K:\FORMS\UNIFORM APPLICATION Page 2 of 2 Kopsa General Plan Amendment & Rezone APN 036-160-045 PROJECT DESCRIPTION The property is approx. 5 acres of vacant level land fronting on Las Plumas Avenue adjacent on the east side of Oakdale Heights School in south Oroville. The land is currently zoned R-3 with a General Plan designation of Public. The owner acquired the property from a church and wishes to change the designation to Medium Density Residential (MDR), consistent with the surrounding residential and vacant properties. The current zoning is also requested to be changed to R-2 as the owner is contemplating single-family and duplex housing options in the future. No plans for the design and construction have been established at this time. There are a few willow trees, oaks and some brush along the westerly edge of the property adjacent to the drain from the school playground. Garbage has accumulated around the drain and outfall ditch, which crosses the southerly portion of the property and heads easterly to a larger swale running north and south, ultimately to the Wyman Ravine drain basin. Some green waste has also been dumped onto the property. The property is within the South Feather Water and Power District and the Lake Oroville Area Public Utility District, suppliers of water and sewer service respectively. A sewer pump station is located across Las Plumas Avenue just east of the property. Fire hydrants and overhead utilities are located along the property frontage. The grammar school playgrounds are adjacent westerly, vacant lands and Las Plumas High School are easterly, vacant lands and a church are to the south and single- family and multi -family homes are across Las Plumas Avenue on the north. The land is currently zoned R-3 with a General Plan designation of Public. The owner acquired the property from a church and wishes to change the designation to Medium Density Residential (MDR), consistent with the surrounding residential and vacant properties. The current zoning is also requested to be changed to R-2 as the owner is contemplating single-family and duplex housing options in the future. No plans for the design and construction have been established at this time. There are a few willow trees, oaks and some brush along the westerly edge of the property adjacent to the drain from the school playground. Garbage has accumulated• around the drain and outfall ditch, which crosses the southerly portion of the property and heads easterly to a larger swale running north and south, ultimately to the Wyman Ravine drain basin. Some green waste has also been dumped onto the property. The property is within the South Feather Water and Power District and the Lake Oroville Area Public Utility District, suppliers of water and sewer service respectively. A sewer pump station is located across Las Plumas Avenue just east of the property. Fire hydrants and overhead utilities are located along the property frontage. The grammar school playgrounds are adjacent westerly, vacant lands and Las Plumas High School are easterly, vacant lands and a church are to the south and single- family and multi -family homes are across Las Plumas Avenue on the north. The parcel is located within the EI Medio Fire Protection District. LAFCO has prepared a Draft Municipal Service Review (MSR) for the District which finds the District to be underfunded and unable to consistently and reliably produce the staffing necessary for safe and effective fire protection and medical aid responses. While this MSR has not yet been adopted in final form, it clearly provides substantial evidence that fire protection for this proposal is a significant impact. Adequate mitigation measures would only be feasible if they included increased funding or other cooperative fire service protection agreements with neighboring fire agencies. Such an agreement would require the approval of LAFCO pursuant to Government Code Section 56133. LAFCO requests that the Initial Study be circulated to our agency for review. CSAISSUES • 3. If urban type services (e.g. street lighting, landscaping, drainage, fire protection, etc.) for the new development are proposed to be provided by a new county service area (CSA), LAFCO should be consulted early, as the Commission has concerns about the continued use of CSA's in place of annexations to existing urban service providers. If a CSA is proposed to provide services, this should be fully addressed in the appropriate environmental documents. The creation of new governmental entities such as a county service area must be approved by LAFCO. Such a request would be reviewed based on state law and local LAFCO policies which are clearly directed at maximizing service efficiencies, minimizing the creation of new governmental entities and limiting urban sprawl. Conceptually, it was designated public for a reason, and we should evaluate whether it makes sense to alter it. We may or may not be able to do so in advance of the GP update. The rezone, which is a down zone of a higher density zone should be evaluated to see if it lessens housing numbers we are using with the state to meet our housing quotas. The rezone, which is a down zone of a higher density zone should be evaluated to see if it lessens housing numbers we are using with the state to meet our housing quotas. COUNTY COUNSEL'S IMPARTIAL ANALYSIS OF MEASURE G The Butte County Counsel has prepared the following impartial analysis of Measure "G" pursuant to Elections Code Section 9313. This analysis is not an argument for or against the measure. This measure is being submitted to the voters within the EI Medio Fire Protection District (the "District"), pursuant to the requirements of Proposition 218, which was approved by California voters in November 1996. Proposition 218 prohibits a special tax increase within the District unless and until the increase is submitted to the voters within the District and approved by a two-thirds vote. This measure would authorize an increase in the special tax within the District for fire protection and prevention, as specified in Resolution R-04-003, adopted by the Board of Directors of the District on July 7, 2004. If the measure is approved by two-thirds or more of the votes cast on the measure, the increase in the special tax will be imposed on real property in the District for fiscal year 2005-06 and each fiscal year thereafter. The amount of the special tax increase for each parcel of real property would be based upon the classification of improvements and uses of the property, as specified below: a. Unimproved parcels: An additional Twenty-five Dollars ($25.00) per parcel up to and including five (5) acres; plus an additional One Dollar ($1.00) for each additional acre or fraction thereof. b. Improved parcels: i. Residential. An additional Sixty Dollars ($60.00) per residential dwelling unit. In the case of mobile home parks, courts and sites, the tax will be based upon the number of mobile home spaces (units), whether occupied or not, plus an additional unit for common facilities. ii. Commercial: An additional One Hundred Twenty-five Dollars ($125.00) for the first 1,000 square feet, or fraction thereof, under roof, plus an additional Five Dollars ($5.00) for each additional 1,000 square feet or fraction thereof, under roof. iii. Commercial, involving significantly higher risk of fire damage or hazards: An additional Two Hundred Dollars ($200.00) for the first 1,000 square feet, or fraction thereof, under roof, plus an additional Five Dollars ($5.00) for each additional 1,000 square feet or fraction thereof, under roof. The special taxes imposed by the District could not be increased in the future unless another election were held in the District approving the increase by two-thirds or more of the votes cast. The General Plan designation and the zoning are not consistent with each other. The parcel should be zoned P -Q (Public, Quasi -Public) or should have a land use designation of Medium or High Density Residential in order to be consistent. There is some.history with this parcel-. about three years ago a developer (Alpha 111) proposed to put in a high density residential complex and submitted an application for a development agreement in order to take advantage of a density bonus (the application was subsequently withdrawn by the applicant). At that time, Randy Wilson -and I had concerns about the inconsistency and had County Counsel (Neal McCabe) review the issue.: He determined that the apartment complex was allowed by right, even though the General Plan was not consistent with the zoning. However, I don't believe McCabe's determination was an "official" opinion and I do not have a lot of confidence in it. After Alpha III dropped the development agreement I believe they wanted to develop to the density allowed by the R-3 zone. I know Meleka talked to them and'I think he told them that a General Plan amendment was needed irf order to allow the high density use. Since Meleka is no longer with the County I cannot verify this. 1 am sure that Yvonne also would not agree with allowing a R-3 use until such time as the land use designation was changed to Medium or High Density Residential. I tired to find the file on the development agreement project, but it is missing. It may be in Meleka's stuff, which consists of about ten large boxes of files. I will still try to find the file and let you know.if I find anything. Where does that leave the prospective buyer? If he/she is looking to develop the parcel with a high density use, then a General Plan amendment to Medium or High Density residential is needed (this is my opinion, which may not reflect the County's official opinion). A General Plan amendment would require environmental review, possibly an EIR given the nature of the existing neighborhood (mostly low density residential with some public uses), the impacts to the nearby schools, and vehicle circulation impacts. I am sure the neighborhood would be against any high density residential use of the parcel, which is another reason why I believe that a General Plan Amendment would be necessary. If the potential buyer is still interested you may want to write a letter to Yvonne requesting that County Counsel render an opinion on this issue. I hope the above information helps you out.
