the perc test data in the E. I. R. relates to test maderior to the grading on the s4e. This does not affect the change in zoning to P r "C-2". The project was begun as a 15'e, acre shopping center with 12 acres to be constructed under a use permit in the A2 -ltd zorle. 1 final EIR was certified 'n July of 1977 for 2Q,000 square feet of buildings and I0` acres of paved parking or a site to be levelled with a grade 'cut not in ex cess of 3.0 feet. Percolation tests and soil samples are referred to in the report. . Ground water was re- ported to exist at 13 to 20 feet -in late January of dry 1977. The shopping center is to gene7.a�e a traffic count of 10,000 vehicles per day and according to the BIRD the developer will cons'txldct' .a r> four lane Clary Road section alongside�theproject. (Pr.esurlmnbly the taxpayers will foot the bill for widening Clark between the shopping center and Bille Road.) The EIR states that the project �y would return $121,000 in property tax revenues to Bunte County and local. districts. This was as of July, 1977. The first problem involves percolation and ground water. Since July, 1977, grading plans have been submitted to the depart- ment of 'Public Works showing a maximum cut of 20k feet and a cut of at least that magnitude presently exists on the project site. On ,lune 9, 1978, your environmental review director stated to Me that he had not been notified of the chane in cut from 10 to Mk feet. The second problem sconcerns traffic �� The 1977 Earn leaves t1ne impression that the developer will construct Clark Road to four lanes alongside the shopping cen'cer. However', the ,parcel map and subdivision map recently approved by the county call only for construction of,a k section along the East side of Clark, Road. The IEIR and the use permit also :fail ,to state wiAo will construct the mile of four lane road to,the Bille Road intersection or ' whether additional four lane roads wall be needed above Wagstaff or along Wagstaff. The relative road bu ldingi,obl,igations of the developer and the taxpayers are very unclear and seem to be changing in favor of the developer. The third problem concerns the economic impact of the project. With the passage of Proposition 13, it !°s unlikely that the ETR statements of the economic impact of the ,shopping center ar'e va�,id. Specifically with regard to the Environmental Impact Report on file for the proposed _-tlzoning I would mote for your attention that there are certain social and economic factors which could be considered by your board at arriving at a decision to approve the ptoject. As you are well aware, the trafilc on the Skyway between Paradise and -Chico has reached , considerable proportions and has even at certain times of the day become hazardous. In addition thgre are residents of Paradise who have their driving privileges restricted to the Paradise aye W and elderly, persons who may find the drive to Chico for major regional'shoppinq center purchases difficult. It would seem to me that a shopping center for the Paradise area would alleviate some of these problems and definitely be of valise to those residents Further, in discussions with the developer he has informed me that his 'best estimates of the gross sales for the first yeas of the center's operation would be in the neighsorhood of $20,000,000. Assuming that the County of Butte would receive 1% of the 6t sales tax levied on all retail sales from that shopping center this would mean a total of $200,000 in ,revenues to the County of Butte during the first year of the shopping center's operation.
