Dear Tom, I am writing this letter as a result of recent decisions made by the principals of Blakeley Western. A few months ago John Blacklock arranged a meeting with Supervisors Houx and Josiassen and Butte County Development Services. Jerry Blakeley and Bill Beck, Blakeley Western Principals were in attendance and later that day we spent quite a bit of time discussing the status of our proposed business research park. Bill Beck returned to Butte County for a meeting with you and staff members with more discussion and he recently returned for a lengthy discussion on the opportunities for a Blakeley Western Business Research Park in Butte County. Subsequently they have directed -me to notify the County of Butte that Blakeley Western wishes to withdraw General Plan Amendment/Rezone 98-03 effective immediately. in my opinion this truly represents a lost opliortunity for nutte County because of the wealth of experience the principals of Blakeley Western bring to this area. In fact Jerry Blakeley is credited with creating the concept of Business Parks in campus -like settings because of his Business Park development along Route 128 outside of Boston, MA. This experience has been achieved through the success of over fifty business parks in the U.S. and I believe would have contributed. greatly to the success of a needed -job center here in Butte County. ' As proposed, the General Plan Amendment and Zone Change Map would cause significant adverse environmental impacts. We recommend that an. Environmental Impact Report (EIR) be prepared to fully describe the impacts and that mitigation measures be provided for these concerns: 1. Vernal wetland impact assessment should be based on a wetland delineation, with a delineation map included in the EIR. 2. The DFG recommends avoidance of vernal pool wetland loss. While vernal pools can be artificially created, successful revegetation with affected plant species (especially sensitive species) appears limited. The DFG recommends that vernal pools be protected by: a., A 50 -foot no disturbance setback, commencing from the outer edge of -the pool's zone of influence should be established around each pool. The setback should be protected by a barrier to prevent compaction for other damage. b. No alteration of a pool's natural drainage, including artificial drainage into it. A qualified biologist should survey the project area (including lands adjacent to the project site which will be directly or indirectly affected by the project) for special concern, threatened, and endangered animal. species. Surveys should be of sufficient duration and frequency to insure an adequate detection probability (a 90 percent, or greater, probability should be attained). Aquatic ecosystems (streams, lakes, ponds, springs, and their associated wetlands) support a great biological diversity. Protection of this ecosystem safeguards watersheds and water quality, reduces sedimentation, and provides habitat for numerous species. A project's aquatic ecosystem impacts should be mitigated by: a. Establishing a 50 -foot no disturbance setback along stream channels (both banks), around lake (or pond) beds or around springs. The setback should commence from the outsido edge of wetland/riparian vegetation or bank/bed top, whichever is greater. No disturbance prohibits the use of the aquatic -wetland area for all types of waste disposal and drainage in addition to no vegetation removal. b. Advising the applicant that any work within the floodplain, consisting of but not limited to diversion or obstruction of the natural flow or changes in the channel, bed or bank of any stream channel will require prior notification to DFG pursuant to Fish and Game Code Section 1600 et seq. The agreement process is an action separate from the specific measures to be included as conditions of project approval by the lead agency. 8. Impacts on the water quality, aquatic habitats and species (with special reference to the spring -run chinook salmon) of Butte Creek should be thoroughly addressed as project site drainage is upstream of that creek. 9. Indirect and direct impacts on all habitats and species should be fully described. 10. Cumulative losses for many habitats and species have been significant locally and Statewide. Cumulative loss assessments should include percentages of habitat acreage and species population losses. 11. A number of Species of Special Concern occur locally, some of which are found on the project site. All local vertebrate species of this category should be considered. For example, a small burrowing owl colony is located one mile south of the project site. 12. Open space areas should not be fragmented by infrastructure, and they should be placed across the street from industrustrial/commercial/residential sites. • Mr. Craig Sanders November 20, 1997 Page Four • 13. In order to comply with Public Resources Code Section 21081.6, a detailed monitoring program must be developed for all required mitigation conditions. The monitoring program should include the following. •a. Specific criteria to measure effectiveness of mitigation. b. Annual monitoring for a minimum of five years. Annual written reports submitted to.the lead agency and the DFG. , 1 C. Annual monitoring reports, each of which include corrective recommendations that shall be implemented in order to ensure that mitigation efforts are successful. A wetland mitigation plan must be developed for this project if avoidance is not possible. The mitigation plan must be based on the concept of no net loss of wetland acreage or wetland value., The plan should, at a minimum, describe the methodology of restoration, species used for restoration (only native species indigenous to the area should be used), criteria to judge success of restoration (minimum 80 percent survival), and a contingency plan in the event of failure. Preferred location for mitigation is on-site. If the project is unable to fully mitigate project impacts to wetland habitats on-site, then a complete description of off-site mitigation should be described. Wetlands are considered waters of the Untied States and Department of the Army permits are required under Section 404 of the Clean Water Act prior to discharging dredge or fill material into them. The U.S. Army Corps of Engineers, 1325 J Street, Sacramento, California 95814-2922, telephone (916) 557-5100, will be able to help you with those permits. Any activity resulting in loss of habitat, decreased reproductive success, or other negative effects on population levels of State -listed threatened or endangered species may be constructed as "take" by the DFG. Take of a threatened or endangered species may be allowed after consultation with the DFG. This process would require a management plan entered into by the project proponent and the DFG that would require formalized mitigation to reduce the significance of the impact.' Similar Federal Endangered Species Act sections apply for federally -listed species. This project will have an impact to fish and or wildlife habitat. Assessment of fees under Public Resources Code Section 21089 and as defined by Fish and Game Code Section 711.4 is necessary. The Durham .Unified School District is concerned about the cumulative impacts from increases in -enrollment and our ability -to provide adequate .school facilities. As a consequence, the Board of Trustees has a policy requesting that new development within the district fully mitigate the impacts on the school district. The cost of providing the necessary permanent facilities, interim facilities, transportation and administrative support facilities amounts to $9,584 per residential unit. The formula used to determine this cost is rather complicated and is available for review. As this number is a couple of years old, we are in the process of updating the calculation to reflect current costs. I would like additional informaiiuli i- c;- a_....%din,.g this- proposal. As it also includes a rezone, I would like to see a specific plan regarding the residential portion of the project. I believe the proposal to rezone 35.8 acres to R-2 would allow for up to 465 residences. This would result in more than 300 additional students in our district. COMMENTS: The Blakeley Western Gateway Business Park, that is proposed on 286 acres along the west side of State Route (SR) 99 north of Neal Road, may have a significant impact on SR 99. A traffic study should be prepared which evaluates both AM and PM peak hour volumes for base and cumulative scenarios with and without the project. The traffic study should be coordinated with the anticipated SR 99/Chico Area Corridor Study and include other approved and proposed developments east and west of SR 99 within the corridor. Caltrans and Butte County Association of Governments (BCAG) have discussed the Study as part of the proposed 1998/99 FY Overall Work Program (OWP). The 1982 Freeway Agreement for this section of SR 99 plans for interchanges at Southgate and Neal Roads and the closure of the Estates Drive access to SR 99. A new signal was recently agreed to at SR 99/Southgate Avenue. The signal at this intersection is considered a long term interim improvement until an interchange is constructed. Caltrans will also allow the installation and operation of a new .traffic signal south of Chico at SR 99/Estates Drive until a frontage road is constructed between Estates Drive and Southgate Avenue, at which time Estates Drive will be permanently closed. The Business Park's proposed new at grade intersection with SR 99 will not be allowed. Caltrans would not recommend the California Transportation Commission (CTC) approve or new access to SR 99. The existing access at Estates Drive cannot be traded for a new location. Mitigation measures may be required to maintain Level of Service (LOS) D on State . facilities. The County should ensure corridor preservation for the frontage road between Estates Drive to Neal Road. Fair share traffic mitigation fees for the frontage road, SR 99 mainline improvements, and the future interchanges at SR 99/Neal Road and SR 99/Southgate Avenue should be collected. 0 Mr. Tom Parilo, Director Butte County Department of Development Services December 1, 1997 Page 2 0 Caltrans maintains at least six drainage facilities that convey runoff from east to west towards the proposed project area. This would include reductions in downstream velocities resulting in sediment aggradation. Any new at grade intersections or future interchange locations will need to be approved by both CalTrans and the County. Past discussions with CalTrans staff have indicated that they would not accept a new at grade intersection nor would they likely accept a "trade" with Estates Drive because Estates Drive is only a "temporary" access scheduled to be closed in the future when a frontage road is constructed that will connect Estates Drive with Southgate. Any proposed new interchanges or a "trade" with the Neal Road interchange, will need as a minimum; Engineering Feasibility Study, Preliminary Project Study Report and a detailed financial analysis on the costs associated with a new interchange or "relocating" the Neal Road interchange site. CalTrans should be consulted prior to any feasibility work to ensure that their informational needs are met. The feasibility and environmental analysis needs to consider land use on both sides of the proposed interchange, and the future traffic flows and accompanying LOS of the facility, as well as the relocation of any County roads needed to serve proposed interchange. The traffic impacts to existing County road and mitigations to retain a LOS C or better are also major traffic concerns. While it can easily be shown that development can reduce the time of concentration allowing the site to peak before the existing basin, development still has the ability to increase the intensity, duration , and frequency of flood events. ' Urban (development) runoff has also been credited with significant contribution to water pollution with highway related contaminants being flushed into the water system with each storm. Acceptable mitigation to these impacts together with best management practice must be developed in this EIR. The proposed method of sewage disposal is not indicated on the tentative map, however, if it is proposed to be a treatment plant with discharge into the storm drainage system. Adequate mitigations must be undertaken to not exacerbate any drainage problems and to maintain or improve current water quality. This individual rezone has no impact on the Fire Department, but the accumulative affect of rezoning to higher density developments is increased demand for fire protection services and higher costs to the county. This development in approximately half -way between the Butte County Station in south Chico and the station in Durham. The current National Fire Protection Association (NFPA) would call for a minimum of 12 firefighters and 1 chief officer for a fire in a low hazard residential area. For fires in a commercial area a medium response would require 16 firefighters and 2 chief officers. Fire protection in unincorporated Butte County has been rapidly changing from a primary rural area to an area with higher residential, commercial and industrial areas. The number of incidents has risen from 5460 in 1986 to a projected 13,000 incidents in 1997. The number of incidents combined with a demand for increased service in the areas of emergency medical response, rescues and hazardous materials responses has put a severe strain on both career and volunteer staffing. Normal staffing for career staffed engines would be 2 in semi --rural areas and 3 firefighters in more urban areas around Chico, Oroville, and Paradise. Currently Butte County has only 3 permanently funded fire stations with 2 person staffing and one other 2 person station funded jointly between Butte County and the City of Gridley. Fire protection in Butte County has historically relied heavily upon volunteer staffing. Increased incident load and the diverse and complicated types of calls with the demand of mandated training has had an effect on volunteer company strength. This has an adverse impact on the number of volunteer firefighters that can be expected to arrive at .scene, especially during the day light hours when volunteers are working. Many volunteer fire companies in Butte County are under strength. The Insurance Services Office (ISO), recently completed an evaluation of the CDF/Butte County Fire Department and as November 1, 1997 the ISO rating on those areas of the County that are located within 5 miles of a staffed fire station and within 1000 feet of a fire hydrant have an ISO r4�&RffjnolbiAsion N O V 17 1991 Oroville, California i - _ 4 This area with its own fire station will qualify for the 4. rating. Location of the site must be approved by the CDF/Butte County Fire Department and the preferred site would be as far north as' possible with an acceptable access to the freeway. 3. All new construction must meet the requirements of the California Fire Code. 4. All new structures must have class A roofs. 5. Some type of funding mechanism must be implemented to: a. staff the full time fire department personnel at the new fire station. The purpose of this letter is to summarize, some of the project direction we discussed at our meeting so that you have a clear understanding of our expectations. Project Status Applications for general plan amendment and rezoning were filed on October 27, 1997. As part of the process of determining application completeness, staff has distributed the October 1997 General Plan Amendment/Zone Change Map prepared by Gilbert Engineering to various County departments and other service providers to solicit feed- back. Preliminary comment letters have been received from the following: County Public Works, LAFCo, Environmental Health, Fire Department, Air Quality Management District, U.S. Army -Corps of Engineers, Caltrans, Cal. Dept. of Fish and Game, Cal. Regional Water Quality Control Board, Durham Unified School District, Cal Water, Durham Area Recreation District, PG&E, Durham Mutual Water Co. Please request copies of these letters if you do not already have them. As we discussed and agreed at our meeting, the application will be revised prior to further processing. The scope of the revisions are discussed below. Your revised application materials will be re -circulated for review and comment. The fees already submitted are still applicable and work will be billed against this deposit. Overall Approach As you know, the County provides for industrial development through the Industrial land use designation in the General Plan and the M-1 and M-2 zoning districts. However, based on the business park concept you have described, we have concluded that the existing General Plan and Zoning land use designations may not provide for the flexibility that you require. Furthermore, they do not provide a basis for design guidelines and other safeguards the County would like to see. As Mr. Parilo indicated, it is our expectation and understanding that the proposed. project, while providing economic benefits to the county, will be of a very high caliber in terms of site planning and design. To accomplish this objective, we strongly believe that a new General Plan land use designation and Zoning classification are needed. These new land use designations would be drafted to reflect and facilitate the high standards of this proposed project, but could also be applied elsewhere in the county. As we discussed, the most efficient approach to creating new County General Plan and Zoning designations is to , adapt applicable documents in use elsewhere. It is my understanding that you are in the process of collecting such documents, and will provide copies for our review and comment. Once we have reviewed the land use documents, we will provide direction to you for use in preparing draft texts. The draft general plan designation and associated zoning will become a key element of your application materials. Project Revisions Land Use. We have expressed concerns about the proposed inclusion of medium density residential land use on nearly 36 acres of the project site. In addition to exacerbating traffic problems in the area, the presence of dwellings could create land use conflicts within the proposed business park. It is our understanding that your revised application will show this land use replaced with business park uses. Circulation. As we have discussed, reference to creation of a new intersection with Highway 99 should be deleted from the application. As you know, the County's 1982 Freeway Agreement with Caltrans calls for closure of the Estates Drive/Highway 99 intersection and, ultimately, construction of new interchanges at Neal Road and Southgate Avenue. Caltrans will not allow new at -grade interchanges. Moreover, the applicability of an interchange, as shown on your map, with connecting roadways is questionable' since the land to the east (Swartz) is not proposed for development. • Application Materials 0 In addition to completed standard application forms, your revised application package should include four components, as follows: 1. Proposed General Plan Amendment/Rezoning Map. Revision of the exhibit dated October 1997, reflecting changes in proposed land use, circulation, and other issues. 2. Narrative. A project description narrative is needed to explain various key elements of the proposal that cannot be adequately addressed graphically on the GPA/Rezone map. First, there should be a description of the overall concept of the project. The text should also address and provide detailed information concerning other key issues we have already identified and discussed, such as the proposed land dedication to CSU, Chico, proposed storm drainage, proposed sewage treatment and disposal, and -circulation. 3. Conceptual Land Use Plan. This exhibit, which provides graphic information not appropriate for inclusion on the GPA/Rezone map, should consist of an overall illustrative land use diagram, with details as needed, that graphically depicts design concepts identified in the narrative, including the location of the sewage treatment plant. (A plan of this type was previously prepared for the Gateway Chico project.) 4. Proposed General Plan and Zoning Text. AsJndicated above, initially, you will provide County staff with copies of ordinances and general plan land use descriptions adopted and in use elsewhere. Following discussions among County staff and with you, draft text will be prepared and distributed for wider review along with the other application materials. It is understood that you will prepare the draft text based on our direction. Environmental Review Process As you are aware, an environmental impact report will be required for the proposed General Plan Amendment -and Rezone. The scope of the analyses will be determined following the Notice of Preparation process. Hopefully, some economy in both cost and time can be achieved by using background information contained in the Gateway Chico EIR (SCH 93122063), even though it was never certified by the County. Also, background data collected for the Blakeley Western residential project EIR may be applicable to the project site.... Certain technical studies will be required as part of the environmental review process. Some studies that have already been completed may be useful. To date, you have provided us with the following: 1) Market Support for 300 -acre Chico Gateway Development, Chico, California, September 1992, Economic Research Associates; 2) The Economic Impact of Gateway Chico . on Butte County, California, September 6, 1994, Regional and Economic Sciences; and 3) Preliminary Wetland Assessment Map, January 19, 1993, Sugnet and Associates. Please provide us with copies of any other studies that have been prepared that have a bearing on your project and the project vicinity. Also, you are encouraged to provide a detailed description of which aspects of the Chico Gateway project are incorporated in your current proposal. It is our expectation that, with a sufficient level of information in the project description, the EIR should be adequate to address subsequent tentative maps and most other land use applications ultimately required within the project area, thereby eliminating the need for preparation of additional EIRs. However, it is premature to make this determination at this time. Upon submittal of all requested application materials and all available background studies, we will initiate the environmental review process, beginning with preparation and distribution of a Notice of Preparation.
