ANALYSIS: This project is a request to allow the placement of a mobile home as a temporary second dwelling on property located at 177 Self Lane in the Oroville area. The proposed mobile will be located on the eastern half of the 5.2 acre parcel approximately 220' east of the existing dwelling. the proposed mobile will not be located near any neighboring dwellings. The proposed location will not cause ' any hardship on the adjacent properties or result in any land use conflicts. The adjoining parcels are either vacant of are used for residential purposes. The temporary mobile will be used to house the applicant, who is the sister of the property owner. The applicant has not provided any information that supports the need for a temporary mobile home based upon the findings and intent contained in Section 24-303 which states: "The Board of Supervisors has found that for the health, safety and welfare of the people of the County that it has often become necessary, for the care of persons who by reason of old age, disease (either mental or physical), infirmity or other cause, are unable, unassisted, properly to manage and take care of themselves or would benefit from familial assistance, to allow mobile homes to be placed on smaller parcels than present County codes or ordinances permit so that such persons will not have to be institutionalized, but rather can reside near their close relatives who can help care for them. The ability to care for one's close relatives will not only result in better care for citizens, but will also negate in many situations the necessity for public assistance which many citizens find degrading and damaging to the pride of the persons concerned and their immediate relatives. This will also provide privacy and dignity for the relative as well as independence, of which these people are deserving." In addition, the applicants have adequate property to divide the parcel to create two legal parcels. If the required findings can be made, the temporary second dwelling would be appropriate. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also 2 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - March 16, 1992 makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double -wide mobile home. These amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers. The applicant proposes to place a single wide mobile home on the property. RECOMMENDATIONS: A. Find that this project is Categorically Exempt from environmental review; and B. Find that this proposed use of the property does not meet the intent of section 24-303 of the Butte County Code; and C. Deny the Use Permit to allow a mobile home as a temporary second dwelling on AP #036-310-110 (Mary Perry) If the required findings can be made then it would be appropriate to make the following recommendation: A. Find that this project is Categorically Exempt from environmental review; and B. Located near Palermo, the project site is transected by an unidentified creek. Streams and their associated wetland habitats comprise one of the most valuable ecosystems. In addition to obvious watershed importance, streams support the greatest diversity of plant and animal species (aquatic and terrestrial) of all inland ecosystems. Retention of streamside corridors protects water quality, reduces sedimentation, and provides a continuous habitat for numerous species. To mitigate project impacts on the stream system, the following measures are needed: ,a. Establish a 50 -foot no disturbance setback along both sides of the stream channel. The setback should commence from the outside edge of wetland/riparian vegetation or bank -top, whichever is greater. b. The applicant should be advised that any work within the 100 -year floodplain, consisting of but not limited to diversion or obstruction of the natural flow or changes in the channel, bed or bank of any stream channel will require prior notification to DFG pursuant to Fish and Game Code Section 1600 et seq. The agreement process is an action separate from the specific mitigation measures to be included as conditions of project approval by the lead agency. Pursuant to Public Resources Code Sections 21092 and 21092.2, the DFG requests written notification of proposed act -ions and pending decisions regarding this project. These drains are partially overgrown with thick vegetation that restricts flow and allows standing water to produce mosquitoes. We recommend that the blackberries and other obstructive vegetation and debris in and along all drain courses be removed and maintained free from obstructions. This will improve drainage.and allow greater access to these sources from district personnel for the purpose of inspections and treatments. We have in the past, stocked these creeks and ponds with mosquito eating fish to provide natural -mosquito control in this area. However with a greater influx of people into this area, it has become increasingly important for developers and landowners to eliminate mosquito breeding sources on their property. We urge the property owners to assume responsibility in helping to establish a more mosquito and disease free environment. These comments are consistent with the District's adopted policy called "Guidelines, Checklist and Standards for Vector Prevention in Proposed Developments". The Use Permit shall expire two years from the date of issuance of the Use Permit. Upon application, the Planning commission may grant an extension of the 41 Use Permit not exceeding one year. 6. In the event that the applicant who is residing within the mobile home or the conventional residence, for any reason, moves to another location or is deceased, then, in that event, the Use Permit granted herein shall automatically expire and the mobile home. shall be removed within one hundred twenty (120) days. Recently enacted legislation (AB 3158, Chapter 1706, Statutes of 1990, effective January 1) 1991) requires that the Department of Fish and Game impose and collect filing fees as specified to defray the cost of managing and protecting fish and wildlife trust resources. These filing fees are collected during the environmental review process and are to be paid at the time the County files a "Notice of Exemption" with the County Clerk pursuant to Section 21152 of the Public Resources Code. To increase administrative efficiency, the statute delegated the collection of filing fees to the County Clerk and provided the County authority to collect a $25.00 documentary handling fee. ANALYSIS: This project is a request to allow the placement of a mobile home as a temporary second dwelling on property located at 177 Self Lane in the Oroville area. The proposed mobile will be located on the eastern half of the 5.2 acre parcel approximately 220' east of the existing dwelling. the proposed mobile will not be located near any neighboring dwellings. The proposed location will not cause any hardship on the adjacent properties or result in any land use conflicts. The adjoining parcels are either vacant of are used for residential purposes. The temporary mobile will be used to house the applicant, who is the sister of the property owner. The applicant has not provided any information that supports the need for a temporary mobile home based upon the findings and intent contained in Section 24-303 which states: "The Board of Supervisors has found that for the health, safety and welfare of the people of the County that it has often become necessary, for the care of persons who by reason of old age, disease (either mental or physical), infirmity or other cause, are unable, unassisted, properly to manage and take care of themselves or would benefit from familial assistance, to allow mobile homes to be placed on smaller parcels than present County codes or ordinances permit so that such persons will not have to be institutionalized, but rather can reside near their close relatives who can help care for them. The ability to care for one's close relatives will not only result in better care for citizens, but will also negate in many situations the necessity for public assistance which many citizens find degrading and damaging to the pride of the persons concerned and their immediate relatives. This will also provide privacy and dignity for the relative as well as independence, of which these people are deserving." In addition, the applicants have adequate property to divide the parcel to create two legal parcels. If the required findings can be made, the temporary second dwelling would be appropriate. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also 2 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - March 16, 1992 makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double -wide mobile home. These amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers. The applicant proposes to place a single wide mobile home on the property. RECOMMENDATIONS: A. Find that this project is Categorically Exempt from environmental review; and B. Find that this proposed use of the property does not meet the intent of section 24-303 of the Butte County Code; and C. Deny the Use Permit to allow a mobile home as a temporary second dwelling on AP #036-310-110 (Mary Perry) If the required findings can be made then it would be appropriate to make the following recommendation: A. Find that this project is Categorically Exempt from environmental review; and B. Find that the proposed use will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare, and safety of the County because ; and C. Approve the Use Permit to allow a temporary mobile home as a second dwelling on AP #036-310-110 (Mary Perry) subject to the following conditions: 1. Occupancy of the mobile home is limited to Deane and Mary Perry. 2. The Use Permit shall expire two years from the date of issuance of the Use Permit. Upon application, the Planning Commission may grant an extension of the Use Permit not exceeding one year. 6. In the event that the applicant who is residing within the mobile home or the conventional residence, for any reason, moves to another location or is deceased, then in that event, the Use Permit granted herein shall automatically expire and the .mobile home shall be removed within one hundred twenty (120) days. In the event the mobile home is not removed within one hundred twenty (120) days - pursuant to the terms of the Use Permit, the County shall remove the mobile home and store it at the owner's expense. 7. The applicant is to pay a deposit or post a bond to cover the cost of removal in the amount of $1,500 for a single -wide mobile or $2,000.00 for a double -wide mobile. 8. Meet the requirements of the Building Division of the Butte County Department of Public Works. 9. There shall be a 50' "No Disturbance" setback that shall commence from the top of bank of the drainage way or the outside edge of the riparian vegetation, whichever is greater. 10. Meet the requirements of the Butte County Fire Department: a. The new driveway shall be a minimum of 10 foot wide and with a 15 foot vertical clearance. b. The new driveway shall be capable of supporting a 40,000 pound vehicle such as a fire engine. C.
