The Commission was reminded that SeCtion t of the M-1 and M-2
Ordinances requies a use permit for facilities `:'that' might have object on-
able, characteristics
Commissioner Gilbert added that this would be a prooedcnt getting action
and added, that if the plan is changed and the industrial: zoning is
approved that this ares could be used in the future for any type of
industrial 'operation.;

maintained in the county and that Bangor must not be permitted to lose:.
the little industr,_it has.
Counsel Siemsen reminded the Commission that a minimum of two weeks is
required by State law before -action can he taken on the rezoning portion
of this hearing. He.also said that State. Otatutes do riot noir a] low
use variances to zonng restrictions
After a lengthy: discussion, motion was macre by Commissioner Wheeler to
recommend approval of the proposed General Flan Changes front "Timber
Mountainous Terrain" to "Indus -trial" property located on the south-
west corner of Robinson Mill; Road & LaPorte Road. His findings were
that the action was for the general public welfare and economic better-
meat
of the community. He commented further that. services for the-
industrial
heindustrial area were covered in the environmental stud., and that this
motion is consistent with the Negative Declaration. _Eris motion was
seconded by Commissioner Steitz.

Proponents; Mrs. Arnold said that decision had been postponed too long
and asked that a decision be made now.;
Mr. Arnold said tliat oniy..a week ago there was an area ,moeting express -
• p of the fire and police protection
�,n concern about the possible loss
and added that the loss of this tax base would be detrimental,
Warren Smith, owner of Butte County Auction; Vern G:ilney, Bertha Brmatinger,
pixie Hill all, spoke in favor, but had. no new information to 'add that had
not been introduced in previous meetings. In response to a gliestion from
Mrs Hill, staff commented that the hoard had assured the Bangor cllsi
dents that a hearing would bef'`rier�r:; {;n the area.,
Opposed: Jeff Phoenix questioned whether litigatadh was pending and
added that any manufacturing on the property is illegal and exp=ressed
concern that once the 5 acres is rezoned the plant, will continue tO grow,.
J. Gillis, owner o property across' the road, read a.letter from�.Charies
Brooks in opposition, and stated that owners of Parcels 28-18.41, 35,
26, 18, 40, :'9 38 and 30 were all opposed. He further stated that passage
of this proposal would be a violation of his (Hillis') constitutional
rights.

In reson_se to a question raised by Mr. Arnold concerning manufacturing
in an A-5 zone, Mrs. Blair stated that the building permit for Kilby Mart -
ufacturi.ng Company was issued on property zoned A-2 not A -S.
Commis s:i0,31'er Gilbert then repeated his notion t.o continue this matter
until September 18. Tt was again seconded by Commissioner Everhard

Dear Editor
.After reading the articles concerning the rezoning of,. -i-1,5 acre parcel"
sectioned off from a 112 acre parcel belonging to Jin,,y%Arnol'd in
Bangor, California, for the operation of a light manufacturing
plant, I am appalled at the inconsistencies'of the Butte vounty7�
Planning Commission and 'the Board of Supervisors,;;
It is my enderstanding that rezoning by whatever measures it took
to obtain it was applied for, My question is; Why was Mr. Arnold
,not informed of the°necessary requirements of an amendment to the
,t
general plan', which I may add, is obviously outmoded, when he first {tl'
applied?
My next question is why must a person pay the fee to apply for
rezoning and go through the procedureonly to be told at the time
of denial that there are other procedures necessary to complete,
t-he'first steps and then be told another fee will prob.ab77 be 'required?
My next question is; Why in the name of all that is beneficial to
this poor county, would anyone even consider denial of a non-polluting
business which employs 20 people and will be bringing revenue in
the form of taxes to this county?
My neat question is: is it really possible; in,ithis land of free
enterprise and initiative, ;that a few people, whose only objection
seems to be that the machine shop building 'was coni►etCed from a "
barn and they were not told of the conversion bo -k it took place,
can possibly object so loudly that they have the right to destroy 20
persons livelihood? ,
Are these people productive enough to'nompensate for that?
if this is all agriculture land,, what is the product? xt is my
understanding that on 'most of the land in Bangor p"articularly, it is
even difficult to grow'a goat. Then to,put the frosting on the caste

zoning from A-5 to M-1 wag denied: We were advised by the a6mmiss'ioners
to apply for an appeal f6rwenwished to continue our application for
rezoning, so that .is what we our doing not,
We are not sure of the enact procedure to take or,, just what information
you.need to know so I will give you the general information that was
discussed at the Planning commission meeting and ask your help and
cooperation in handling 'the matter in the proper legal manner..
We have a light manufacturing businebrlin which we produce aircraft anj'
helicopter spate parts directly for the Government; Our machine shop
is equiped with lathes, drill, presses, milling machines and geneiA:l <
welding equipment, none of which create loud noises, Our building is
a nice metal building, well insulated and very quiet, It is neat and cle'
clean with well kept grounds, There is nothing to polute the atmosphere
and we feel there is absolutely nothing unsightly or detramentaltoo our
surrounding community.
We are providing A livelyhood for 18 people of the near by surroandinl
area At the,.present, This amounts to approximatley $150,000,00 annual
salaries to be used is and around our comMUnity. ?.1

We feel that the mafority of out neighbors are very much in favor of
our operation and tadilities due to the fact that 15 oft!�em came to
support us at the meeting last night.
We 'began our business in 1075 in Gridley, California and Moved it to the
present location in Bangor in March of 1976 because we had outgrown the
small shop building in Gridley. k7P``felt it would bead asset to this
community in which wee have made our home. We 'were unaware 7of any legal`
limitations when wie made the move and now we are applying for rezoni'nh to
make it completely legal.
