These projects were received in the years 1998 to 2001. No action has been taken by the applicants of these projects to make their application complete or to give the Planning Division the go ahead to start working on the project again. Letters were sent to each applicant and/or their representative requesting they respond back to Planning Division staff as to how they would like to proceed with their project. No written replies were received. In order to close out these files, staff recommends that these six projects be denied without prejudice. The project descriptions are provided below, along with a status of the proj ects. Michael Caprealian, Tentative Parcel Map to divide 21.52 acres into two parcels of 11.51 acres and 10.01 acres on property zoned FR -10 (Foothill Recreational — 10 acre parcels). The property is located on the east side of Helltown Road, approximately two miles north of Centerville. APN 011-400-039. File # TPM 00-12. This project, which was received on February 23, 2000, was deemed incomplete by the Environmental Health Division because test holes for soil testing were not dug by the applicant. The areas where the test holes are required are not accessible by a backhoe. A letter dated September 20, 2002, sent to the applicant requesting the status of the project went unanswered. Another letter dated January 31, 2003, sent to the applicant also went unanswered. The Environmental Health Division stated that they have had no recent contact with applicant. Staff spoke with the applicant who stated that the property owner who originated this application, Gilbert Kinney, passed away several years ago. Janice Kinney and the Estate of Gilbert Kinney sold the property in 2002. 1 • The new owner of the project parcel, Grant Peterson, wrote a letter stating that he would like the project to continue until he decides what to do. The letter is attached to this memorandum. A copy of the letter was forwarded to County Counsel for review. Bryce M. This project, which was received on April 8, 1998, was deemed incomplete by the Planning Division for errors and/or omissions in the application material submitted with the project and because authorization from the California Department of Fish and Game to allow the proposed change was not received. A letter dated September 24, 1999, sent to the applicant's representative requesting status of the project went unanswered. Another letter dated January 31, 2003, sent to the applicant's representative and to the applicant also went unanswered. Champion Christian School, Use Permit to expand an existing gymnasium at the Champion Christian School from 5,400 sq. ft. to approximately 9,000 sq. ft. and to increase the height of the ceiling from 20 feet to 30 feet, on property zoned P -Q (Public — Quasi -Public), located on the north side of East Avenue, approximately 400 feet west of Floral Avenue, at 1184 East Avenue (First Church of the Nazarene), Chico. APN 048- 300-049. File # UP 01-05. This project, which was received on August 30, 2000, was put on hold at the applicant's request on November 1, 2000, because the Environmental Health Division required that the project site annex to the City of Chico or connect the proposed upgraded facility to the City of Chico sewer system. A letter dated January 31, 2003, sent to the church and to the church's representative went unanswered. The Environmental Health Division stated that they have had no recent contact with applicant. Point BTA 79LLC (Silverbell), Minor Use Permit for collocating antennas at a height of 70 feet on an existing 120 foot tower and connecting the antennas to telecommunications equipment mounted to the wall within Suite 8 of the existing adjacent building on property zoned C-2 (General Commercial), located at 3415 Silverbell Road, Suite 8, Chico. APN 007-390-001. File # MUP 02-06. This project, which was received on August 3, 2001, was put on hold at the applicant's representative's request. A letter dated August 19, 2002 sent to the applicant and to the applicant's representative went unanswered. Another letter dated January 31, 2003, also went unanswered. Since this project was submitted, the tower on which the proposed antennas would be placed has been modified by other antennas, and the site plan and radio-frequency analysis submitted for this project would have to be revised to reflect the changes to the tower. 2 • . • Point BTA 79 LLC (Nord Avenue), Minor Use Permit to collocate six panel antennas on an existing monopole tower at a height of 98 feet and to connect the antennas to telecommunications equipment within an existing building. The antennas will be used for digital cellular communications systems on property zoned C-1 (Light Commercial). The property is located within a 1.9 acre parcel northeast of and adjacent to State Route 32 (Nord Avenue), approximately'/4 mile northwest of Sacramento Avenue, Chico. APN 043-200-005. File # W -P 02-07. This project, which was received on August 3, 2001, was put on hold at the applicant's representative's request. A letter dated August 19, 2002 sent to the applicant and to the applicant's representative went unanswered. Another letter dated January 31, 2003, also went unanswered. Since this project was submitted, the monopole on which the proposed antennas would be placed has been modified by other antennas, and the site plan and radio-frequency analysis submitted for this project would have to be revised to reflect the changes to the tower. Thomas Reed, Tentative Parcel Map dividing a 40 acre parcel into two parcels of 15 acres and 25 acres each on property zoned SR -3 (Suburban Residential — 3 acre parcels) and M-1 (Light Industrial). The property is located on the east side of Cohasset Road immediately south of Plummers Lane, north of Chico. APN 048-010-066 and 067. File # TPM 99-17. This project, which was received on June 7, 1999, was deemed incomplete by the Environmental Health Division because winter groundwater monitoring is required. The required tests have not been completed. A letter dated September 20, 2002, requesting status of the project and sent to the applicant's engineer and the applicant went unanswered. Another letter dated January 31, 2003, to these two individuals also went unanswered. The Environmental Health Division stated that they have had no recent contact with applicant. All of the above projects have been around for a long period: of time and the applicants are not actively seeking getting their projects to hearing. Denying these projects without prejudice would allow Planning Division staff to close out the projects, but still allow the applicants to resubmit their projects at any time. A new application would have to be submitted, along with the normal processing fee, if an applicant wanted to resubmit their application. As noted above, letters were sent to the applicants and/or their representatives requesting the status of the project. No written replies were received. Additionally, the applicants and/or their representatives were notified of the August 14, 2003, Planning Commission meeting. Public notices of the meeting were placed in the appropriate newspapers and notices were sent to property owners in the project areas. 3 Recommendation Staff recommends that the Planning Commission take the following action: I. Find that the denial of these projects is statutorily exempt from the requirements of the California Environmental Quality Act (CEQA) under Sections 15270(a) and (b) of Title 14, California Code of Regulations, Chapter 3 (Guidelines for Implementation of the California Environmental Quality Act). These sections state that CEQA does not apply to projects for which a public agency rejects or disapproves. H. Deny the following projects without prejudice based upon the following findings: a. Denial of these projects is for one or more of the following reasons: 1. The project was deemed incomplete by County staff due to errors or omissions in the application materials submitted with the proj ect; 2. The project was deemed incomplete by County staff because required soil :testing for on-site sewage disposal systems was not completed; 3. The project was put on hold at the applicant's request and nothing has been heard from the applicant in over a year or more. ' b. The applicants of these projects have not made any attempt to go forward with their projects. c. Per your suggetion, I am writing to you to hold open the application for a parcel split at 13600 Helltown Road, Chico, CA 95928 (APN 011-400-039) I am the new owner of this property having purchased it from Gilbert and Jan Kinney one year ago. I have no immiediate plans for this parcel should it be split, but the thought has occured to me that it would be worthwhile. If possible, I'd like to transfer the application to my name. Evans One Nice Place Oroville, CA 95966 Dear Mike, On 3 January 1992, I surveyed the Walden.Pond Estates property, Phase II, for deer use and for review of the effects of moving homesites further north on lots in this phase. I was accompanied by Jeff Souza, Wildlife Biolo- gist. We walked the perimeters and transects though lots 21, 22, 23 and 24, where the vegetation allowed movement and ground visibility provided an oppor- tunity to check for deer hoof prints and pellets. The basic habitat on the site is a Montane Hardwood -Conifer Forest. the main tree species are ponderosa pine, Douglas fir, and incense cedar Tan Oak and Pacific madrone form a secondary canopy over portions of the site. Other shrubs in the project area include deerbrush, whiteleaf manzanita., and poison oak. Grasses and forbs were absent from areas with dense tree and shrub overstories, but were present in small numbers in clearing and along road- sides. The only surface water source on the project site is a section of OWID ditch parallel to Forbestown Road. ADJOINING DEVELOPMENT Adjoining development includes a Christmas tree farm along the western edge and larger lot development to the north. The boundary between the Christ- mas tree farm and Walden' Pond Estates is a wildlife exclusion fence with hogwire and chicken wire on the bottom three to four feet, and a barrier of hogwire above it to a height of over six feet. Part of the northern boundary includes a wooden rail fence. There is one' home and outbuildings near the northeast edge of the property and numerous homes on small lots south of the Forbestown Road. SURVEY OBSERVATIONS Deer tracks were observed along Fir Road and on a cleared alignment that approximates Walden Pond Lane. Deer tracks were also found leading from a game trail from the south through the area of lots 18 and 19, across Walden Pond Lane through lot 22 and the north portion of lot 23; then continuing northward on a game trail that passed through the project's north boundary. No east -west game trails were observed on the lots inspected. There was very little evidence of browsing on the deerbrush on these lots and no deer pellets were found. There was a concentration of tracks and split acorns under one tan oak, although this species is not usually eaten by deer. There are several areas on the project site with dense vegetation that would provide good shelter against predators and weather. Tracks of a very large dog and human boot marks Were observed along.Fir Road and Walden Pond Lane. No evidence was found that that indicated this dog was chasing deer. CONCLUSIONS Deer use on the site may have increased with additional clearing and creation of openings on the site. The original deer movement pattern is from southeast to northwest through the site, a pattern that is still maintained by at least one animal. Access to and from the west side of the project is blocked by the game exclusion fence of the Christmas tree farm. Additional clearing of trails and roadways may improve access to and through the parcel for deer. Free -roaming dogs would discourage deer use from this parcel and from adjoining areas and must be controlled. Moving the home site further north on Lot 21 will have no effect on use of the site. The home site on Lot 22 can be moved 100-150 feet further north if the buffer area from the line separating it from Lot 23 is increased. Keeping the homesite at the same approximate distance form the line with Lot 21 is recom- mended. The home site on Lot 23 should be moved north more than 75 feet further north, and -moved closer to the boundary with Lot 24. Moving the building envelopes closer to the indicated lot lines is recom- mended to allow deer to follow their pre -development path through the project. A firebreak should be created along the northern boundary to the inter- section of Big Fir Road to allow for east -west movement of deer. Since ely, Albert J. Drainage water from this subdivision could enter the tributary of the Feather Fiver via the on-site swale and the existing pond on-site. Some provision should be made to insure that. oil phenols and residues from automobiles and residential uses do not enter the on-site waterways via stormwater drainaqe channels or enter off-site drainageways. Sediment traps of some sort should be incorporated into any plans for a permanent solution to drainage. lh: All of Butte County is within a Moderate Earthqua4::e Intensity Zone VIII. The subject property is located approximately 3 mile southwest, of the Big Bend Fault which is of unknown activity. Pinother fault of unknown activity is located approximately 4 miles to -the southwest of the subject property. Construction of homes to Uniform Building Code standards for seismically active areas should provide adequate protection to residents in case of seismic activity. 3i: Domestic water is to be provided by the Yuba County Water District. This project will represent an incremental increase in demand for water from the district. 5d: The subject property is located in an area of migratory deer herd movements and is in or near a major migration corridor. The Department of Fish and Game has indicated that significant adverse impacts will occur on-site and significant, indirect adverse impacts may occur off-site as well. The Department. of Fish and Game has suggested a redesign of the project to incorporate mitigation merisures which would include the creation of an open space area in the northwesterly portion of the property. See the attached letter from the Department of Fish and Game. 8, 11: The butte County General Plan designates this property as Agricultural -Residential. While densities of 1 dwelling unit per acre are allowed in the Agricultural -Residential designation, it is the ma:cimum density allowed by that designation. One dwelling unit per acre would be approximately 3 to `; times the density of other development in the immediate area. As such, this project would represent a si.gnificant departure from current development in the neighborhood. Appendix F - Page 6 AP 73-18-149, 152 . 130,c,f: Development of 24 residential -lots accessing Forbestown Road will approximately double traffic loads on that section of Forbestown Road between the project and Challenge Cutoff Road. The most recent traffic counts on Forbestown Road in this location indicate an ADT of 210' Once built out this project would add from 170 to 240 trips per day. This increase can be considered significant due to the substandard nature of Forbestown Road in this area. Discussions with the Department of Public Works indicate that that department is studying the situation and may require off-site road improvements to Forbestown Road. Forbestown Road from Challenge Cutoff Road northwest to New York Flat Road has recently been rebuilt and is adequate to handle the expected increase in traffic. 14a: Though not significant, this project will represent an incremental increase in demand for public services in a rural area. 16a,b: Power and phone lines will have to be extended to the individual lots of the subdivision. 16c: Water lines will have to be extended into the subdivision of adequate size to provide a 500 gallon per minute fire flow for the three hydrants required by the Butte County Fire Department. K. Herndon's proposal to form 24 lots on 30.64 acres near Forbestown. Lot size would vary from 1.0 to 2.9 acres. Dominant onsite habitat is a mixed deciduous -conifer woodland with a shrub understory. The project would have a significant adverse impact for onsite habitat and associated wildlife species. Residential construction is expected to destroy one-half of the habitat and wildlife, and the remainder can be expected to be impacted by other factors (e.g., clearing of vegetation for fire safety). Significant indirect adverse impacts may occur offsite by such factors as increased road kills of wildlife and harassment of wildlife by domestic animals. Examples of species which can be detrimentally affected are the spotted owl, deer, and black bear. We suggest consideration of subdivision redesign to incorporate mitigation measures to reduce adverse impacts on habitat and wildlife. Either an increase in lot size or creation of an open space area in the northwest portion of A.P. 73-18-149 would be appropriate. Herndon the property owner? The deed indicates that B.K. Herndon is, not Bryce M. Herndon as indicated on the application. 2. The appropriate authority authorizing the proposed change is the California Department of Fish and Game. The reason for showing the homesites on the map was to ensure that some open space remained on the parcels for animal habitat. The Initial Study for that project determined that open space was needed, and a letter from the Department of Fish and Game confirmed that determination. Any change to the condition to alter the homesites as shown on the map will have to be approved by the Department of Fish and Game. Please resubmit a new Certificate of Correction with the correct page numbers ( 97, 98, & 99). The Certificate of Correction also requires you to certify the Certificate with your engineer's stamp. In addition, the proposed change is somewhat ambiguous. It probably should be revised to read: "Change Note 4 to read: Homesite area for Lots 14, 16, 17 to be within leachfield setback area. Homesite area for Lot 21 to be within 120 feet of Walden Pond Lane Centerline. There are no restrictions on homesite area for Lots 22, 23, and 24." You may wish to delete Note 4 in its entirety rather than have restrictions on any of the lots. Again, as pointed out in item 2 above, the change will have to be approved by the Department of Fish and Game. 4. The check for the recording fee is being held at the Planning Division.
