An increasing nmber of requests for immediate rezoning out of Timberland
JPreserve Zone classification under the, provisions of the Forest Taxation
Reform Act of 1976, are being received. This letter is to .request that
when county planning departments and county, boards of supervisors receive

such requests, that notification of such request, in waiting, with the
essential information and a copy of the map showing the location and acreage
��.
of I the area proposed for rezoning be promptly sent to the Resource Manage-
ment section, California Department of Forestry, 1416 Ninth.5treet,
Sacramento, °CA 95814. The reasons for this request are outlined in the
following.
Ander the Forest Practice Act and Board of Forestry regulations,, a Timber-
land Converdion Permit,issue'd by the 'Director of Forestry is required in
cases. where the size of the area for which rezoning is req nested is three
acres o'r more and where timber or other solid wood products are removed for
commercial purposes. When a conversion permit is require.i,,'the Hoard of
Supervisors must 'give notice to all landowners w•Lthin one'mile of the bound-
aries of the area for which rezoning is requested, and hold a public hearing
to congiaer whether the rezoning is in the public interest. At this hearing,
the Board of Supervisors may make findings required by law in support of the
rezoning, may tentatively approve the rezoning by 4/5 vote* and then may send
the tentative approval to the Director of Forestry for his review.

Tn general, these regulations require that for immedxaate rezoning,' requests of

Negative Declaration to the=State; Clearinghouse. The required time, periods_
allrkoed for review and comment from public agencies and the general public
must then run. Finally, any significant comments on the Draft BIk must be
answered by the County before it adopts the required final env.,ronmental
documentation.,
Besides its procedural concerns Vith-Ammediate rezoning of TPZ lauds,the
Board of Forestry strongly encourages the retention of good quality timber
land for use in timber growing and 'compatible uses for the general,' welfare
of the people of California. This interest is formally expressed in the
Board of Forestry's written 'policy, "Maintenance of Timber Supply," adopted
in July, 1977. This policy reflects Board of Forestry conclusions that prime
timber-'and,must be protected as a means of economically supplying the public's
n need for forest products. The policy also, includes findings that it is in
the public interest to oppose diversion of prime timberland and othek TPZ
land to uses that preclude timber growing and harvesting, except where public
values for such uses exceed those:. from timber growing and harvesting.
Therefore, because of the reasons c, tlined in this letter, the Board of
Forestry 'requests and urges counties to 'promptly notify the Department of
Forestry, in accord with the first paragraph oft this letter,, when county
planning departments mid county Boards of Supervisorsreceiverequests for
immediate rezoning from T,imberlazsd Preserve Zone -classification.
